Tim Civil Code of California has been in operation since the first day of January, 1873. It is based on, and to a great extent copied from, the proposed Civil Code of the State of New York, which was prepared by a com mission appointed by the Legislature of that State, and completed and published in the year 1865. It has not, however, been yet adopted as a part of the statutory law of the State; but, from present indications, its adoption at no very distant period may be reasonably expected.
