James M. Jeffries having received a majority of the whole number of votes cast, was declared duly elected judge of the ninth judicial circuit for the term of eight years, commencing on the 1st of January, 1879.

Mr. WALLACE offered the following joint resolution:

Resolved by the House of Delegates (the Senate concurring), That the further execution of the joint order be postponed until to-morrow at 12:30 P. M.

Which was agreed to.

Mr. BOHANAN moved to reconsider the vote by which the joint resolution was agreed to; which motion was rejected.

Ordered, That Mr. WALLACE carry the joint resolution to the Senate and request their concurrence.

A message was received from the Senate by Mr. KOINER, who informed the House that the Senate had agreed to the joint resolution.

On motion of Mr. ROBINSON of Portsmouth, the House adjourned until to-morrow at 12 o'clock P. M.

A communication from the Senate by their clerk was read as follows:

In Senate December 18, 1878.

The Senate have passed bills entitled an act to incorporate the Dan Valley and Yadkin river narrow gauge railroad company, No. 36; an act to authorize the trustees of Rodes Methodist Episcopal church, South, to convey to the heirs of Charles P. Rodes, deceased, of Nelson county, a lot of land, No. 45; and an act to amend and re-enact the sixteenth section of an act approved February twenty-fourth, eighteen hundred and seventy-six, entitled an act to provide for the working of roads in the county of Fauquier, No. 46.

In which bills they respectfully request the concurrence of the House of Delegates.

No. 45. Senate bill was read twice and placed on the calendar, the rule having been suspended, on motion of Mr. COGHILL, requiring its reference to a committee.

No. 36. Senate bill was read twice and placed on the calendar, the rule having been suspended, on motion of Mr. WILKINSON, requiring its reference to a committee.

No. 46. Senate bill was read twice and referred to the committee on counties, cities and towns.

The following Senate bills were reported from the committee for courts of justice:

No. 17. Senate bill entitled an act to amend section two, chapter one hundred and seventy-one, Code of 1873, and the acts amendatory thereto, in regard to commissioners of courts, was reported from the committee for courts of justice.

No. 41. Senate bill entitled an act to amend and re-enact the first and second sections of chapter one hundred and seventy, Code of eighteen hundred and seventy-three, in relation to the removal of causes pending in one court to another.

No. 45. House bill to authorize courts, or judges thereof in vacation, or justices of the peace, to order sales of personal property seized under writs of fieri facias, or under distress warrants in cases where such property is expensive to keep or perishable, was reported from the committee for courts of justice, with a substitute, was read a first time.

No. 46. House bill to amend and re-enact section 53, chapter 21, of the criminal code, in reference to the organization, government and discipline of the penitentiary, approved March 14, 1878, reported from the committee on retrenchment and economy, was read a first time.

No. 47. House bill granting a loan of arms of the state to the prin

cipal of the Suffolk military academy, reported from the committee on militia and police, was read a first time.

No. 48. House bill to amend an act to prevent the sale of cotton between certain hours, reported from the committee on propositions and grievances, was read a first time.

A message was received from the Senate by Mr. GAYLE, who informed the House that the Senate had agreed to the amendment of the House to Senate bill entitled an act to provide for the relinquishment to the United States of title to and jurisdiction over lands within the state of Virginia, for sites of life-saving stations, No. 26.

A message was received from the Senate by Mr. PHELEGAR, who informed the House that the Senate had agreed to a joint resolution to expedite the election of circuit judges, in which they respectfully ask the concurrence of the House.

The Senate joint resolution as follows:

Resolved (the House of Delegates concurring), That in the further execution of the joint order for election of circuit judges, no committees to count and report the result shall be appointed until the remaining seven judges shall have been voted for, when one joint committee shall be appointed to count and report all the votes-

Was agreed to two-thirds of the members present voting in the affirmative.

Mr. GRAVES moved to reconsider the vote by which Senate joint resolution was agreed to; which motion was rejected.

Ordered, That Mr. GRAVES inform the Senate that the House have agreed to the Senate joint resolution.

Mr. MCCAULL, from the committee on enrolled bills, presented the following report:

The committee on enrolled bills have the honor to report that the following bills and joint resolution have been approved by the gov

ernor:

An act authorizing the trustees of Andrew chapel congregation of the town of Harrisonburg to execute a deed of trust on the church property.

An act for the relief of the tax payers of the county of Orange.

An act to amend and re-enact an act entitled an act to fix the times of holding circuit court in the 14th judicial circuit.

An act to amend an act entitled an act for the assessment of taxes on persons, property, income, licenses, &c., and imposing taxes thereon for the support of the government and free schools, and to pay the interest on the public debt.

An act to establish the Church home of the city of Norfolk.

An act to incorporate the Union bridge company.

An act to incorporate the Planters' savings bank at Chatham, Virginia.

Joint resolution defining the true status of the present general assembly.

An act to authorize the colored Baptist church of Liberty, Virginia,

to borrow money and secure the payment of same by deed of trust on the church property.

Mr. WALKER of Westmoreland, under a suspension of the rule, presented sundry petitions of certain counties in the 10th judicial circuit, in behalf of John Critcher for judge of the circuit.

On motion of Mr. WALKER of Westmoreland, the petitions were laid on the table.

Mr. BARBOUR offered the following resolution:

Resolved, That the committee on printing enquire why the report of the auditor has not been printed.

The House refused to refer the resolution to a committee.

The resolution was agreed to.

Leave of absence was granted Messrs. DAVIDSON, SHANNON, DICKENSON, CRANK, SHUMATE, KELLY, CHASE, HEALY and FRY, one day each; and HARDESTY and DANCE, two days each.

Senate joint resolution returning thanks to W. W. Corcoran, Esq., of Washington city, for the gift of a valuable painting, was, on motion of Mr. ANDERSON, passed by.

The following were presented and referred under rule 37:

By Mr. CARTER of Loudoun: A bill to amend and re-enact section 8 of chapter 25 of acts of assembly, approved March 14, 1878, relating to fees of justices and other officers. Referred to committee for courts of justice.

By Mr. TAYLOR of Henrico:

- Resolved, That the committee on asylums and prisons enquire into the expediency of reporting a bill authorizing the superintendent of asylums to advertise for proposals to furnish provisions for the use of the asylums.

By Mr. LOVELL:

Resolved, That the joint committee on constitutional amendments be instructed to enquire into the expediency of striking from the constitution section 2 of article 10, which provides: "No tax shall be imposed on any of the citizens of this state for the privilege of taking or catching oysters from their natural beds, with tongs, in the waters thereof; but the amount of sales of oysters so taken by any citizen in any one year, may be taxed at a rate ot exceeding the rate of taxation imposed upon any other species of property," and report to this general assembly.

By Mr. EDWARDS: A bill for the relief of Daniel Carter, of Halifax county. Referred to the committee on finance.

By Mr. WATSON: Preamble and resolution in relation to a settlement of the public debt. Referred to the committee on finance.

By Mr. SMITH of Albemarle: Petition for the relief of M. A. Carroll from excessive over-valuation of real property. Referred to the committee on finance.

The morning hour having expired, the House proceeded to the business on the calendar.

No. 45. Senate bill entitled an act to authorize the trustees of Rodes Methodist Episcopal church, South, to convey to the heirs of Charles P. Rodes, deceased, of Nelson county, a lot of land, came up. The bill was read a third time and passed.

Mr. COGHILL moved to reconsider the vote by which the bill was passed; which motion was rejected.

No. 36. Senate bill entitled an act to incorporate the Dan valley and Yadkin river narrow gauge railroad company, came up.

On motion of Mr. ROBINSON of Portsmouth, the bill was committed. to the committee on roads and internal navigation.

No. 32. House engrossed bill to extend the time for the repeal of the present fence law in the magisterial district of Rowanty, in the county of Dinwiddie, came up.

On motion of Mr. WALSH, the bill was passed by.

The hour of 12 o'clock P. M. having arrived, the IIouse proceeded to the further execution of the joint order which has for its object the election of circuit judges.

Mr. POWELL nominated William S. Barton, of Fredericksburg, for the office of judge of the tenth judicial circuit.

Mr. WRIGHT nominated John Critcher, of the county of Westmoreland.

Ordered, That Mr. POWELL inform the Senate that the House is ready, on its part, to proceed to the further execution of the joint order, and that William S. Barton and John Critcher are the only persons in nomination before the House.

A message was received from the Senate by Mr. MURRAY, who informed the House that the Senate was ready, on its part, to proceed to the further execution of the joint order, and that William S. Barton and John Critcher are the only persons in nomination before the Senate.
