No. 26. House bill to amend and re-enact an act entitled an act to regulate the working of the public roads in the counties of Prince William. Montgomery, Chesterfield and Lancaster, approved February 25, 1878.

No. 27. House bill to amend and re-enact 26th section of an act entitled an act to provide for working and keeping in order the roads. of the commonwealth, approved March 20, 1875.

No. 28. House bill in relation to the assessment of real property or purposes of municipal taxation in the city of Alexandria, and to exempt and except said city from the operation of an act entitled an act to provide a basis of municipal taxation on the real property in cities and towns, approved March 29, 1877.

Mr. TAYLOR of Fluvanna moved that the House do now adjourn; which was rejected-yeas 46; nays 67.

A communication from the Senate, by their clerk, was read as follows:

In Senate, December 14, 1878.

The Senate have passed House bills entitled an act to incorporate the Union bridge company, No. 6, and an act to incorporate the the Planters savings bank at Chatham, Virginia, No. 29.

They have passed, with amendment, House bill entitled an act for the relief of the sureties of John Huddleson, late collector of Central township, of the county of Rockingham, No. 2.

And they have passed a bill entitled an act for the relief of Thomas Wilson, of Montgomery county, No. 33.

In which amendment and bill they respecfully request the concurrence of the House of Delegates.

No. 2. House bill, was referred to the committee on finance.

No. 33. Senate bill was read twice and referred to the committee on finance.

No. 22. Senate bill entitled an act to incorporate the Clover masonic building association, was reported from the committee of propositions and greivances.

No. 34. House bill to provide for the protection of fish in the Appomattox river, reported from the committee on Chesapeake and its tributaries, was read a first time.

The following reports were agreed to:

Committee for schools and colleges have, according to order, had under consideration certain resolutions of the county school board of Prince William county, in relation to the public school tax, and recommend adoption of the following resolution:

Resolved, That the committee for schools and colleges be discharged from the further consideration thereof, and that the same be referred to joint committee on constitutional amendments.

The committee on privileges and elections have had under consideration a resolution to them referred, to enquire into the expediency of so amending the constitution as to reduce the number of elections now held by causing the election of city, county and state officers to be held on the same day with elections for members of the general assembly, and adopt the following:

Resolved, That the committee be discharged from its further consideration, and that the same be referred to the joint committee on constitutional amendments.

Senate joint resolution returning thanks to W. W. Corcoran, Esq., of Washington city, for the gift of a valuable painting, was, on motion of Mr. GRAVES, passed by.

Mr. ASHTON, under a suspension of the rule, offered the following resolution:

Resolved, That the governor be and he is hereby requested to inform the House what action has been taken by him under an act approved February 25, 1878, entitled an act to empower the governor of Virginia to enter into negotiation with the governor of Maryland in relation to marking and designating the boundary line between the states of Virginia and Maryland, and that he further inform the House what action, if any, has been taken by the legislature of Maryland and the Congress of the United States as to the ratification of the award of J. S. Black and Charles J. Jenkins, establishing the boundary line between the states of Virginia and Maryland. The resolution was agreed to.

Mr. STEVENS offered the following resolution:

Whereas the James river and Kanawha company was authorized to issue its bonds for the sum of three hundred and fifty thousand dollars, for the purpose of connecting the canal with tidewater, and to secure the payment of the interest and principal thereof was authorized to pledge the net revenues of the dock, including water privileges, &c.; and whereas the said bonds were guaranteed by the state and have been converted into registered bonds of the state, and have thereby become an absolute indebtedness of the state; therefore be it

Resolved, That the committee for courts of justice be instructed to report to this House whether the state has by any act deprived herself of the right to assert her claim to the net revenues and rents authorized to be pledged as aforesaid.

The House refused to refer the resolution to a committee.

The resolution was agreed to.

Leave of absence was granted Mr. ALLEN for four days.

Resolved, That the joint committee on constitutional amendments. be and are hereby required and instructed to enquire into and report upon the expediency of returning to the old magisterial system of county courts.

By Mr. JORDAN:

Resolved, That the joint committee on constitutional amendments be and are hereby instructed to enquire into and report upon the expediency of so amending the constitution as to allow the counties and public free school districts, to raise additional sums by a capitation tax

for the support of public free schools, to be used exclusively in said counties and public free school districts.

By Mr. BLAND:

Resolved, That the committee for courts of justice be requested to enquire into the expediency of so amending the law as to allow pay to all persons summoned and in attendance upon the courts as veniremen, until discharged, whether they serve on the jury or not.

Resolved, That the committee on asylums and prisons be instructed to inquire whether or not the directors of the state penitentiary have exceeded their powers, by illegally purchasing supplies for said penitentiary.

By Mr. FULTON:

Resolved, That the fish commissioner is hereby instructed and directed to collect and lay before the general assembly such information in regard to the oyster and fish culture; the extent of the public domain suited to this culture; the present and possible fish and oyster product of the Virginia tidal waters; and the peculiar advantages of our waters for rearing, and taking oysters and fish, as will throw light on the question of the feasibility and expediency of dividing our tida domain into sections and leasing the same for a long term of years. Referred to Committee on the Chesapeake and its tributaries.

By Mr. FAUNTLEROY: A bill to amend and re-enact section 27, chapter 16, of an act approved March 14, 1878, revising, amending and re-enacting the laws regulating crimes and punishments. Referred to committee for courts of justice.

By Mr. SYKES: Petition of citizens of Norfolk county, protesting against the passage of a bill to authorize J. A. Borden to close and dam Little Bridge creek in said county. Referred to committee on roads and internal navigation.

By Mr. FARR: A bill to amend and re-enact section 5, of an an act to amend and re-enact section 4 of an act to incorporate the Mt. Ver non ladies association of the Union, passed March 9, 1878, and to add an additionad section, approved April 4, 1877. Referred to committee on propositions and grievances.

Resolved, That the committee of finance be and it is hereby instructed to enquire and report to this body, as soon as may be practi

cable, where are the plates from which were engraved the bonds and coupons issued under the funding act, approved March 30, 1871; whose property and in whose custody they are; and whether or not any legislation is needful to secure the state against their illigitimate use.

No. 8. Senate bill entitled an act to incorporate the Afton brotherhood in Nelson county, to conduct a mutual life insurance company was read a third time and passed.

No. 24. House engrossed bill to amend an act entitled an act to define the limits of tide-water on the south side of James river, approved March 14, 1878.

No. 25. House engrossed bill to enable the board of supervisors of Chesterfield county to assist the Manchester free bridge commissioners in keeping the free bridge in repair.

Motions severally made to reconsider the votes by which House engrossed bills Nos. 20, 23, 24, 25, 26, 27, and 28 were passed, were rejected.

No. 30. House bill authorizing the use of district school funds for the payment of teachers, was read a second time and ordered to be engrossed to be read a third time,

Mr. FARR moved to reconsider the vote by which the bill was ordered to be engrossed; which motion was rejected.

No. 32. House bill to extend the time for the repeal of the present fence law in the magisterial district of Rowanty, in the county of Dinwiddie, was read a second time and ordered to be engrossed to be read a third time.
