An act to amend section 1 of an act approved March 25, 1872, declaring certain streams in Charlotte county to be highways, as amended by an act approved March 20, 1875, as amended by an act approved March 14, 1878.

An act providing for submitting the question of liquor license or no liquor license to the qualified voters of Fairfax county at the first election for district officers, and at every subsequent election for district officers.

An act amending the charter of the town of Lovettsville, Loudoun county, and further of extending the protection of the corporate powers of the town of Lovettsville to all religious denominations worshipping within a mile of said town.

A communication from the Senate by their clerk, was received as follows:

In Senate, March 3, 1879. The Senate have agreed to House joint resolution to provide for the assessment of property for taxation for the year 1879, No. 273.

And they have agreed to joint resolution to protect the interest of the state in the Upper Appomattox company.

In which joint resolution they respectfully request the concurrence of the House of Delegates.

The hour of 12 P. M. having arrived, the SPEAKER announced that by constitutional limitation the present session of the General Assembly had expired, and declared the House adjourned sine die.

SPECIAL SESSION.

TUESDAY, MARCH 4, 1879.

In obedience to the following proclamation, the SPEAKER called the House to order at 12 o'clock M.

The proclamation was read as follows:

PROCLAMATION.

COMMONWEALTH OF VIRGINIA,

GOVERNOR'S OFFICE, RICHMOND, VA., March 4, 1879.

Whereas important matters of legislation pending in the general assembly of Virginia, have been left unfinished by the constitutional termination of the session, and the interests of the commonwealth requires that it be convened:

Now, therefore, I, Frederick W. M. Holliday, governor of Vinginia, do issue this my proclamation convening the said general assembly on Tuesday, March 4, 1879, at 12 o'clock M. in the capitol.

Given under my hand as governor and under the seal of the commonwealth at Richmond, this 4th day of March, 1879.

Ordered, That Mr. JOHNSTON of Giles inform the Senate that the House is ready to proceed to business.

A message was received from the Senate by Mr. JOHNSON, who informed the House that the Senate is ready to proceed to business. On motion of Mr. WALLACE,

Resolved (the Senate concurring), That a committee of three on the part of the House and two on the part of the Senate be appointed to wait on the governor and inform him that the general assembly is now in session, and ready to receive any communication he may make.

Ordered, That Mr. WALLACE Communicate the resolution to the Senate and request their concurrence.

A message was received from the Senate by Mr. BROOKE, who informed the House that the Senate had agreed to the joint resolution appointing a committee to wait on the governor.

The SPEAKER appointed Messrs. WALLACE, LACY and ROBINSON the committee on the part of the House.

The committee subsequently reported, through their chairman, that they had waited on the governor, and that he would communicate to the general assembly in writing.

A message was received from his excellency the governor, by his private secretary, which message was read as follows:

COMMONWEALTH OF VIRGINIA,

GOVERNOR'S OFFICE, RICHMOND, VA., March 4th, 1879.

Gentlemen of the Senate and House of Delegates:

Under authority vested in me by the constitution, I have called you together in extra session because the interest of the commonwealth requires it. At the beginning of the regular session, three months ago, I communicated to you the condition of the commonwealth. It is unnecessary for me to review in detail the subjects to which I then called your attention. The various committees having those subjects in charge, after diligent labor, have reported their work for the action of your honorable bodies. Some have been considered and have passed into laws; others are still awaiting action, and are of great interest to the present and future of the state.

I need not say that the grave matters involved, having undergone the careful deliberation of your committees and yourselves, ought to be disposed of now that angry controversy may end, and peace and quiet bring that prosperity which will surely follow, and which the people of Virginia long for so earnestly.

On motion of Mr. STEVENS, the message was laid on the table and ordered to be printed.

Mr. ROBINSON offered the following resolution:

Resolved (the Senate concurring), That a joint committee be appointed, to consist of five members of the Senate and nine of the House of Delegates, to whom all propositions on the subject of amendments to the constitution shall be referred, with instructions to report by bill or otherwise.

The question being on reference, was put and decided in the negative.

The joint resolution was agreed to.

Ordered, That Mr. ROBINSON carry the joint resolution to the Senate and request their concurrence.

Leave of absence was granted Messrs. SHELBURNE and MCCRAW five days each; WATSON four days; HARVIE, LUCK, TROUT, Bland, SMITH of Dinwiddie, WHITACRE, CURLETT, and WHITE Caroline, three days each; AKERS two days; and indefinite leave for Mr. DAVIDSON.

By Mr. LOVELL: A bill relating to the collection of printers' fees in legal cases. Referred to the committee for courts of justice.

By Mr. GOODE: A bill to amend the act of March 25, 1872, relating to creeks in Charlotte county. Referred to committee on propositions and grievances.

By Mr. MCMULLAN: A bill to authorize the board of supervisors of the respective counties, and common councils of the respective cities, to determine what allowances shall be made to commonwealth's attorneys, clerks, and sheriffs of their counties and cities, payable out of the county or city treasuries. Referred to committee on counties, cities and towns.

By Mr. Bocock: A bill to define the force and effect of answers to bills in chancery. Referred to committee for courts of justice.

By Mr. FICKLIN: A bill to render more efficient and economical the use and analysis of fertilizers, and to amend the law in relation to the analysis and sale of same. Referred to committee on agriculture and mining.

By Mr. FULTON: A bill to provide convict labor for the Wilson creek and South Fork turnpike road between the mouth of Wilson, in Grayson county, and Marion in the county of Smyth. Referred to committee on asylums and prisons.

By Mr. TALIAFERRO of Gloucester: Petition of Mrs. Annie F. Hughes, of Gloucester county, praying that authority be given the county court of Gloucester to reduce the assessment on her lands, and that certain taxes be refunded. Referred to committee on finance.
