fent Majefty; and the remaining feven Fifteenths of the faid Fund, appropriated for the Encouragement of the raifing and dreffing of Hemp and Flax in that Part of Great Britain called Scotland, is put under the Management of the Truftees and Commiffioners for encouraging and promoting Fishings, Manufactures, and Improvements, in that Part of Great Britain called Scotland: And whereas the eight Fifteenth Parts of the faid Fund allotted for, the Encouragement of the Growth of Hernp and Flax, in that Part of Great Britain called England, hath not hitherto been paid or applied for the Purposes for which the fame was intended: And whereas there is now remaining in his Majefty's Exchequer the Sum of forty-four thoufand feven hundred and nineteen Pounds nineteen Shillings and five Pence, referved there for encouraging the raifing and dreffing Hemp and Flax in that Part of Great Britain called England, as the proportional Part directed to be applied by the faid Act of the tenth Year of his Majefty's Reign, of the additional Duties on certain foreign Linens imported into this Kingdom, which were granted by an Act of the feventh Year of his Majefty's Reign: And whereas, if the faid Act of the tenth Year of his prefent Majesty's Reign, fo far as refpects the Diftribution and Payment of the faid Arrears, and of the faid eight Fifteenth Parts of the faid Fund appropriated to that Part of Great Britain called England, was altered, and the Application of the faid Fund put under the Management and Direction of the Commiffioners for Trade and Plantations, in the Manner hereafter directed, it would more fully answer the Intention of the Legiflature in paffing the faid Acts: May it therefore please your Majefty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That fo much of the faid recited Act, of the tenth Year of his prefent Majefty's Reign, as refpects the Direction, ordering, limiting, and appointing, of the DiftribuGeo.3. repealed. tion and Payment of the faid Sum of eight thousand Pounds per Annum, or of eight Fifteenth Parts of the Sum and Sums of Money which have already grown due, and been kept apart, and fhall hereafter grow due, and be kept apart, for the Encouragement of raifing and dreffing Hemp and Flax in this Kingdom by his Majesty's Royal Sign Manual, pursuant to the Directions of the faid Act of the tenth of his prefent Majefty, fhall be, and is hereby repealed.

II. And be it further enacted by the Authority aforefaid, That the Distribution and Payment of the Sum of eight thousand Pounds per Annum, from the Commencement of the faid Act of the feventh Year of his prefent Majefty, and annually afterwards, or of eight Fifteenth Parts of the Sum and Sums of Money which have already grown due, and been kept apart, and fhall hereafter grow due, and be kept apart, for the Encouragement of raifing and dreffing Hemp and Flax in this Kingdom, pursuant to the Directions of the faid Act of the tenth Year of his prefent Majefty, and every Matter and Thing for the Appropriation thereof, according the true Intent and Meaning of the faid Act of the feventh of his Majefty, fhall be, and is hereby put under the Management and Direction of the Commiffioners for Trade and Plantations, with and under fuch Conditions, Reftrictions, and Limitations, as herein-after are expreffed.

III. And be it enacted by the Authority aforefaid, That, for the Encouragement of the Growth of Hemp and Flax in that Part of Great Britain called England, there fhall be applied, diftributed, and paid, in Bounties yearly, a Sum not exceeding fifteen thousand Pounds, to be charged upon, and paid out of, the faid Arrears now in the Receipt of the Exchequer, and out of the After-produce of the faid Duties; at the Rate of three Pence per Stone for every Stone of Hemp weighing fourteen Pounds, and four Pence per Stone for every Stone of Flax weighing fourteen Pounds, to be raised in that Part of Great Britain called England, in the Year one thousand feven hundred and eighty-two, and in every subsequent Year during the Space of five Years, and which fhall be broken and properly prepared for Market, to be paid to the Grower, or other Perfon who breaks and properly prepares fuch Hemp and Flax for Market.

IV. And be it enacted by the Authority aforefaid, That the Grower, or Perfon claiming, and who shall be intitled to the faid Bounty, fhall fign and exhibit his Claim to one of the Juftices of the Peace for the County, Riding, or Place, within which the Hemp or Flax has been raifed, mentioning in fuch Claim of what Crop the fame is, and the Farm or Ground on which the Hemp or Flax grew; and which Claim fhall be likewife attefted by two of the Parish Officers of the fame Parifh with the Claimant or Grower, who fhall certify that they believe the Truth of the Particulars contained in fuch Claim; and which Claim, when fo attefted, the faid Juftice is hereby required to counterfign, and tranfmit to the Juftices for the County, Riding, or Place, at their next General Quarter Seffions.

V. And be it enacted by the Authority aforefaid, That every Perfon who fhall claim and receive any ing any Bounty of the Bounties_herein-before granted, fhall, at or before the Time when he fhall receive the fame, enter are to give Bond into a Bond or Security (without Stamps), to the Clerk of the Peace for the Time being, or his Succeffors, of the faid Counties, Ridings, or Places refpectively, with two fufficient Sureties, to be approved of by the faid Juftices, at their Quarter Seffions for the County, Riding, or Place, within which the faid Hemp or Flax was grown, in the penal Sum of Treble the Value of the Bounty claimed and received, and of the Hemp or Flax for which he shall have claimed and received the fame, with Condition that fuch Perfon is duly intitled to the faid Bounty, according the true Intent and Meaning of this Act; which Bond fhall and may be put in Suit, under the Orders and Directions of the faid Juftices at their Quarter Seffions, by the Clerk of the Peace for the Time being, against every fuch Perfon or Perfons as the Cafe fhall require; and all Sums of Money fo recovered fhall be put into the Hands of the Treasurer of the respective Counties, and be applied, in the first place, towards defraying the Charges and Expences of profecuting the fame, and the other Charges attending the Execution of this Act, and the Remainder towards the Fund out of which the faid Bounties are to be granted,

And be it further enacted by the Authority aforefaid, That the faid Juftices in each County, at their Quarter Seffions at Michaelmas next, and at every following Michaelmas Quarter Seffions, during the Continuance of this Act, fhall, and they are hereby required to advertise and publish the feveral Bounties by this Act granted, with the Conditions neceflary to be complied with before the fame can be received. VII. And be it enacted by the Authority aforefaid, That the faid Juftices, at the faid next Quarter Seffions, fhall publifh the Names and Places of Abode of the Perfons who have claimed the faid Bounties, and the Quantities of Hemp or Flax for which they claim, to the End that the faid Juftices may, by the Means aforefaid, or by fuch other Means, Methods, Proofs, and Inquiries, as they fhall direct and judge most fit, difcover and be able to ascertain, against their General Quarter Seffions at Midfummer in each Year, the Quantity of Hemp and Flax raifed in the County, Riding, or Place, and the Truth of the feveral Claimants Claims and Pretenfions; which Claims the faid Juftices, at the faid Midfummer Quarter Seffions, are hereby authorifed, empowered, and required finally to fettle and determine.

VIII. And be it enacted by the Authority aforefaid, That the faid Juftices fhall, at their faid Midfummer Quarter Seffions in each Year, make up a State of the Claims which have been finally fettled and allowed by them, and tranfmit the fame to the Commiffioners for Trade and Plantations; and the faid Commiffioners, on the Receipt of fuch Returns from the feveral Counties, fhall apportion the Sums applicable to each County, and certify to the Lord High Treasurer of Great Britain, or Lords Commiffioners of his Majesty's Treasury for the Time being, the Amount of the Sums fo claimed and allowed, and pray an Iflue of the whole Amount of the faid Bounties; and the Commiffioners of his Majefty's Treafury, or any three or more of them for the Time being, or the Lord High Treasurer for the Time being, fhall thereupon, and they are hereby empowered and required to iffue (without Fee or Reward) their Warrants or Orders to the Receivers of the Land Tax of the feveral Counties within which the faid Hemp and Flax respectively has been raised, to pay (without Deduction, Fee, or Reward), on the Order of the Quarter Seffions of each refpective County, Riding, or Place, the Sums appropriated for fuch County; and the faid Juftices, at their next enfuing Quarter Seffions, fhall diftribute and pay, without Fee or Reward, the fame to the feveral Perfons, or their Affigns, who fhall have been found intitled to the faid Bounties.

IX. Provided always, and it is hereby further enacted, That the Grower, or other Perfon preparing Hemp or Flax for Market, and who fhall fell any Quantity of Hemp or Flax within that Part of Great Britain called England, thall deliver to the Buyer, along with fuch Hemp or Flax, a particular Account of the Hemp and Flax fold, expreffing the Quantity, Place where it grew, and the Year of its Growth; and the Seller in like Manner fhall take of the Buyer a Receipt, in Writing, containing a Duplicate of the Quantity bought, the Place where it grew, and the Year of its Growth.

X. And be it enacted by the Authority aforefaid, That, for the better Information of the Lords Commiffioners for Trade and Plantations, the faid Juftices in each County fhall, and they are hereby required from Time to Time, at their several Quarter Seffions, to make up, and tranfmit to the faid Commiffioners for Trade and Plantations, a State of the Claims which have been then made, and their Proceedings and Judgements thereupon, which the faid Commiffioners fhall return to the Quarter Seffions of each County, with fuch Obfervations as may occur to them, and fuch Directions as they may think neceffary for the better ascertaining the Claims, and which Directions the faid Quarter Seffions are hereby required to obferve and comply with.

XI. And be it enacted by the Authority aforefaid, That the faid Commiffioners for Trade and Plantations fhall annually make up an exact Account of the Quantities of Hemp and Flax raised, and of the Monies prayed and iffued to the Quarter Seffions of the different Counties, and fhall annually lay the fame before both Houfes of Parliament. annually before

XII. And be it enacted by the Authority aforefaid, That it fhall and may be lawful for the faid Commiffioners for Trade and Plantations to make fuch further Rules and Orders for the faid Bounties, and for preventing Abufes therein, as they shall think expedient, according to the true Intent and Meaning of this Act. XIII. And be it enacted by the Authority aforefaid, That fuch reafonable Allowances fhall be made to the Clerks of the Peace refpectively, for what they fhall do and perform in their respective Offices for and towards the carrying into Execution the Purposes of this Act, as the Juftices, at their respective Quarter Seffions, fhall from Time to Time order and direct.

XIV. Provided always, and be it further enacted by the Authority aforefaid, That the faid recited Acts of the feventh and tenth Years of his Majefty's Reign, fhall continue and be in full Force in all Respects, except in fo far as the fame are hereby altered or varied.

XV. And be it enacted by the Authority aforefaid, That this Act fhall continue and be in force for and during the full Term of five Years from the firft Day of Auguft in the Year one thousand feven hundred and eighty-two, and from thence to the End of the then next Seffion of Parliament.

An A&t for establishing an Agreement with the Governor and Company of the Bank of England, for advancing the Sum of two Millions, towards the Supply for the Service of the Year one thousand seven hundred and eighty-one.

"The Bank are willing to advance two Millions for the Service of the prefent Year; provided their ex"clufive Privilege of Banking, &c. be confirmed. Commiffioners of the Treafury empowered to make ❝out Exchequer Bills for two Millions, before April 5, 1782. Exchequer Bills to bear Intereft. Bills "iffued at the Exchequer not to be current to any Collector of the Cuftoms, &c. for three Years; except "for the Discharge thereof. Exchequer Bills to be repaid out of any Supplies to be granted for the Year "1784. If fufficient Supplies are not granted before April 5, 1784, the faid Bills fhall be charged on the "Sinking Fund. Monies fo iflued out of the Sinking Fund to be replaced out of the first Supplies. The "Bank to exchange for ready Money all fuch Bills, with Intereft, as fhall, within three Years, be tendered .6 to them: But shall not be intitled to any Premium for the fame.

ND, for the Encouragement of the faid Governor and Company of the Bank of England, and their Succeffors, to exchange and circulate the faid Exchequer Bills, in the Manner and during the Time herein-before mentioned; and to the End the faid Governor and Company, and their Succeflors, may have a competent Recompence and Confideration for fo doing;' it is hereby declared and enacted by the Authority aforefaid, That fuch Part of the faid recited Provifion contained in the faid Act, made in the fourth Year of the Reign of his prefent Majefty, as relates to the determining the faid Fund of one hundred thoufand Pounds per Annum, and the faid Corporation of the Governor and Company of the Bank of England, upon the Notice and Payments therein mentioned, fhall be, and is hereby repealed and made void; and that the faid Governor and Company of the Bank of England, and their Succeffors for ever, fhall remain, continue, and be one Body Corporate and Politick, by the Name aforefaid, and fhall for ever have, receive, and enjoy, the faid entire yearly Fund of one hundred thousand Pounds out of the faid Rates and The Bank to re- Duties of Excile, together with a perpetual Succeffion and Privilege of exclufive Banking, as herein-after is mentioned, and all other Abilities, Capacities, Powers, Authorities, Franchifes, Exemptions, Privileges, Corporate, &c. XII. And to prevent any Doubts that may arise concerning the Privilege or Power given, by former Acts of Parliament, to the faid Governor and Company, of exclufive Banking, and alfo in regard to the erecting any other Bank or Banks by Parliament, or reftraining other Perfons from Banking during the Continuance of the faid Privilege, granted to the Governor and Company of the Bank of England, as 4 before recited; it is hereby further enacted and declared by the Authority aforefaid, That it is the true Intent and Meaning of this Act, that no other Bank fhall be erected, established, or allowed by Parlia ment; and that it fhall not be lawful for any Body Politick or Corporate whatsoever, erected or to be erected, or for any other Perfons, united or to be united in Covenants or Partnership, exceeding the Number of fix Perfons, in that Part of Great Britain called England, to borrow, owe, or take up, any Sum or Sums of Money on their Bills or Notes, payable at Demand, or at any lefs Time than fix Months from the borrowing thereof, during the Continuance of fuch faid Privilege to the faid Governor and Company; who are hereby declared to be and remain a Corporation, with the Privilege of exclufive Banking, as before recited, fubject to Redemption on the Terms and Conditions before mentioned; that is to fay, on one Year's Notice after the first Day of August one thoufand eight hundred and twelve, and Repayment of the three millions two hundred thousand Pounds, and all Arrears of the one hundred thou fand Pounds per Annum, and all the Principal and Intereft Money that fhall be owing them on all fuch Tallies, Exchequer Orders, Exchequer Bills, or Parliamentary Funds (fuch Funds as are before mentioned only and always excepted), which the faid Governor and Company, or their Succeffors, fhall have re

An Act to explain and amend an Act made in the eighth and ninth Years of the Reign of King WILLIAM the Third (intituled, An Act for the leffening the Duty upon Tin and Pewter exported, and granting an Equivalent for the fame by a Duty upon Drugs,) fo far as the fame relates to the Importation of Drugs from the Ruffian Dominions; and alfo an Act made in the third Year of the Reign of his present Majefty (intituled, An A&l for the further Improvement of his Majesty's Revenue of Customs, and for the Encouragement of Officers making Seizures, and for the Prevention of the clandeftine Running of Goods into any Part of his Majefty's Dominions), to permit the Importation of Orchillia Weed, and Cobalt, during the prefent Hoftilities, from any Place whatsoever, in British, Irish, or Neutral Ships; and to permit Sugars, the Growth of Demerary and Effequibo, to be imported into Great Britain, upon Payment of the like Duties, and under the like Reftrictions, as Sugars of the British Islands in the Weft Indies.

HEREAS by an Act of Parliament in the eighth and ninth Years of the Reign of King WILLIAM the Third, intituled, An A for the lefening the Duty upon Tin and Pewter exported, and 8 & 9 Gul. 3 granting an Equivalent for the fame by a Duty upon Drugs; after reciting that, Whereas by an Act, made in the twelfth Year of the late King CHARLES the Second, intituled, A Subfidy granted to the King of • Tonnage and Poundage, and other Sums of Money payable upon Merchandizes exported and imported, it was provided, That all Drugs, imported directly from the Place of their Growth in English-built Shipping, be rated one third Part of what is charged in the Book of Rates, and no more; it was, amongst other Things, enacted, That the Subfidy to be received for all Drugs imported directly from the Place of their Growth in English-built Shipping, fhall be according to the full Value on the refpective Species • enumerated in the Book of Rates, and not according to the faid Abatement; and for all Drugs otherwife imported, Treble fuch full Value: And whereas Doubts have arifen whether Drugs, the Growth of Ruffia, 'imported from certain Ports in Ruffia, which were not fubject to, and under the Dominion of, the Ruffian Empire, at the Time of paffing the faid recited Act, can be now imported from fuch. Ports upon Pay⚫ment of the fingle Duty;' for obviating which Doubts, be it enacted by the King's moft Excellent Majesty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the twentieth Day of July one thoufand feven hundred and eighty-one, all Drugs of the Growth, Production, or Manufacture, of any Part of the Dominions of Ruffia, which thall be laden and fhipped at any Port or Place fubject to and within the faid Ruffian Dominions, and imported from thence in British-built Shipping into this Kingdom, fhall be deemed and taken to be imported directly from the Place of their Growth, Production, or Manufacture, and fhall be liable to and pay Duties accordingly; any Thing in the faid recited, Act, or any other Act or Acts of Parliament, to the contrary notwithstanding.

II. And whereas by an Act of Parliament, made in the third Year of the Reign of his prefent Majefty, intituled, An Act for the further Improvement of his Majesty's Revenue of Customs; and for the En- 3.Geo. 3. c.221couragement of Officers making Seizures; and for the Prevention of the clandeftine Running of Goods into any Part of his Majesty's Dominions; it is, amongst other Things, enacted, That it fhall and may be lawful to and for the Commiffioners of his Majefty's Cuftoms to caufe all. Ships, Vellels, and Boats, and all Goods, of what Kind foever they may be (excepting only fuch Veffels, Boats, and Goods, as are by Law liable to be burnt), which thall be feized by any Officers of the Cuftoms for unlawful Importation,, or for Nonpayment of Duties, or for any other Caule of Forfeiture, and condemned according to Law,, to be fold publickly to the best Bidder, at fuch Places as the faid Commiffioners fhall think proper; and. all and every Officer who fhall feize fuch Goods, fhall, for his and their Encouragement, be allowed by the faid Commiffioners one Moiety of the net Produce arifing by the Sale of fuch Seizure, after the deducting the Charges of Condemnation and Sale from the Whole; and the faid Commiffioners fhall

cause the other Moiety thereof to be paid into the Receipt of his Majefty's Exchequer, in lieu of his Majefty's Share thereof (excepting in thofe Cafes which are otherwife provided for by the faid Act): And whereas it is by the laid Act provided and further enacted, That if the Produce of any particular Seizure, fold in pursuance of the faid Act, fhall not be fufficient to answer the Expences of Condemna tion and Sale, or if, upon the Trial of any Seizure, a Verdict fhall be given for the Claimant, and the Ship or Goods fhall not be condemned, in either of thofe Cafes it fhall and may be lawful for the Commiffioners of his Majefty's Cuftoms to order the Charges attending the feizing and profecuting fuch Ship or Goods, to be paid out of any Branch of the Revenue of the Cuftoms which is by Law applicable to the Payment of Incidents: And whereas it is not reafonable that fuch Part of the publick Revenue, which is by Law applicable to the Payment of Incidents, fhould be burthened with the Expences of profecuting fuch Seizures, but, on the contrary, that fuch Charges and Expences, and other Law Charges, and Expences of Management, where it may be judged neceflary by the Commiffioners of his Majefty's Cuftoms, fhould "be defrayed out of the Produce arifing by the Sale of Seizures which are condemned: Be it therefore enacted by the Authority aforefaid, That where any Ship, Veffel, Boat, or Goods, fhall be feized by any Officer or Officers of his Majefty's Cuftoms, which are by Law liable on Condemnation to be burnt, or otherwise destroyed, or where the Produce arifing by the Sale of any particular Seizure fhall not be fufficient thall be defrayed, to answer the Expences of feizing, profecuting, or condemning the fame; or if upon any Trial a Verdict fhall be given for the Claimant, or the Ship, Veffel, Boat, or Goods, fo feized, fhall not be condemned; in either of thofe Cafes, it fhall and may be lawful for the Commiffioners of his Majefty's Cuftoms, if they think proper, to order the Charges arifing by the Condemnation and Sale, and by the Seizure and Profecution of fuch Ships, Veffels, and Boats, or Goods, whether they fhall be condemned or not, and all Manner of Law Bills, and other Charges of Management, to be paid out of his Majefty's Share of the Produce arifing by the Sale of any Goods which have been, or may be feized and condemned, in like Manner as may now be done out of any other Branch of the Revenue of the Cuftoms, which is by Law applicable to the Payment of Incidents; any Thing in the faid recited Act, or any other Act or Acts of Parliament, or any Cuftom or Ufage, to the contrary notwithstanding.

6 III. And whereas Orchillia Weed is very useful and neceffary in the dying Manufactures, and, by reafon of the prefent Hoftilities, it cannot be now imported into this Kingdom directly from the Place of its Growth, in Ships navigated according to the Laws now in force, without great Hazard and Expence to the Importers thereof: And whereas Cobalt is very neceflary in Medicine and various Manufactures, and it is expedient at this Time to encourage the Importation thereof into this Kingdom: Be it therefore further enacted by the Authority aforefaid, That, from and after the twentieth Day of July one thoufand feven hundred and eighty-one, and during the prefent Hoftilities with France, Spain, and the United Provinces, or either of them, it fhall and may be lawful for any Perfon or Perfons to import into any Part of Great Britain any Orchillia Weed and Cobalt, from any Port or Place whatfoever, in any British or Irish Ship or Veflel navigated according to Law, or in any foreign Ship or Veflel belonging to any Kingdom or State in Amity with his Majefty, his Heirs or Succeffors, navigated by foreign Seamen, without paying any Cuftom or Duty whatsoever for the fame, fo as a due Entry be firft made thereof at the Cuftom-houfe belonging to the Port into which fuch Orchillia Weed and Cobalt fhall be imported, in the fame Manner and Form as was used and practifed before the making of this Act, and fo as the fame thall be landed in the Prefence of the proper Officer appointed for that Purpofe, otherwife fuch Orchillia Weed and Cobalt fhall be liable to the fame Duties, Penalties, and Forfeitures, as if this Act had not been made; any Law, Cuftom, or Ufage, to the contrary notwithstanding.

IV. And whereas by an Act of Parliament, made in the fixth Year of the Reign of his prefent Majefty, intituled, An Act for repealing certain Duties, in the British Colonies and Plantations, granted by feveral Acts of Parliament; and all the Duties impofed by an Act made in the last Seffion of Parliament upon certain Eaft India Goods exported from Great Britain; and for granting other Duties instead thereof; and for •further encouraging, regulating, and fecuring feveral Branches of the Trade of this Kingdom, and the British Dominions in America; it is, amongst other Things, enacted, That all Sugars which fhall be imported into Great Britain from any Part of the British Colonies or Plantations on the Continent of America, shall be deemed and taken to be French Sugars: And whereas the Colonies of Demerary and Effequibo, on the Continent of America, formerly under the Dominion of the States General of the United Provinces, have lately furrendered to his Majefty's Arms, and being now in his Poffeffion, it is reasonable and expedient, for the Encouragement of the Sugar Planters in thofe Colonies, that Sugars of the Growth and Produce thereof fhould be deemed British Sugars: Be it therefore enacted by the Autho rity aforefaid, That, from and after the fourteenth Day of March one thoufand feven hundred and eighty-one, all Sugar the Growth and Produce of the faid Colonies of Demerary and Effiquibs, fhall be deemed and taken to be British Sugars, and fhall and may be exported from thence, and imported into this Kingdom, upon Payment of the fame Duties, and upon Exportation intitled to the fame Drawback as Sugars the Growth and Produce of any British Island in the West Indies; and fhall in all Refpects be fubject and liable to the fame Securities, Certificates, Rules, Regulations, and Reftrictions, Penalties and Forfeitures, as Sugars the Growth and Produce of the British Islands in the West Indies are fubject and liable to by Law; any Thing in the faid recited Act, or any other Act or Acts, to the contrary notwith, standing.

V. Provided always, and it is hereby further enacted by the Authority aforefaid, That until there shall be &e. empowered Officers of his Majefty's Cuftoms appointed for that Purpofe in the faid Colonies of Demerary ani Effequibo, it thall and may be lawful for the Naval Officer, or any other Officer appointed by the Com mander in Chief of his Majefty's Forces in America, or the Commanding Officer of the Troops at those Colonics
