Mr. Brackett moved that said bill be substituted for Senate bill No. 1290, Int. No. 922, of the same title, now on the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. Said bill was then read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

Mr. Brown offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor, requesting the return to the Senate of Senate bill No. 284, entitled "An act to amend the Fisheries, Game and Forest Law, relating to unlawful devices and explosives for the taking of fish" (Int. No. 280), for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative. Ordered, That the Clerk deliver said resolution to the Assembly, and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

The Assembly returned the bill (No. 1240, Senate reprint No. 1270, entitled "An act to amend the Labor Law, relating to the employment of women and children at polishing or buffing" (Rec. No. 317), with a message that they have concurred in the amendments of the Senate thereto.

Ordered, That the Clerk return said bill to the Assembly.

The Assembly sent for concurrence a resolution, in the words following:

Resolved (if the Senate concur), That a respectful message be sent to the Governor, requesting the return to the Assembly of Assembly bill No. 1015, entitled "An act to grant to the city of Yonkers certain land under water on the Hudson river, below high water mark, for purposes of a public street and bridge, and certain other land adjacent thereto for slip purposes" (Rec. No. 505), for the purposes of transmitting the same to the mayor of the city of Yonkers.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Also, the following:

Resolved (if the Senate concur), That a respectful message be sent to the Governor, requesting the return to the Assembly of Assembly bill No. 1273, entitled "An act to amend chapter 425 of the Laws of 1896, entitled 'An act to amend the charter of the city of Poughkeepsie,' as amended by chapter 232 of the Laws of 1898” (Rec. No. 248), for the purposes of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative. Ordered, That the Clerk return said rosolution to the Assembly, with a message that the Senate have concurred in the passage of the same.

The Assembly returned the bill (No. 953) entitled "An act to amend chapter 361 of the Laws of 1897, entitled 'An act to incorporate the city of North Tonawanda (Int. No. 799), with a mes

sage that they have concurred in the passage of the same.

Ordered, That the Clerk transmit said bill to the mayor of the city of Lockport for a hearing, pursuant to the provisions of the Constitution.

The Assembly returned the following entitled bills, with a message that they have concurred in the amendments of the Senate thereto:

"An act to organize a fire department and board of fire commissioners in and for the city of Schenectady." (No. 738, Rec. No. 149; Senate reprint No. 1327.)

"An act to amend section 409 of the Penal Code, relative to dangerous weapons." (No. 456, Rec. No. 103; Senate reprint No. 1312.)

Ordered, That the Clerk return said bills to the Assembly.

The bill (No. 669) entitled "An act to amend chapter 478 of the Laws of 1893, entitled 'An act to incorporate the city of Olean,' relating to the powers of the common council" (Int. No. 601), was returned by the mayor of the city of Olean, with a certificate that a public hearing had been duly held on said bill in pursuance of law, and that the mayor and local legislative body had duly accepted the same.

Ordered, That the Clerk deliver said bill to the Governor.

The Assembly returned the bill (No. 963) entitled "An act relative to the new East river bridge, authorized to be constructed by chapter 789 of the Laws of 1895, entitled 'An act to authorize the construction of a bridge over the East river, between the cities of New York and Brooklyn'" (Int. No. 162), with a message that have concurred in the passage of the same.

Ordered, That the Clerk transmit said bill to the mayor of the city of New York for a hearing, pursuant to the provisions of the Constitution.

Mr. Marshall, from the committee on printed and engrossed bills, reported as correctly printed the bills entitled as follows:

Mr. White, from the committee on public education, to which was referred the bill introduced by Mr. Ambler, Int. No. 748, entitled "An act for the registration of institutions and schools. for the education of the blind, deaf-mutes, and other defectives. as educational institutions in the department of public instruction, and to provide for their visitation and inspection by that department" (No. 861), reported the same to the Senate with some amendments, and the title amended so as to read "An act for the registration of institutions and schools for the education of the blind and of deaf-mutes, as educational institutions in the department of public instruction, and to provide for their visitation and inspection by that department, and in relation to the teachers and pupils in such institutions," which report was agreed to.

On motion of Mr. White, and by unanimous consent, said bill was ordered printed and recommitted to the committee on public education.

Mr. Brackett, from the committee on the judiciary, to which was referred the Assembly bill introduced by Mr. M. E. Lewis, Rec. No. 314, entitled “An act to legalize certain acts of the board of supervisors of Monroe county in relation to the publication of their official proceedings " (No. 1515), reported in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Johnson, from the committee on public health, to which was referred the Assembly bill, introduced by Mr. Coughtry, Rec. No. 90, entitled "An act to amend chapter 661 of the Laws of 1893, entitled 'An act in relation to the public health, constituting chapter 25 of the general laws,' as amended by chapter 860 of the Laws of 1895, as amended by chapter 840 of the Laws of 1896, relating to the practice of veterinary medicine" (No. 765), reported in favor of the passage of the same, with some amendments (Senator Johnson dissenting), which report was agreed to.
