The Senate met pursuant to adjournment.

Prayer by Rev. John Raleigh.

The journal of yesterday was read and approved.

Mr. Dunnigan introduced a bill (Int. No. 432) entitled "An act to amend the Election Law, in relation to the statement of age of voter on registration," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Giorgio introduced a bill (Int. No. 433) entitled "An act to amend the Greater New York charter, in relation to pensioners holding office," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Straus introduced a bill (Int. No. 434) entitled "An act to amend the Civil Service Law, in relation to transfers," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on civil service. Also, a bill (Int. No. 435) entitled "An act to amend the Civil Service Law, in relation to the appointment, removal and term of office of municipal civil service commissioners," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on civil service. Mr. Schackno introduced a bill (Int. No. 436) entitled "An act to amend the Code of Criminal Procedure, in relation to court officers in Bronx county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on codes.

Mr. Thayer introduced a bill (Int. No. 437) entitled "An act to amend the Town Law, in relation to power of town board to make appropriation for hospital purposes," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (Int. No. 438) entitled "An act to amend chapter twenty-nine of the Laws of nineteen hundred and two, entitled 'An act to make the office of sheriff of Franklin county a salaried office, in part, and to regulate the management thereof,' in relation to the salary of such officer and the salaries and number of his subordinates," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public high

ways.

Also, a bill (Int. No. 439) entitled "An act to amend the Highway Law, in relation to creating new State routes and county highways in Franklin county," which was read the first time. and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (Int. No. 440) entitled "An act to amend the Town Law, in relation to limitation of indebtedness of a town," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (Int. No. 441) entitled "An act to amend the Town Law, in relation to appropriations for purchase and maintenance of fire apparatus, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Mr. Russell introduced a bill (Int. No. 442) entitled "An act to amend the Banking Law, in relation to investments of savings banks in promissory notes secured by the assignment or pledge of mortgages on real estate," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

Mr. Thompson introduced a bill (Int. No. 443) entitled "An act to amend the Highway Law, in relation to a new State highway in Suffolk county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Mr. Byrne introduced a bill (Int. No. 444) entitled "An act extending to all cities of the State the application of certain acts of the Legislature passed in the years nineteen hundred and twenty, nineteen hundred and twenty-one and nineteen hundred and twenty-two, in relation to defenses in actions based upon unjust, unreasonable and oppressive agreements for the rent of premises and to summary proceedings for the recovery of real property," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Schackno introduced a bill (Int. No. 445) entitled "An act to amend the Penal Law, in relation to the disposition and sale of cocaine or eucaine," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on codes.

Mr. Russell introduced a bill (Int. No. 446) entitled "An act to locate in part the boundary lines between the counties of Kings and Queens," which was read the first time, and by unanious consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public high

ways.

Mr. Mastick (by request) introduced a bill (Int. No. 447) entitled "An act to amend the Public Service Commission Law, in relation to charges by gas corporations," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public service.

Mr. Lacey introduced a bill (Int. No. 448) entitled "An act

to confer jurisdiction upon the Court of Claims to hear, audit and determine the claims of Louise L. Groess and George E. Groess against the State for damages alleged to have been sustained by them on July nineteenth, nineteen hundred and nineteen, growing out of personal injuries received by Louise L. Groess while sitting on a public bench located in grounds surrounding the State School for the Blind, located at Batavia, New York, by reason of the breaking of a large decayed limb from a tree located therein, and to render judgment therefor," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Ryan introduced a bill (Int. No. 449) entitled "An act to provide for the construction of a stock-judging coliseum on the State Fair grounds at Syracuse, and for the improvement of said grounds, and making an appropriation therefor," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Mr. Cotillo, from the committee on the judiciary, to which was referred the Senate bill introduced by Mr. Robinson (No. 220, Int. No. 220) entitled "An act to legalize, ratify and confirm the acts and proceedings of the town of Arietta, Hamilton county, its voters, officers and agents, and the acts and proceedings of the board of supervisors of the county of Hamilton, in relation to the issuance and sale of town bonds of such town and to provide for the sale and payment of such bonds," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Cotillo, from the committee on the judiciary, to which was referred the Senate bill introduced by Mr. Thompson (No. 4, Int. No. 4) entitled "An act to validate bonds of the village of Babylon, county of Suffolk and State of New York, to be issued for the purpose of widening out the pavement on certain highways therein, and to legalize proceedings relating thereto," reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Thompson, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading. Mr. Russell, from the committee on banks, to which was referred the Senate bill introduced by Mr. Russell (No. 75, Int. No. 75) entitled "An act to amend the Banking Law, in relation to number of directors of banks and trust companies," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Schackno, from the committee on codes, to which was referred the Senate bill introduced by Mr. Schackno (No. 83, Int. No. 83) entitled "An act to amend the Civil Practice Act, in relation to amendments of pleadings of course," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Schackno, from the committee on codes, to which was referred the Senate bill introduced by Mr. Schackno (No. 129, Int. No. 129) entitled "An act to amend the Civil Practice Act, in relation to sequestration proceedings in divorce actions," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole. Mr. Schackno, from the committee on codes, to which was referred the Senate bill introduced by Mr. Fearon (No. 189, Int. No. 189) entitled "An act to amend the Civil Practice Act, in relation to proof of tariffs or classifications filed with the Interstate Commission of the United States," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Schackno, from the committee on codes, to which was referred the Senate bill introduced by Mr. Fearon (No. 193, Int. No. 193) entitled "An act to amend the Civil Practice Act, in relation to manner of obtaining preference in the county of Onondaga," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Schackno, from the committee on codes, to which was referred the Senate bill introduced by Mr. Antin (No. 225, Int. No. 225) entitled "An act to amend the Civil Practice Act, by introducing a new section, to be section three hundred and sixtyeight-a," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Rabenold, from the committee on conservation, to which was referred the Senate bill introduced by Mr. Rabenold (No. 153, Int. No. 153) entitled "An act to amend the Conservation Law, in relation to the number of inspectors and game protectors," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Cotillo, from the committee on the judiciary, to which was referred the Senate bill introduced by Mr. Straus (No. 262, Int. No. 262) entitled "An act to incorporate the Edwin Gould Foundation for Children," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Cotillo, from the committee on the judiciary, to which was referred the Senate bill introduced by Mr. Knight (No. 133, Int. No. 133) entitled "An act to legalize and confirm certain official acts of Engene M. Hogan, performed as justice of the peace of the town of Java, New York, since the expiration of the term of his office, reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Fearon moved that the committee on civil service be discharged from the consideration of Senate bill (No. 263, Int. No.

263) entitled "An act to amend the Civil Service Law, in relation to superannuation and retirement of officers and employees in the State civil service," that the said bill be amended, reprinted and recommitted to the committee on civil service.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Rabenold moved that the committee on conservation be discharged from the consideration of Senate bill (No. 147, Int. No. 147) entitled "An act to amend the Conservation Law, in relation to licenses for the taking of frogs," and that the said bill be amended, reprinted and recommitted to the committee on conservation.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Robinson moved that the committee on internal affairs of towns, counties and public highways be discharged from the consideration of Senate bill (No. 161, Int. No. 161) entitled "An act to amend the Highway Law, in relation to county aid for construction, improvement and maintenance of town highways," and that the said bill be amended, reprinted and recommitted to the committee on internal affairs of towns, counties and public highways.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Love offered a resolution, in the words following:

Resolved, That a committee consisting of five members of the Senate be appointed by the Temporary President to attend the funeral of the late Mrs. Daniel J. Carroll of Brooklyn.

The Temporary President appointed as members of such committee Messrs. Dunnigan, Farrell, Twomey, Love, Higgins.

Mr. Cotillo moved that the committee on the judiciary be discharged from further consideration of the resolution introduced by him memorializing the Congress of the United States relative to the modification of the Federal Immigration Laws.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Cotillo moved that said resolution be amended to read as follows:

Whereas, The immigration laws enacted by the Congress of the United States have operated so as to work injustice on many foreign born, aspiring to become citizens of this country, to deny to the oppressed of other countries the refuge and the opportunity which this country has traditionally offered to the human race and to deprive this country itself of that influx of lawabiding, industrious and thrifty men and women such as have in the past built up our industries and our commerce;

Whereas, The most objectionable feature of such immigration laws is the so-called "quota" provision thereof;
