No. 46. House bill to amend and re-enact section 53 of chapter 21 of the Criminal Code in reference to the organization, government and discipline of the penitentiary, approved March 14, 1878, came up. Mr. SOUTHWARD moved to dismiss the bill.

Mr. PULLIAM moved to commit the bill to the committee on asylums and prisons.

Mr. SHELBURNE moved the pending question, which was ordered. The motion by Mr. PULLIAM was agreed to.

No. 51. House bill in relation to the testimony of persons charged with criminal offences testifying in their own behalf, was, on motion of Mr. GRAVES, passed by.

On motion of Mr. MCCAULL, the House adjourned until to-morrow at 12 o'clock M.

SATURDAY, JANUARY 18, 1879.

The reading of the Journal was dispensed with, on motion of Mr. KYLE.

A communication from the Senate by their clerk, was read as follows:

In Senate, January 17, 1879. The Senate have passed House bill entitled an act to amend and reenact section 32 of chapter 8 of the Code of 1873, in reference to the counting of the vote by board of state canvassers in cases of special elections, No. 67; and they have agreed to the substitute proposed by the House of Delegates to Senate joint resolution returning thanks to W. W. Corcoran, Esq., of Washington city, for the gift of a valuable painting.

No. 85. Senate bill entitled an act to enable the Chesapeake and Ohio railway company to increase its capital stock for certain purposes, was reported from the committee on roads and internal navigation.

No. 129. House bill to authorize W. L. Cook to erect a wharf upon his land on York river, reported from the committee on roads and internal navigation, was read a first time.

No. 130. House bill to amend and re-enact the seventeenth section of the seventh chapter of an act reviving, amending and re-enacting certain sections and chapters of the criminal laws of the commonwealth, approved March 14, 1878, and found in session acts 1877-78, pages 279 to 380, reported from the committee for courts of justice with the recommendation that it do not pass, was read a first time. Mr. DAVIDSON, under a supension of the rules, presented

No. 132. House bill to amend and re-enact an act entitled an act for the protection of game, approved March 14, 1878, which was read a first time.

Mr. WALSH offered the following preamble and resolution :

Whereas the board of directors of the Virginia penitentiary, in their annual report of November 10th, 1878, says "it now feels constrained to suggest the abolition of the office of general agent altogether, as superfluous and expensive," and that "the abolition of said office would place the business of the institution under the control of one head, which could thus be held to a stricter accountability and the state be saved from $300 to $500 per annum in the shape of commissions and other charges;" therefore, be it

Resolved, That the committee on asylums and prisons be instructed. to enquire into the expediency of abolishing the office of general agent of the penitentiary, and report by bill or otherwise.

The question being on reference, was put and decided in the affirm

ative.

The preamble and resolution was referred to the committee on asylums and prisons.

Mr. FULKERSON offered the following resolution:

Resolved, That on and after Monday next the House will meet at 11 o'clock A. M., and that the chair be vacated at 3 o'clock P. M. The question being on reference, was put and decided in the affirmative.

The resolution was referred to the committee on rules.

Mr. CARTER of Loudoun, offered the following resolution:

Resolved, That the committee for courts of justice be instructed to enquire whether the abandoned turnpikes do not legally revert to the original land owner where no compensation was given for the land through which said turnpikes run.

The question being on reference, was put and decided in the affirmative.

The resolution was referred to the committee for courts of justice. Mr. Henry offered the following resolution:

Resolved, That the committee on asylums and prisons be directed to report a bill requiring all supplies and materials needed for the penitentiary to be purchased after advertising for the lowest bidders, and requiring all the moneys received from sales of articles manufactured in the penitentiary to be paid into the treasury, and that no money be paid out for said institution except on the warrant of the auditor.

The question being on reference, was put and decided in the negative.

Pending the question on agreeing to the resolution, on motion of Mr. HENRY, the resolution was passed by.

Mr. FAUNTLEROY offered the following resolution:

Resolved, That the committee on federal relations of the House of Delegates have leave to confer and sit with the special committee of the Senate to inquire into the exercise of jurisdiction by the judge of the district court of the United States in the case of Burwell Reynolds and Lee Reynolds, as a joint committee, and report accordingly.

The question being on reference, was put and decided in the negative.

The resolution was agreed to, two-thirds agreeing thereto.

On motion of Mr. GRAY, the use of the hall was granted to Dr. George W. Bagby on the evening of the 24th instant.

Leave of absence was granted Messrs. TROUT and MCCAULL three days each, MONCURE one day, and indefinite leave for Mr. HINER.

By Mr. MUSHBACH: A bill to incorporate the Virginia mining and manufacturing company. Referred to committee on propositions and grievances.

By Mr. TALIAFERRO of Gloucester: A bill to amend and re-enact an act approved February 20, 1868, entitled an act to amend and reenact an act to amend and re-enact article six of chapter 100 of the Code of 1873, in relation to unlawful fishing. Referred to the committee on the Chesapeake and its tributaries.

The morning hour having expired, the House proceeded to business on the calendar.

No. 85. Senate bill entitled an act to enable the Chesapeake and 'Ohio railway company to increase its capital stock for certain purposes, came up.

Mr. HENRY moved to add at the end of the first section the following proviso:

Provided that the stock hereby authorized, and the property represented thereby, shall be subject to taxation as other property." Pending its consideration,

On motion of Mr. HENRY, the bill was recommitted to the committee on roads and internal navigation.

The following House engrossed bills were read a third time and passed:

No. 98. House engrossed bill to incorporate the Virginia and Statesville narrow-gauge railroad company.

No. 14. House engrossed bill to authorize the sale of certain church. property belonging to the vestrymen of St. Andrew's Protestant Epis copal church, Beckford parish, county of Shenandoah, to make a valid title to the same, and to reinvest the proceeds of the sale.

No. 86. House engrossed bill for the protection of deer in the county of Rockingham.

No. 55. House engrossed bill to amend and re-enact section 6, chapter 104 of Code of 1873, in regard to marriages.

Motions, severally made, to reconsider the votes by which Nos. 98, 14, 86 and 55, House bills were passed, were rejected.

No. 51. House bill in relation to the testimony of persons charged with crimmal offences testifying in their own behalf, came up.

On motion of Mr. SHELBURNE, the bill was passed by.

No. 54. House bill to amend and re-eanact section 13, chapter 178 of the Code of 1873, in relation to appeals, writs of error and supersedeas, came up.

The bill was read a second time.

Mr. HENRY moved to amend by inserting before the amended section the following:

"Be it enacted by the general assembly, That the thirteenth section of chapter 178 of the Code of 1873, in relation to appeals, writs of error and supersedeas, be amended so as to read as follows"— Which was agreed to.

The bill as amended was ordered to be engrossed to be read a third

No. 56. House bill to amend and re-enact the sixty-seventh section. of the charter of the city of Richmond, came up.

On motion of Mr. HENRY, the bill was passed by.

No. 60. House bill to incorporate Salonie cemetery company, near Middleburg, Loudoun county, Va., came up.

The bill was read a second time.

Mr. STEVENS moved to amend by inserting after the word "way," in the sixteenth line, first section, the words" be liable."

Pending its consideration.

On motion of Mr. CARTER of Loudoun, the bill was passed by.

On motion of Mr. FAUNTLEROY, the calendar was postponed five

minutes.

Mr. FAUNTLEROY, from the committee on federal relations and resolutions, submitted a report upon the exercise of jurisdiction by the United States district judge in the matter of Burwell Reynolds and Lee Reynolds.

On motion of Mr. FAUNTLEROY, the report was passed by.

The time to which the calendar was postponed having arrived, the House resumed business on the calendar.

No. 61. House bill to protect buzzards, came up.

The bill was read a second time, and ordered to be engrossed to be read a third time.

No. 62. House bill authorizing the classification of the stock of the Norfolk library association, came up.

The bill was read a second time, and ordered to be engrossed to be read a third time.

Mr. TALIAFERRO of Norfolk city, moved to reconsider the vote by which the bill was engrossed, which motion was rejected.

No. 64. House bill to amend and re-enact the first section of an act approved March 12, 1878, incorporating the Vance manufacturing company, of the city of Norfolk, came up.

The bill was read a second time, and ordered to be engrossed to be read a third time.

Mr. TALIAFERRO of Norfolk city, moved to reconsider the vote by which the bill was engrossed; which motion was agreed to.

Mr. TALIAFERRO of Norfolk city, moved to amend by inserting before the amended section the following:

Be it enacted by the general assmbly of Virginia, That the first section of an act entitled an act to incorporate the Vance manufacturing company of the city of Norfolk, be amended and re-enacted so as to read as follows"

Which was agreed to.

The bill as amended was ordered to be engrossed to be read a third time.
