sections of an act entitled an act to provide for the working of the roads in the counties of Scott, Wise and Buchanan, approved March 5, 1877, so as to include Grayson and Tazewell counties.

On motion of Mr. GRAVES, the title was amended by inserting after "Grayson," "Wythe."

The title, as amended, was agreed to.

No. 10. House engrossed bill to incorporate the Marion reading club of the town of Marion, Smyth county.

No. 12. House engrossed bill to amend and re-enact section 19 of an act entitled an act to provide for working the roads in the counties of Shenandoah and Page, approved February 6th, 1878.

No. 13. House engrossed bill to provide that in case of eviction of part of leased premises, such eviction shall not work a suspension of the whole rent.

No. 17. House engrossed bill to incorporate the Rappahannock freedman's cemetery company.

Motions severally made to reconsider the votes by which House engrossed bills Nos. 8 and 13 were passed; were rejected.

No. 7. House bill providing for submitting of repeal of fence law, in whole or in part, to the voters of Mount Vernon and Centreville districts, in the county of Fairfax, was read a second time.

On motions severally made by Mr. MUSHBACH, the bill was amended as follows:

Strike out the words "sections or districts," found in the 9th and 10th lines, 1st section, and insert the words "districts or sections of Centreville district."

Strike out the words "either of the districts named," found in the 11th line, 1st section, and insert the words "Centreville district."

Strike out the words "said districts," found in 13th line, 1st section, and insert the words "Centreville district."

Strike out the word "a," found in 17th and 24th lines, 1st section, and in the parenthesis, 3d line, 3d section, and in the 7th line, 3d section, and insert in each place the word "Centreville."

Between the words "state" and "except," found in the 4th line, 2d section, insert the words "except so far as the same may be in conflict with the fourth section of this act, and."

Strike out the words "a majority of whom are freeholders," found in the 3d and 4th lines, 3d section, and insert the words "including a majority of the freeholders hereinafter mentioned."

Add an independent section as follows:

4. The word "freeholders" wherever it occurs in this act, shall be construed to apply to and include as well non-resident as resident freeholders, and any person who is a qualified voter in the county, city or town in this commonwealth in which he resides, and who is the owner of land Iving in the district or section in which an election may be held under this act, shall be entitled to vote at such election, and his ballot shall be received and placed in the ballot box, directed by the 1st section of this act to be provided for the ballots of freeholders, and shall

be canvassed and counted, and included in the return and abstract of ballots, provided for in the 2d and 3d sections of this act.

Strike out all after the word "for" in the 8th line, 3d section, and insert in lieu thereof the words "said repeal shall not take effect in Centreville district, or any section thereof, until twelve months, and in Mount Vernon district, until two years after the ratification of this act."

Mr. MUSHBACH severally moved a reconsideration of the votes by which the amendments offered by himself were agreed to; which motions were rejected.

The bill as amended was ordered to be engrossed to be read a third time.

Mr. FARR moved to reconsider the vote by which the bill was ordered to be engrossed; which motion was rejected.

No. 14. House bill to authorize the sale of certain church property belonging to the vestryman of St. Andrew's Protestant Episcopal church, Beckford parish, county of Shenandoah, to make a valid title to the same, and to re-invest the proceeds of the sale, was, on motion. of Mr. HENKEL, passed by.

The following House bills were read a second time and ordered to be engrossed to be read a third time.

No. 18. House bill to amend and re-enact the 5th section, chapter 38, Code of 1873, in regard to the delivery of lists of delinquent lands

to treasurers.

No. 19. House bill for the relief of Nathan W. Williams, of Grayson county, from the payment of a fine.

In Senate December 13, 1878.

The Senate have passed a bill entitled an act to amend an act entitled an act for the assessment of taxes on persons, property, income, licenses, &c., and imposing taxes thereon for the support of the government and free schools, and to pay the interest on the public debt, No. 37.

In which bill they respectfully request the concurrence of the House of Delegates.

No. 37. Senate bill was read twice and placed on the calendar, the rule having been suspended, on motion of Mr. LovELL, requiring its reference to a committee.

No. 32. House bill to extend the time for the repeal of the present fence law in the magisterial district of Rowanty, in the county of Dinwiddie, reported from the committee on agriculture and mining, was read a first time.

No. 33. House bill to make parties accused of rape and seduction competent witnesses, reported from the committee for courts of justice, with a substitute, was read a first time.

Senate joint resolution returning thanks to W. W. Corcoran, of Washington city, for the gift of a valuable painting, was, on motion of Mr. Bocock, passed by.

The SPEAKER appointed the following as the committee on the part of the House, under authority of a joint resolution appointing a joint committee on constitutional amendments:

The bill being presently engrossed, Mr. WATSON moved that it be read a third time this day; which motion was agreed to, two-thirds of the members in the House so determining.

The bill was read a third time and passed.

Mr. WATSON moved to reconsider the vote by which the bill was passed; which motion was rejected.

Ordered, That Mr. WATSON carry the bill to the Senate and request their concurrence.

No. 14. Mr. STEVENS moved to pass by the bill; which motion was rejected. The bill was ordered to be engrossed to be read a third time."

No. 24. House bill to amend an act entitled an act to define the limits of tidewater on the south side of James river, approved March 14th, 1878, was read a second time and ordered to be engrossed to be read a third time.

Mr. WALSH moved to reconsider the vote by which the bill was ordered to be engrossed; which motion was agreed to.

On motion of Mr. WALSH, the bill was amended by striking out "north" in 10th line of 1st section, as proposed to be amended, and inserting "south."

The bill as amended was ordered to be engrossed to be read a third time.

The following House bills were read a second time and ordered to be engrossed to be read a third time.

No. 23. House bill to authorize trustees of certain school property in the county of Roanoke to sell the same and re-invest proceeds.

No. 25. House bill to enable the board of supervisors of Chesterfield county to assist the Manchester free bridge commissioners in keeping the free bridge in repair. ·
