witness who impeaches the patent. Mr. Carpmael, on the other side, is the chief witness to support the patent. The one says that it is neither new nor useful, the other says it is both novel and useful.

Now this is what Mr. Carpmael says. I will draw your attention to his evidence first. He says there are two sheets of drawings, one mode of bevelling, that is No. 5, and the other described in another mode of bevelling, No. 1. That from the drawings a workman of competent skill could make the invention, but the specification would give certain assistance; part of the mode of producing the bevelling is different in the two drawings. The defendant's model is correct by the specification and plan taken together, that, as he says, that model is correct by the second plan No. 17, the bevelling movement in the model is No. 17, and omits so much of No. 5, as varies from it. A full-sized machine would work better than a model. A saw is suspended in the frame, the saw turns on its own axis and is capable of moving in concert with the frame. The specification disclaims the movement on the axis; saws have been made to turn on their axes independent of their frame. The having the capability of movement and having the means applied to it of guiding, so as to steer it, is a new system of sawing, as far as I am acquainted with the subject. Now that does not appear to be exactly the case, because he has not adverted to the circumstance that Jones' machine has the capability of lateral movement, and has also the means applied to it, of guiding in the one case by means of the forked-lever. The suspension of the saw with means of lateral movement is new; the slottedlever and the slotted-bar at right angles are new, in combination with other parts of the system." A workman can follow an irregular line moulded out on the log. The combination in No. 17 is new. The log is fixed on pivots and rotates on its own axis. The dog-discs are fixed on the pivots, and thereby a piece of wood is cut, curved, and bevelled.
