Inspector of nuisances to inspect chairs and carriages By the Act.-Compensation may be awarded to driver or chair- Wilfully injuring chair or carriage, £5 penalty, and compensation to proprietor (sec. 67. page 118). N.B.-By Section 79 of the "Cheltenham Improvement Act," page 110, the term "Hackney Carriages," in the "Police Clauses' Act," is to include sedan chairs, wheel chairs, and fly chairs drawn by men, and the word 66 Driver" is to include the word "Chairman," and the word "drive" is to include the word "draw." Section 41 of the "Police Clauses' Act," page 112, is amended, to the effect that the name, place, and abode of the driver shall be stated in the licence. Section 44, page 112, also is amended, to the effect that notice shall be given of change of abode of the driver. Section 45, page 113, also is amended, to the effect that the proprietor shall not permit the chair or carriage to be drawn or attended by any other person than the person named in the licence, except in case of illness or absence from some unavoidable cause, but it is not necessary to obtain a licence for a driver. Sections 51 and 52, page 114, are not to extend to hired chairs. By Section 81 of the "Cheltenham Improvement Act," page 119, the provisions thereof (incorporated or otherwise,) are not to extend to any private chairs or carriages; and by Section 82, page 120, all fines and forfeitures are to go to the Borough Fund, except overcharges for fares, which may be ordered to be paid to the parties aggrieved. BYE-LAWS, &c. 1.-Definition. In these Bye-Laws, the terms" Hired Chairs" and "Hackney Carriages" mean "Chairs" and "Carriages" standing or plying for hire in the streets of the Borough of Cheltenham, and the term "CHAIRS" relates and is to extend to such Chairs, whether Sedan Chairs, Wheel Chairs, Hand Fly Chairs, (heretofore known as Fly Carriages drawn by men,) or the like, and whether carried or drawn by one or two men; and the term "CARRIAGES" relates and is to extend to such Hackney Carriages, whether Coaches, Flys, Carts, Gigs, or the like, and whether drawn by one or more horses, ponies, mules, or donkeys; and the terms "Proprietors," "Drivers," or Chairmen," relate to such " Carriages" and "Chairs ;" and the word "Street" is to include lane, alley, road, square, or other public passage or place in the Borough, unless such meanings be repugnant to the context; and the penalties hereby imposed attach to every offence unless it be otherwise stated. CHAIRS. 2.—Extreme Distance for Chairs.-The distance fixed by order of the Commissioners within which Chairs shall be compellable to go with fares, is two miles from the General Post Office, Cheltenham. 3.-Fares for Chairs.-The several fares for distance and time, respectively, hereinafter set forth, and no higher fares, shall be demanded or taken. SEDAN CHAIRS. For carrying One Person. The fare for any distance not exceeding a quarter of a mile, or 440 yards, shall be And for every quarter of a mile commenced beyond the first quarter of a mile .... Fares for Time. The fare for any time not exceeding one hour shall be ...... And for every half hour commenced after the first hour...... WHEEL CHAIRS. For carrying One Person. Fares for Distance. The fare for any distance not exceeding one quarter of a mile, Beyond a quarter of a mile, and not exceeding half a mile .. The fare for any time not exceeding one hour, shall be HAND-FLY CHAIRS. ...... The fare for carrying one person any distance shall be the same as above mentioned in reference to Sedan Chairs hired for distance. And for carrying two or more persons any distance, the fare shall be one half more than for carrying one person the same distance. Fares for Time. The fare for any time and for carrying one person shall be the same as above mentioned in reference to Sedan Chairs hired for time. Appendix Appendix No. 7. s. d. The fare for the first hour, and for carrying two or more persons 3 0 And for every half hour commenced after the first hour, and 1 6 4.—Remuneration to Chairmen Called but not Employed.— When a Chairman is called to take up a fare, and proceeds with his Chair to the place directed, and is then sent away without such fare, every such Chairman shall be entitled to receive Sixpence, if he came a distance not exceeding one quarter of a mile from the nearest stand, or One Shilling, if such distance were more than a quarter of a mile, and in case he be detained longer than ten minutes he shall be entitled to receive Sixpence for every quarter of an hour commenced after the expiration of the first ten minutes. 5.-Stands for Chairs.-The Stands for Chairs shall be at the places under mentioned, and not more than the number of Chairs set opposite the names of such stands shall at any one time be placed upon any of the Stands. The south side of the High Street, opposite the Belle Vue Buildings .... 3 6.-Number of Chair and Names of Chairman to be Displayed.Every Chair shall be numbered with a number corresponding to the number of the license of such Chair, and such number and the name of the Chairman or Chairmen licensed thereto, shall always be kept painted thereon, of a colour different from and in strong contrast with the colour of the ground of such Chair, in a proper and conspicuous manner, to the satisfaction of the Inspector of Nuisances. Any person offending, either by using or working a Chair not so numbered and named as aforesaid, shall forfeit a sum not exceeding Ten Shillings. 7.—Hand-Fly Chairs not to go on Footpaths.-No Hand-Fly Chair shall be permitted to stand or be drawn along or over any of the footpaths within the Borough, with or without a fare. Any Chairman offending contrary thereto shall forfeit a sum not exceeding Ten Shillings. 8.-Chairmen to keep on outer edge of Footpath.-No Chairman shall carry or wheel a Sedan or Wheel Chair upon any of the footpaths within the Borough, when without a fare in such Chair. And the Chairman shall, when working any Chair with a fare, at all times keep the Chair on the outer edge of the footpath, and on the side nearest the carriage road, (if any,) and also shall at all times allow sufficient room for foot passengers, so as not to obstruct their free and uninterrupted passage along the footpath. And the Chairman is on all occasions to study the convenience of foot passengers, and not to demand of the foot passengers to make or give way, but to wait a reasonable time till the passage is clear. Any person offending contrary hereto shall forfeit a sum not exceeding Ten Shillings. Appendix 9.-Chairman when waiting to keep on Carriage Way.-Every Chairman shall at all times, while waiting for a fare, keep his Chair on the carriage-way, (if any,) and not on the footpaths. Any person offending contrary hereto shall forfeit a sum not exceeding Ten Shillings. 10. At crossings Chairmen to give way to Foot Passengers.—At all crossings the Chairman is to draw aside and give up the same to foot passengers. Any person offending contrary hereto shall forfeit a sum not exceeding Ten Shillings. 11.-Sedan Chairs and Hand Fly Chairs to be Lighted.-Every Chairman when using his Chair between half an hour after sunset and half an hour before sunrise, shall have in case of a Sedan Chair a lantern in front, and in case of a Hand Fly Chair two lamps affixed thereto, approved of by the Inspector of Nuisances, properly lighted. Every person offending contrary hereto shall forfeit a sum not exceeding Ten Shillings. 12.-Poles of Sedan Chair to be taken out. The poles of every Sedan Chair, while on any stand, or waiting with or for a fare, shall be taken and remain out. Every Chairman offending contrary hereto shall forfeit a sum not exceeding Ten Shillings.
