Mayors, &c. of the Cinque

which fuch Subftitute fhall have been found, or in refpect of which fuch Fine fhall have been paid, fhall, within Seven Days after the Production of fuch Certificate, pay fuch Money on Pain of forfeiting for any Neglect or Refufal the Sum of Twenty Pounds.

LXVIII. And whereas there is no Quota established for the Militia within the Cinque Ports, Two ancient Towns and their Members,' be it enacted, That the Number of Men to be balloted and enrolled for the Local Militia under this Act, within the Cinque Ports, Two ancient Towns and their Members, fhall not exceed fuch Number as will, in addition to and together with and including the effective Yeomanry and Volunteers then ferving within the fame, exclufive of Supernumeraries, above the Eftablishment of fuch Corps ferving without Pay, who fhall have been inrolled therein after the First Day of April laft, amount to Two thousand five hundred

Men.

LXIX. And be it further enacted, That when and fo often as the Number of effective Yeomanry and Volunteers, together with the Number of Local Militia in the Cinque Ports, Two ancient Towns and their Members, fhall be below the Quota of Local Militia herein-before established for the fame, it fhall be lawful for His Majefty to order and direct that a Number of Local Militia Men, equal in Amount to fuch Deficiency, fhall be forthwith ballotted and enrolled for the fame under this A&t, fo that the Number in the Whole of the Local Militia and the effective Yeomanry and Volunteers within the fame, fhall be equal to the faid last-mentioned Quota so established as aforefaid.

LXX. And be it further enacted, that the Warden of the Cinque Ports, Two ancient Towns and their Members, and in his Abfence his Lieutenant or Lieutenants, fhall within their refpective Jurifdictions put in Execution this Act, and use and exercise all the Powers and Authorities contained in the said Act of the Fortyfecond Year of the Reign of His prefent Majefty, or any other Act or Acts of Parliament relating to raising or embodying Men within such Jurisdiction as aforefaid, or any Act relating to the Militia of England, or this Act, for the Purpose of carrying the fame into Execution, and raifing the Men to be provided and raised within their respective Jurifdictions under this Act, and all the Powers, Provifions, Authorities, Penalties, and Forfeitures contained in any Act or Acts of Parliament, and hereby made applicable to the raifing the faid Local Militia, or in this Act, fhall be in full Force for the Purpose of raifing the Local Militia within the Cinque Ports; any Thing in any Act or Acts of Parliament contained to the contrary notwithftanding.

LXXI. Provided also, That it fhall be lawful for the faid Warden, and the faid Mayors, Jurats, Magiftrates, or Deputy Lieutenants, at a General Meeting to be holden as foon as may be after any Ballot fhall have been directed for the raising of any Local Militia within the Cinque Ports, and Lifts shall have been returned for that Purpose, to appoint the Number of Men to be raised in pursuance of this Act for each of the faid forts, Two ancient Towns and their Liberties, and the feveral Members thereof refpectively; and the Number of Men fo apportioned fhall be raifed, ballotted for, and fworn in, pursuant to the Provifions of this Act.

LXXII. And be it further enacted, That the Mayors, Jurats, or other Magftrates for the Time being, of each of the Cinque Ports,

Two ancient Towns and their Liberties, and the feveral Members Ports, &c. thereof, shall and may act as Deputy Lieutenants for the Purposes of this Act; and that it fhall be lawful for the Warden of the faid Cinque Ports, Two, ancient Towns and their Members, to appoint any other Perfons qualified in the Manner directed by an Act made in the Forty-fecond Year of His present Majelty's Reign, intituled, An Act for amending the Laws relating to the Militia in England, and for augmenting the Militia, to act in like Manner as Deputy Lieutenants within the fame: Provided always, that the faid Warden may, with the Concurrence of any Meeting of Deputy Lieutenants, authorize the faid Mayors, Jurats, and Magiftrates, or Deputy Lieutenants, within fuch Ports, Towns, Liberties, and Members, to iffue their Orders to the respective Conftables within the fame, to return within a limited Time Lifts of all Perfons liable to ferve in the Local Militia for fuch Port, Town, Liberty, and Member refpectively, in the Manner required by this Act, and by the faid Act of the Fortyfecond Year of the Reign of His prefent Majesty, or any A&t relating to the Militia of England, and may appoint fuch Times as may appear to him to be neceffary and proper for the Returns and Notices to be made and given, conformably to the Directions of the faid recited A&t and this A&t; and for the holding other Meetings, and doing all Acts, Matters, and Things, which may be neceffary for carrying this Act into Execution within the Cinque Ports.

LXXIII. And be it further enacted, That a Local Militia fhall be ballotted and enrolled from among the Tinners or Miners of the Counties of Devon and Cornwall, in like Manner and to fuch Amount in relation to the Quota of Regular Militia for the faid Tinners and Miners, as is by this Act directed in relation to Counties; and fuch Local Militia fhall be raised under the Provifions of this Act.

LXXIV. And be it further enacted, That the Warden of the Stannaries in Great Britain shall refpectively, in obedience to His Majesty's Orders to be iffued for that Purpofe, which His Majefty is hereby empowered to iffue, procure all Matters to be done touching the Tinners of the Counties of Devon and Cornwall, according to the Customs of the Stannaries and Privileges of the Working Tinners, as are hereby or by any Act or Acts relating to the Tinners or Miners of Cornwall, or to the Militia, required to be done by the Lieutenants and Deputy Lieutenants aforefaid, touching other Perfons refiding in the faid Counties of Devon and Cornwall not entitled to the Benefit of fuch Privileges; and fuch Warden, Special Deputy Warden, and other Officers of the Stannaries, fhall have fuch and the like Powers and Authorities to do and execute all and every the Matters and Things which fhall be fo required to be done as aforefaid, as the Lieutenants and Deputy Lieutenants of the feveral Counties have for fo doing the feveral Matters and Things hereby required to be done by them refpectively.

LXXV. And be it further enacted, That all and every the Powers of Clauses, Provifions, Powers, Authorities, Matters, and Things contained in an Act paffed in the Forty fecond Year of His prefent Majefty, intituled, An Ad for repealing an A& made in the Thirtyeighth Year of the Reign of His prefent Majefly, intituled, An A&t for raifing a Body of Miners in the Counties of Cornwall and Devon, for the Defence of the Kingdom during the prefent War, and for the more effectually raifing and regulating a Body of Miners for the Defence of Great Britain, relative to raifing and regulating a Body of Miners Dd4

Local Militia fhall be ballotted and enrolled in the Tower Hamlets.

This Act fhall not repeal

Provifions relating to Counties extended to Ridings, and relating to Hundreds extended to

Rapes, &c.

within the Stannaries, in the Counties of Devon and Cornwall, fhall, in all Cafes in which other Provifions are not made by this Act, be applied, practifed, and put in force, in all Refpects, for raifing the Local Militia Men to be raised out of the Tinners and Miners within the faid Stannaries under this Act, as fully and effectually as if the faid Act and this Act were confolidated into one A&.

LXXVI. And be it further enacted, That a permanent Local Militia fhall be ballotted and enrolled under this Act in the Tower Hamlets and Liberties of the Tower, not exceeding fuch Number of Men as will, in addition to, and including and together with the effective Volunteers ferving in and for the Tower Hamlets and Liberty of the Tower, exclufive of Supernumeraries above the Eftablishment of any fuch Corps ferving without Pay, who fhall have been enrolled therein after the First Day of April laft, amount to Six Times the Amount of the Quota of the original Militia of the Tower Hamlets; and fuch Local Militia fhall be ballotted and enrolled at fuch Periods as His Majefty fhall by any fuch Warrant as aforefaid, direct; and all and every the Claufes, Provifions, Powers, Authorities, Matters, and Things. contained in Two Acts made in the Thirtyfeventh Year of the Reign of His prefent Majefty, or in any other Act or Acts relative to raising the Militia of the Tower Hamlets and Liberty of the Tower, together with all Claufes, Powers, Provifions, and Authorities contained in an Act made in the Forty-third Year of His prefent Majefty, intituled, An Act to enable His Majefty more effectually to raise and affemble in England an additional Military Force. for the better Defence and Security of the United Kingdom, and for the more vigorous Profecution of the War, for railing the Men to be raised therein under that A&t, fhall be applied, practised, and put in force in all Refpects, for raifing the Men to be raised therein under this Act, as fully and effectually as if the faid Acts and this A& were confolidated into one Act.

LXXVII. Provided always, That nothing in this A&t contained shall be conftrued to extend to repeal any of the Provifions of the faid Two recited Acts of the Thirty-feventh Year aforefaid, other than as any new and additional Fines, Penalties, and Powers in this Act contained may be applicable and neceffary for the raifing the Men by this A&t directed to be raised in the Tower Hamlets.

LXXVIII. And be it further enacted, That all Provifions, Directions, Clauses, Matters, and Things whatever in this Act contained, relating to Counties, fhall extend and be conftrued to extend to all Ridings, Shires, Divifions, Cities, and Places; and all Provifions, Directions, Claufes, Matters, and Things in this Act contained, relating to Hundreds, fhall extend and be conftrued to extend to all Rapes, Laths, Wapentakes, and other Divifions in or of any fuch County, Riding, Division, Shire, City, or Place; and all Provifions, Directions, Claufes, Matters, and Things in this Act contained relating to Parishes, fhall extend and be conftrued to extend to all Townships, Tythings, and Places, and to all Extra-parochial Places united therewith, for the Purpofes of any Act relating to the Militia; and all Powers by this Act given to any Constable fhall extend to all Tythingmen, Headboroughs, Peace Officers, and other Tythingmen, &c. Perfons acting as Conftables in any Counties, Hundreds, Parifhes, and Places in which there fhall be no Constable, as fully and amply as if they were feverally and respectively repeated in every fuch Provifion, Direction, and Claufe, and with relation to every fuch Matter or Thing. LXXIX. And
