No. 76 House bill to authorize the James river and Kanawha company to make sale and transfer of all its works, property and franchises to the Richmond and Alleghany railroad company, and to define the powers and duties of the board of public works in respect thereto, came up as a special order.

On motion of Mr. FULTON, the special order was postponed for thirty minutes.

No. 123. House bill to amend and re-enact the first section of an act to furnish convict labor to work on the Raleigh and Grayson turnpike road, approved February 28, 1878, was, on motion of Mr. FULTON, up out of its order on the calendar.

Mr. FULTON moved that the bill have a third reading this day; -which was agreed to, two-thirds of the members in the House so determining.

No. 97. House bill to amend and re-enact an act to authorize the construction of a turnpike road in Princess Anne and Norfolk counties, approved March 14, 1878, was, on motion of Mr. HALL, taken up out of its order on the calendar.

No. 143. House bill for the relief of Isaac J. Parks and Jesse L. Parks as sureties of John Parks of Grayson county, was, on motion of Mr. FULTON, taken up out of its order on the calendar.

No. 138. House bill to amend the charter of the town of Suffolk, was, on motion of Mr. SHRIVER, taken up out of its order on the calendar.

No 124. House bill to amend and re-enact the seventh section of chapter 212 of the Acts of 1876-77 for the protection of fish in the waters of the commonwealth above tide-water, was, on motion of Mr. GRAVES, taken up out of its order on the calendar.

The bill was read a second time, and ordered to be engrossed to be read a third time.

No. 90. House bill for the relief of Joseph Wyche of Brunswick county, was, on motion of Mr. REESE, taken up out of its order on the calendar.

The bill was read a second time, and ordered to be engrossed to be read a third time.

No. 137. House bill to amend and re-enact section 14 of the charter of the city of Danville, was, on motion of Mr. WILKINSON, taken up out of its order on the calendar.

The bill was read a second time, and ordered to be engrossed to be read a third time.

No. 43. House bill entitled an act to incorporate the Bangens hydraulic mining and manufacturing company, came up.

The amendments of the Senate were agreed to.

Motions (severally made by Mr. WALLACE) to reconsider the votes by which the Senate amendments were agreed to, were rejected.

The time to which the special order was postponed having arrived, No. 76. House bill, as special order, came up.

Mr. BERNARD moved to amend the bill by striking out all of the eighth sub-division of section one after the word "which" in fourth line, and inserting in lieu thereof the following: "the works, property and franchises of the James river and Kanawha company are hereby authorized to be conveyed. A failure to build said railroad within two years from the date of the expiration of the time aforesaid, shall work a forfeiture of said works, property and franchises, and also of the work, property and franchises of said railroad company to said James river and Kanawha company: provided, however, that such forfeiture shall not prejudice the rights of any creditor of said railroad company, and upon such forfeiture said James river and Kanawha company shall thereupon be revived and restored as a corporation, with all of its rights, privileges and franchises, just as they existed at the date of the passage of this act."

Pending the consideration of which,

A message was received from the Senate by Mr. KOINER, who informed the House that the Senate have agreed to a joint resolution to appoint a special joint committee to consider and report the best mode of conducting the conference with the public creditors, &c.

Mr. BARBOUR moved to postpone the special order for five minutes; which motion was agreed to.

The SPEAKER laid before the House the joint resolution as requiring immediate attention.

The joint resolution is as follows:

Resolved by the general assembly, That a joint committee of three on the part of the Senate, and five on the part of the House of Delegates, be appointed to consider and report the best mode of conducting the conference with the public creditors and others contemplated by the joint resolution of the general assembly, and the recent proclamation of the governor on that subject.

The joint resolution was agreed to.

Mr. GRAVES moved to reconsider the vote by which the joint resolution was agreed to; which motion was rejected.

Ordered, That Mr. BARBOUR inform the Senate that the House have agreed to the Senate joint resolution.

The SPEAKER subsequently appointed Messrs. Keyser, Barbour, TALIAFERRO of Gloucester, HENRY, and McCONNELL, a committee on the part of the House.

The Journal was read by the clerk.

A communication from the Senate by their clerk, was read as follows:

In Senate, January 24, 1879. The Senate have passed House bills entitled an act to incorporate the Good Templar Relief Association of Loudoun county, No. 65; an act to authorize the sale of certain church property belonging to the vestrymen of St. Andrews' Protestant Episcopal church, Beckford parish, county of Shenandoah, to make a valid title to the same, and to reinvest the proceeds of the sale, No. 14; and an act to incorporate the Virginia towing company, No. 63.

And they have passed, with amendments, House bills entitled an act to provide for the protection of fish in the Appomattox river, No. 34; an act to enable the board of supervisors of Chesterfield county to assist the Manchester free bridge commissioners in keeping the free bridge in repair, No. 25; an act to incorporate the Virginia and Statesville narrow-gauge railroad company, No. 98.

In which amendments they respectfully request the concurrence of the House of Delegates.

No. 34. House bill, with Senate amendments, was, on motion of Mr. WALSH, placed on the calendar, the rule being suspended requiring its reference.

No. 98. House bill, with Senate amendments, was referred to the committee on roads and internal navigation.

No. 25. House bill, with Senate amendments, was referred to the committee on counties, cities and towns.

No. 6. Senate bill entitled an act imposing certain duties upon county and corporation treasurers and other collectors of state revenue and fixing the penalty for failure to perform them, was reported from the committee on finance, with amendments.

The following House bills, reported from the committee on finance, were read a first time.

No. 166. House bill for the relief of Joseph A. Carr, of Loudoun county.

No. 167. House bill concerning certain state bonds donated by William W. Corcoran to the University of Virginia for the endowment of a professorship of natural science therein.

No. 168. House bill to allow H. C. Hudson, treasurer of Halifax county, extension of time to make his returns of delinquents and insolvents in the revenue of 1877.

No. 169. House bill to amend and re-enact the first and second sections of an act approved March 21, 1877, entitled an act to secure the payment of wages or salaries to certain employees of railway, canal, steamboat and other transportation companies, reported from the committee on roads and internal navigation, was read a first time.

The report of the committee on federal relations and resolutions, upon the exercise of jurisdiction by the United States district judge in the matter of Burwell Reynolds and Lee Reynolds, came up.

On motion of Mr. FAUNTLEROY, the report was postponed until Tuesday, 28th instant.

Leave of absence was granted Messrs. SMITH of Dinwiddie, five days; SPESSARD, FULTON, and GREEN, three days each; BLAND and GOODE, two days each; and SOUTHWARD and WALKER of Chesterfield, one day each.

Mr. BOHANNAN was, on his motion, excused from service on the cial committee to consider the fees of county officers, &c.

The Speaker appointed Mr. HENSON as a member of the committee in place of Mr. BOHANNAN.

Mr. HARRISON of Sussex offered the following resolution:

Resolved, That the sergeant-at-arms be instructed to pay to the personal representative of the late E. C. ROBINSON, delegate from the city of Norfolk, the amount in full of his salary for the present regular session of the general assembly.

The question being on reference, was put and decided in the negative.

On motion of Mr. TALIAFERRO of Gloucester, the resolution was passed by.

The SPEAKER laid before the House a communication from the gov

ernor transmitting the report of the second auditor as to receipts and disbursements of the "Miller fund."

The communication was referred to the committee on schools and colleges.

By Mr. BERNARD: A bill to provide for the binding and re-binding of the land books and other books of record in the clerk's offices of the commonwealth. Referred to the committee for courts of justice. The morning hour having expired, the House proceeded to the business on the calendar.

No. 34. House bill entitled an act to provide for the protection of fish in the Appomattox river, came up.

The amendment of the Senate to the bill was agreed to.

Mr. WALSH moved to reconsider the vote by which the amendment of the Senate was agreed to, which motion was rejected.

No. 24. Senate bill entitled an act to amend and re-enact the second section of an act approved March 15th, 1875, entitled an act to amend and re-enact the charter of the Bank of Manchester, came up.

The bill was read a third time and passed.

Mr. WALKER of Chesterfield moved to reconsider the vote by which the bill was passed, which motion was rejected.

No. 75. Senate bill entitled an act for the relief of C. W. Sullivan, treasurer of Montgomery county, and John H. Goodloe, treasurer of Nelson county, came up.

On motion of Mr. STEVENS, the bill was passed by.

No. 6. Senate bill entitled an act imposing certain duties upon county and corporation treasurers and other collectors of state revenue, and fixing the penalty for failure to perform them, came up.

The first amendment proposed by the committee on finance was agreed to, as follows:
