Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have passed the same, with amendments.

A message from the Assembly was received and read, informing that they had concurred in the passage of the bill entitled "An act to authorize Wynant G. Vandenburgh, the only surviving member of the Consistory of the Reformed Protestant congregation, of Halfmoon, Saratoga county, to alienate certain real estate belonging to said congregation," with the following amendment:

Insert the following as section 3.

"Sec. 3. The foregoing provisions of this act shall not invalidate any contracts heretofore entered into between the Consistory of the Reformed Protestant Congregation of Halfmoon and the Trustees of the School district now occupying said premises.

Mr. Scott moved that the Senate concur in the amendment. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in their amendment.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the Assembly bill entitled as follows:

66 'An act to amend and consolidate the existing laws in relation to the State prisons."

And after some time spent therein, Mr. Paterson, from said committee, reported progress on said bill, and asked leave to sit again.

Mr. Noxon moved that the committee of the whole be discharged from the further consideration of said bill, and that the same be ordered to a third reading.

Mr. Sloan moved to lay that motion on the table.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative, as follows:

ceive a message of the Assembly.

A message from the Assembly was received, returning the bill entitled "An act making appropriations for certain expenses of government for the year 1859," informing that they had concurred in the amendments of the Senate thereto, with the further amendments, as transmitted.

Mr. Diven offered the following resolution:

Resolved, That the Senate insist on their amendments, and refuse to concur in the amendments made to the bill by the Assembly since last in the Senate, and that a committee of conference be requested.

Mr. Paterson called for a division of the question.

The President put the question whether the Senate would agree to so much of the resolution as insists upon the amendments of the Senate, and it was decided in the affirmative, as follows:

The President then put the question whether the Senate would agree to so much as relates to non-concurrence with the amendments of the Assembly, and ask for a committee of conference, and it was decided in the affirmative, as follows:

The President appointed as a committee of conference on said bill, on the part of the Senate, Messrs. Diven, Ely and W. A. Wheeler. Ordered, That the Clerk transmit said bill to the Assembly, with proceedings of the Senate had thereon.

A message from the Assembly was received, returning the bill entitled "An act to enable the supervisors of the city and county of New York to raise money by tax," informing that they had concurred in the report of the committee of conference on said bill.

Ordered, That the Clerk return said bill to the Assembly. Mr. Mather moved that the Assembly bill entitled "An act to amend an act entitled 'An act for the better regulation of the Firemen of the city of New York," now have its third reading.

The President put the question whether the Senate would agree

to said motion, and it was decided in the affirmative.

By unanimous consent, Mr. Schell moved that the committee of the whole be discharged from the further consideration of the Assembly bill entitled "An act providing for the appointment of an additional number of notaries public in the city and county of New York," and that the same be now ordered to a third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.
