The question being on agreeing to the amendment of Mr. MOFFETT to the amendment of Mr. HANGER,

Mr. MOFFETT offered a substitute to the bill.

On motion of Mr. JORDAN, the bill was recommitted to the committee on asylums and prisons.

No. 115. House bill to amend section 8 of chapter 25 of criminal laws, approved March 14, 1878, in relation to fees of justices and other officers, came up as unfinished business.

The question being on agreeing to the motion pending, to commit the bill to the special committee on fees of county officers, &c.,

On motion of Mr. HANGER, the bill was passed by.

No. 4. House bill entitled an act allowing any person to have his dog listed for taxation, thereby making the same personal property,

came up.

The first amendment of the Senate to the bill was agreed to as follows:

Strike out all of the first section after the word "dog" in the seventh line thereof, and insert in lieu thereof the words, "or dogs listed for taxation by the commissioner of the revenue, at a valuation to be fixed by the said commissioner. Any dog so listed is hereby declared personal property. Larceny of any such dog shall be deemed petit larceny, and prosecutions for trespass upon the same shall be for misdemeanor. But no offence under this act shall be punished with stripes. In every prosecution under this act, the defendant shall be allowed to testify in his own behalf."

The second amendment of the Senate to the bill was agreed to as follows:

Insert as an independent section the following, to come in as section 2, viz.:

"The auditor of public accounts shall prescribe a tag, to be paid for by the owner of the dog, which shall be worn by each dog listed and taxed as provided in the first section. No dog shall be considered 'personal property' within the meaning of this act when not wearing such tag."

The third amendment of the Senate to the bill was agreed to as follows:

Add as an independent section, to come in as section the following:

"Nothing contained in this act shall be construed as interfering with special laws imposing a tax on dogs in any county in the commonwealth, or with any general statute of the state already in force in reference to dogs "-yeas 58; nays 24.
