allowed as a Premium on all fuch Hemp as he intends to export, over and above any Duty the fame is or befides other may by Law be fubject to pay at Exportation by any Act: Provided always, That the faid Collector or Dutine, a the Chief Officer of the Cuftoms, upon receiving fuch Premium from the Exporter of fuch Hemp as aforefaid, Port of Exporthall charge himfelf with the Money fo received, or with the faid Premium, and the Commiffioners of his Majefty's Cuftoms are to take particular Care that the fame be duly brought to the Account of his Majefly by fuch Collector or Chief Officer as aforefaid.

VIII. And be it further enacted by the Authority aforefaid, That if any Perfon or Perfons, their Agents or Affigns, fhall be found fraudulently to export fuch Hemp without paying fuch Premium to the Collector or Chief Officer of the Cuftoms in Manner aforefaid, fuch Perfon or Perfons fhall forfeit and lofe all fuch Hemp, and double the Value thereof; one Moiety whereof fhall be to the Ufe of his Majefty, his Heirs and Succeffors, and the other moiety to the Informer or Profecutor, to be profecuted in any of his Majefty's Courts of Record at Westminster, or in the Court of Exchequer in Scotland, refpectively, wherein no Efloin, Protection, or Wager of Law, or more than one Imparlance, fhall be allowed.

IX. Provided always, That if any Doubt or Difpute fhall arife whether the Hemp, or any Part thereof, Onus probandi fo to be exported, is of the Growth, Product, or Manufacture of Ireland, or of foreign Growth, Product, to lie on the or Manufacture, the Onus probandi fhall lie on the Owner or Claimer thereof, and not on the Informer or Profecutor; any Law, Cuftom, or Ufage to the contrary notwithstanding.

X. And be it further enacted by the Authority aforefaid, That if the Mafter or Owner of any Ship or Veffel fhall clandeftinely import or receive in fuch Ship or Veffel, to be imported into Great Britain, any Hemp, knowing the fame to be foreign Hemp, and fhall demand or receive for any fuch foreign Hemp the Reward or Premium hereby granted, fuch Mafter or Owner fhall forfeit the Sum of one hundred Pounds, to be fued for and recovered in Manner as aforefaid; and the Ship or Veffel in which fuch foreign Hemp fhall be fo fraudulently imported, with all her Guns, Tackle, Apparel, and Furniture, fhall be forfeited to the King's Majefty, his Heirs and Succeffors.

An Act for altering the Times of holding the Martinmas and Candlemas Terms in the
Court of Exchequer in Scotland.

HEREAS the Terms of Martinmas and Candlemas, as they are at prefent kept, for the fitting of the Court of Exchequer in Scotland, have been found inconvenient: And whereas it would be more convenient for the Subjects of Scotland, that the faid Terms were altered;' be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That Martinmas Term, for the faid Court of Exchequer, fhall, at all Times hereafter, begin on the twenty-fourth Day of November, and end upon the twentieth Day of December; and that Candlemas Term,for the faid Court, fhall at all Times hereafter, begin on the fifteenth Day of January, and end on the third Day of February; except any of the faid Days, upon which the faid Terms are appointed to begin or end, thall happen to be a Sunday, in which Cafe the Beginning or Ending of fuch Term in which that happens fhall be upon the Day following.

WHEREAS, notwithstanding the many Laws made for fecuring the Revenues on Starch, and for See 24 Geo. 3.

Perfons, who are encouraged in fuch Practices, not only from the great Length of Time allowed by thofe Laws for the Payment of the Duties on Starch, but alfo for want of fome further Regulations in the Manner of carrying on the Starch-making Bufinefs;' for Remedy whereof, be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the fifth Day of July one thoufand feven hundred and feventy-nine, no Peifon or Perfons whatfoever, refiding within the Limits of the Head Office of Excife in London, fhall be permitted to make Entry of any Workhouse or Place for the making of Starch, as required by the Statutes in that Cafe already made and provided, unless fuch Perfon or Perfons fhall occupy a Tenement or Tenements of the yearly Value of ten Pounds, or upwards, and for which he, fhe, or they fhall accordingly be affeffed in their own Name, and fhall alfo pay to the Parish Rates; and that no Perfon or Perfons whatfoever, refiding in any other Part of the Kingdom where there are Rates to Church and Poor, fhall be permitted to make any fuch Entry, Rates; unless fuch Perfon or Perfons fhall be affeffed and pay to Church and Poor, in the feveral Parishes and and no Perfon, Places in any other

II. And whereas, by an Act paffed in the tenth Year of the Reign of her late Majesty Queen ANNE (intituled, An Act for laying additional Duties on Hides and Skins, Vellum and Parchment, and new Duties on Starch, Coffee, Tea, Drugs, Gilt and Silver Wire, and Policies of Infurance, to fecure a yearly Fund for Satisfaction of Orders to the Contributors of a further Sum of one million eight hundred thousand Pounds towards her Majesty's Supply; and for the better fecuring the Duties on Candles; and for obviating Doubts concerning certain Payments in Scotland; and for fuppreffing unlawful Lotteries, and other Devices of the fame Kind; and concerning Cake-foap; and for Relief of Mary Ravenall, in relation to an Annuity of eighteen • Pounds per Annum; and concerning Prize Cocoa-nuts brought from America; and certain Tickets which were intended to be fubfcribed into the Stock of the South Sea Company; and for appropriating the Monies granted in this Seffion of Parliament); it was, amongst other Things, enacted, That all and every Perfon and Perfons whatsoever, who fhould make any Starch in London, Westminster, or in any Parts within the Weekly Bills of Mortality, fhould monthly, and every Month; and all and every Perfon or Perfons whatsoever, who fhould make any Starch in any other Part of Great Britain, fhould, once in every fix Weeks, make a true Entry in Writing, at the next Office for the faid Duties, of all the Starch by him, her, or them, feverally made within fuch Month, or fix Weeks, refpectively; which Entries were to be made in Manner as is therein expreffed: And it was further enacted by the faid Act, that all and every Perfon, who 'fhould make any Starch in London or Weftminster, or within the Limits of the faid Weekly Bills of Mortality, fhould, within four Weeks; and all and every Perfon whatsoever, who fhould make any Starch in any other Parts of Great Britain, fhould, within fix Weeks, after he, fhe, or they fhould have made, or ought to have made, fuch Entry as aforefaid, pay and clear off all the faid Duties upon Starch which fhould be due from him, her, or them refpectively; and that all and every fuch Makers of Starch, who fhould refufe or neglect to make fuch Payment as aforefaid, fhould forfeit and lofe, for every fuch Offence, double the Sum of the faid Duty: And whereas the Allowance of fo long a Time for the making of the Entries, and for the Payment of the Duties, as aforefaid, hath been found prejudicial to the Revenue, and alfo to the fair Trader, as evil-minded and indigent Perfons have been encouraged thereby to make Starch, and have made Entry of the Starch by them made, but have neglected to pay the Duty when due, and before the Time that the Duty could be recovered have abfconded from their refpective Dwelling-places, or by other Methods have evaded the Payment of the fame;' be it therefore enacted by the Authority aforefaid, That, from and after the fifth Day of July one thousand feven hundred and feventy-nine, the above-recited Claufes, and every Article, Matter, and Thing therein contained, shall be, and are hereby repealed, and made null and void; fave only and except in all Cafes relating to the recovering any Arrears which may at that Time remain unpaid of the faid Duties, or to any Penalty or Forfeiture which fhall have been incurred upon, or at any Time before, the faid fifth Day of July one thoufand feven hundred and feventy-nine; any Thing herein contained to the contrary notwithstanding.

III. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of July one thoufand feven hundred and feventy-nine, all and every Perfon whatfoever, who fhall make any Starch, fhall, weekly and every Week, make a true Entry in Writing, at the next Office for the Duties on Starch, of all the Starch by him, her, or them feverally made within each Week; which faid Entries fhall contain the Weight of all the Starch mentioned therein refpectively, and what Quantity thercof was made at each Making in that Week, on Pain to forfeit, for every Neglect, the Sum of fifty Pounds; which Entries fhall be made upon Oath by the Maker of fuch Starch, or by their Chief Workman or Servant employed in making the fame, according to the beft of their Knowledge and Belief, unless such Maker, Workman, or Servant, be a known Quaker, and the folemn Affirmation of fuch Maker, Workman, or Servant, to the fame Effect, in cafe he or fhe be a known Quaker, fhall and may be taken inftead of fuch Oath; and the faid Entries, Oaths and Affirmations to verify the fame, fhall, for fuch Starch as fhall be made within the Limits of the Chief Office of Excife in London, be made with and administered by fuch Officer or Officers as fhall be appointed by the Commiflioners for the Duties on Starch in England, or the major Part of them for the Time being; and for all Starch made in all other Parts of Great Britain, with and by the Collectors and Supervisors of the District or Divifion within which the refpective Makers of Starch fhall inhabit, without any Fee or Charge whatfoever to be taken or demanded for the fame.

IV. And be it further enacted by the Authority aforefaid, That all and every Perfon and Perfons whatfoever, who fhall make any Starch in Great Britain, fhall, within one Week after he, fhe, or they fhall Week after En make, or ought to have made, fuch Entry as aforefaid, pay and clear off all the Duties for Starch which fhall be due from him, her, or them refpectively; and that all and every fuch Maker of Starch, who double, &c. fhall refufe or neglect to make fuch Payment as aforefaid, fhall forfeit and lofe, for every fuch Offence, double the Sum of the faid Duty whereof the Payment fhall be fo refused or neglected; and that no fuch Makers of Starch, after fuch Default in Payment made, fhall fell, deliver, or carry out, any Starch until he hath paid and cleared off his Duty, as aforefaid, on Pain to forfeit double the Value of fuch Starch fo delivered or carried out.

V. Provided always, That no Maker of Starch fhall be obliged to go or fend farther than the Markettown where his or her Starch is made, or the next Market-town to the Place where his or her Starch is made, for the making fuch Entries, or the Payment of the faid Duties.

And, for the better preventing the Frauds frequently committed by divers Makers of Starch, by emptying the Vat or Vats, made ufe of for making of Starch in the Abfence of the Excife Officer,' be it enacted by the Authority aforefaid, That, from and after the fifth Day of July one thousand seven hundred and feventy-nine, every Maker of Starch, before he, fhe, or they do begin to empty or wash out any of the Vat or Vats, made ufe of by him, her, or them, in preparing or making of Starch, he, fhe, or they fhall give to the Officer of Excife of the Divifion or District where his, her, or their Starch-houfe is fituate, twelve Hours Notice, if fuch Starch-houfe fhall be within the Limits of the Chief Office of Excife in London; or if fuch Starch-house fhall be in any other Part of Great Britain, twenty-four Hours Notice of the particular Time and Hour when and at which he, fhe, or they intend to begin to empty or wash out fuch Vat or Vats; and in cafe fuch Maker or Makers of Starch fhall not begin to empty or wash out the faid Vat or Vats, at the Hour and Times mentioned in fuch Notice, or within two Hours next after, then every fuch Notice fhall be, and is hereby declared to be, void, and every fuch Maker and Makers of Starch fhall, and is hereby obliged to give a fresh and like Notice in Manner aforefaid: And in cafe any fuch Maker or on Forfeiture of Makers of Starch fhall neglect or refufe to give fuch first Notice before he begins to empty or wash out his, 1001. her, or their Vat or Vats, or to infert in fuch Notice the Particulars herein before required, or to give a fresh Notice in Manner aforefaid, before he begins to empty or wash out the Vat or Vats, in cafe he, the, or they fhall not begin and proceed to empty or wash out the faid Vat or Vats at the Hour and Time mentioned in the faid firft Notice, or within two Hours next afterward, fuch Maker or Makers of Starch fhall, in every fuch Cafe, for every fuch Offence, forfeit and lofe the Sum of one hundred Pounds. VII. And be it further enacted by the Authority aforefaid, That when and fo foon as the faid Vat or Vats fhall be fo emptied or washed out as aforefaid, and the Water shall be put into the Frames, Tubs, or other Utenfils, used for preparing and making the fame into Starch, the faid Waters fhall remain unmoved and undisturbed in the fame Frames, Tubs, or Utenfils, for the Space of forty-eight Hours, at least, from the Time of emptying and washing out the faid Vat or Vats, agreeable to the faid Notice, and that the Slimes and Wafh fhall not, during the faid Space of forty-eight Hours, be taken off the fame: And that the Officers for the Duties upon Starch may be able to afcertain when the faid Waters were fo put into the faid Frames, Tubs, or Utenfils, after the faid Vat or Vats have been emptied or washed out, as aforefaid, every Maker of Starch fhall give, or caufe to be given, to the Officer of Excife under whofe Survey fuch Maker of Starch fhall then be, a Notice in Writing, fpecifying therein the particular Hour or Time of the Day when fuch Maker of Starch did finish the emptying or washing out of each and every Vat and Vats and if any Maker or Makers of Starch fhall, after the faid fifth Day of July one thousand feven hundred and feventy-nine, neglect to deliver fuch Notice as laft aforefaid, he, fhe, or they fhall, for every fuch Neglect, forfeit and lofe the Sum of one hundred Pounds.

VIII. And be it further enacted by the Authority aforefaid, That whenever any Maker or Makers of Starch fhall be defirous to take off from the four Waters the Slimes or Wash fo put into the Frames, Tubs, or Utenfils, after the fame fhall have been and have remained unmoved and undisturbed for the Space of forty-eight Hours, as aforefaid, he, fhe, or they fhall give to the Officer of Excife of the Divifion or Diftrict where his, her, or their Starch-houfe is fituate, twelve Hours Notice, if fuch Starch-houfe fhall be within the Limits of the Chief Office of Excife in London, or if fuch Starch-house fhall be in any other Part of Great Britain, twenty-four Hours Notice, of the particular Time and Hour when and at which he intends to take off fuch Slimes and Wash; and in cafe fuch Maker or Makers of Starch fhall not begin and proceed to take off the Slimes and Wash as aforefaid at the Time and Hour mentioned in fuch Notice, or within two Hours next after, then every fuch Notice fhall be, and is hereby declared to be, void, and every fuch Maker and Makers of Starch fhall be, and is hereby obliged to give a fresh and like Notice, in Manner aforefaid; and in cafe any fuch Maker or Makers of Starch fhall neglect to give fuch first Notice before he begins to take off fuch Slimes or Wafh, or to infert in fuch Notice the Particulars herein-before tool. required, or to give a fresh Notice, in Manner aforefaid, before he begins to take off fuch Slimes or Wath, in cafe he, fhe, or they fhall not begin and proceed to take off fuch Slimes and Wafh at the Hour and Time mentioned in the faid firft Notice, or within two Hours next afterwards, such Maker or Makers of Starch fhall, in every fuch Cafe, for every fuch Offence, forfeit and lofe the Sum of one hundred Pounds.

IX. And be it further enacted, That when the Slimes fhall be taken off, as aforefaid, and the fame fhall be put into any Tub or Tubs, or other Utenfil, the fame fhall remain in the fame Tub or Tubs, or other Utenfils, into which the fame fhall have been firft put, for the Space of twenty-four Hours after the fame fhall have been to taken off; and if any Maker or Makers of Starch fhall move or disturb the Waters after the fame fhall have been fo emptied or wathed out of the Vat or Vats into any Frame, Tub, or Utenfil, or fhall take off the Siimes or Wath during the Space of forty-eight Hours, as aforefaid, or fhall move or disturb the Slimes after the fame fhall have been put into fuch Tub or Tubs, or other Utenfil, during the Space of twenty-four Hours, as aforefaid, then, and in every fuch Cafe, fuch Maker and Makers of Starch fhall, for every fuch Offence, forfeit and lofe the Sum of one hundred Pounds.

X. And, the better to prevent any Frauds by the fecreting or concealing of Starch,' be it enacted by the Authority aforelaid, That in cate any Officer or Officers for the faid Duties upon Starch fhall at any Time mifs any Quantity or Quantities of Starch, of which an Account had been taken by Gauge, whilft the fame was in the four Waters or Slimes refpectively, and before the faid Starch has been put into the Boxes, and fhall not, upon reafonable Demand, receive Satisfaction what is become of the fame, then, and in every fuch Cafe, it fhall and may be lawful for fuch Officer or Officers to charge the Maker of fuch VOL. XI. And, for the further iecuring the Duty on Starch,' be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of July one thousand feven hundred and feventy-nine, when any Maker or Makers of Starch fhall give Notice of his Intention to box, as required by an Act, made in the fourth Year of the Reign of his late Majefty King George the Second (intituled, An Act to prevent Frauds in the Revenue of Excife with refpect to Starch, Coffee, Tea, and Chocolate), every fuch Maker of Starch fhall, in each fuch Notice, exprefs and declare the particular Frame, Tub, or other Utenfil, from which he, the, or they intend to box any Starch; and that when any fuch Maker or Makers of Starch fhall begin to box fuch Starch, they fhall proceed and continue to box the fame until the whole Quantity on Forfeiture of of Starch in each fuch Frame, Tub, or other Utenfil, fhall be perfectly boxed; and if any Maker or Makers of Starch fhall, at any Time after the faid fifth Day of July one thousand feven hundred and feventy-nine, neglect to give Notice of his Intention to box his green Starch, or fhall neglect to infert in every fuch Notice the particular Frame, Tub, or other Utenfil, from which the Starch is intended to be boxed as aforefaid, or fhall not proceed or continue to box the whole Quantity of Starch in any fuch Frame, Tub, or other Utenfil, after fuch Notice as aforefaid, every fuch Maker or Makers of Starch fhall, in every fuch Cafe, for every fuch Offence, forfeit and lofe the the Sum of two hundred Pounds; any Law, Cuftom, or Ufage notwithstanding.

XII. And be it further enacted by the Authority aforefaid, That from and after the faid fifth Day of July one thousand seven hundred and feventy-nine, every Maker of Starch fhall deliver to the Officer who furevery Room, &c. veys his or their Starch-house an Account in Writing, containing as well an exact Description of each and every Room and Place by him, her, or them made ufe of for the making, drying, or keeping of Starch, as alfo of each and every Veffel or Utenfil by him, her, or them, made ufe of for the making of Starch, before he, fhe, or they prefume to ufe the fame; all which faid Rooms and Places, Veffels and Utenfils, fhall be marked and numbered by, or by the Direction of, the respective Surveyors or Supervisors of Excife who furvey the respective Makers of Starch, to whom fuch Rooms and Places, Veffels and Utenfils, refpectively on Forfeiture of belong, at the Expence of such respective Makers; and if any fuch Maker of Starch fhall make use of any Room or Place, Veffel or Utenfil, for the making of Starch, without giving fuch Account as aforefaid, or before the fame fhall have been marked and numbered as aforefaid, or fhall refufe to pay for the marking and numbering the fame, he, fhe, or they shall, for every such Offence respectively, forfeit and pay the Sum of fifty Pounds.

And be it further enacted, That, from and after the fifth Day of July one thousand seven hundred and feventy-nine, whenever any Maker or Makers of Starch fhall have broken the Starch from his, her, or their Boxes, he, fhe, or they fhall deliver, or caufe to be delivered, to the Officer of Excife under whose their Boxes, they Survey fuch Maker of Starch fhall then be, an Account, in Writing, of the true Number of Pieces broken fhall deliver Ac- from fuch Box, diftinguishing, in fuch Writing, the Size of the different Pieces, under the different Dena minations following; that is to fay, Large, Middling, and Small, and how many Pieces of each Denomination are contained in each Breaking from the Boxes: And in cafe any fuch Maker of Starch fhall neglect on Forfeiture of to deliver to fuch Officer fuch Account in Writing, distinguishing therein as aforefaid; or if, after fuch Account given in as aforefaid, any Officer of Excife thall difcover, in any Place whatsoever, entered or not entered, any Increase in the Number of Pieces, or a greater Number of the large or middling Pieces than were particularly specified in fuch Writing; then, and in every fuch Cafe, every fuch Maker and Makers of Starch fhall, for each Offence, forfeit and lofe the Sum of two hundred Pounds.

XIV. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of July one thousand seven hundred and feventy-nine, whenever any Maker or Makers of Starch shall put their Starch when fcraped, or when put into the Papers, into the Stove or Stoves for drying the fame, every fuch Maker of Starch fhall place, or caufe to be placed, the feveral Pieces of Starch fo put into fuch Stove or Stoves, in fuch Manner as that the Officers of Excife may have Access to, and be able to count diftinctly the Number of the feveral Pieces of Starch fo put into fuch Stove or Stoves.

And, that fuch Officers of Excife may, without Inconvenience or Hurt, be able to count the faid "Pieces in fuch Stove or Stoves,' it is hereby enacted, That, from and after the faid fifth Day of July one thousand feven hundred and feventy-nine, every Maker of Starch fhall provide proper Ladders, and fhall affift the faid Officers in taking an Account of the faid feveral Pieces of Starch in fuch Stove or Stoves; and that no Maker or Makers of Starch fhall, by himself, or by any other Perfon, during the Space of two Hours after fuch Officer fhall have entered the Stove of any fuch Starch-maker, for the Purpose of counting the Number of Pieces of Starch then in fuch Stove, ftir or break up the Fire under the said Stove, nor fhall, during the faid space of two Hours, whilft fuch Officer remains in fuch Stove, throw, or caufe to be thrown, upon the Pan of fuch Stove, any Dirt, Meal, or other Ingredient, whereby a Smoke may be raised, or the Officer hindered or obftructed in counting the Pieces of Starch in the faid Stove: And if any fuch Maker or Makers of Starch fhall not fo place the feveral Pieces of Starch in their respective Stove or Stoves as afore faid, as that the Officers of Excife may diftinctly count the fame; or if fuch Maker or Makers of Starch fhall not provide proper Ladders, or shall not affift the faid Officers in taking the Account as aforefaid; or fhall, by ftirring up the Fire, or by any Means whatsoever, hinder or obftruct the Officers of Excife from going into, and continuing in the faid Stove or Stoves, during the Space of two Hours, as aforefaid, or until fuch Officer fhall have taken the Account of all the faid Pieces, if the fame fhall be done within the faid Space of two Hours; then, and in every fuch Cafe, the Perfon offending therein fhall, for every fuch Of fence, forfeit and lose the Sum of two hundred Pounds. XVI. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of Starchmaker to July one thoufand seven hundred and feventy-nine, when any Maker or Makers of Starch fhall be defirous give proper Noto break down any Piece or Pieces of Starch into Scrapings, or otherwife, he, fhe, or they shall give to tice before be the Officer of Excife of the Divifion or Diftrict where his, her, or their Starch-houfe is fituate, twelve Pieces of Starch Hours Notice, if fuch Starch-house shall be fituate within the Limits of the Chief Office of Excife in Lon- into Scrapings; don; or if fuch Starch-houfe fhall be in any other Part of Great Britain, twenty-four Hours Notice of the particular Time and Hour when and at which he, the, or they intend to break down fuch Pieces of Starch into Scrapings, or otherwife; and in cafe fuch Maker or Makers of Starch fhall not begin and proceed to break down fuch Pieces of Starch as aforefaid, at the Time and Hour mentioned in fuch Notice, or within two Hours next after, then every fuch Notice fhall be, and is hereby declared to be, void; and every fuch Maker and Makers of Starch fhall be, and is and are hereby obliged to give a fresh and like Notice in Manner aforefaid: And in cafe any fuch Maker or Makers of Starch fhall neglect to give fuch on Forfeiture of firft Notice, before he, fhe, or they begin to break down fuch Pieces of Starch, or to infert in fuch Notice 1001. the Particulars herein before required, or to give a fresh Notice in Manner aforefaid, every fuch Maker of Starch fhall, in every fuch Cafe, for every fuch Offence, forfeit and lofe the Sum of one hundred Pounds. XVII. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of July one thousand seven hundred and feventy-nine, if any Officer for the Duties on Starch fhall difcover and find, in the Stove or Stoves of any Maker of Starch, any Piece or Pieces of Starch drying in fuch Stove or Stoves, of which no Account had been before taken in the Box or Boxes, by the Officer for the Duties on Starch, then, and in every fuch Cafe, each and every fuch Piece and Pieces of Starch fhall be deemed, and is and are hereby declared to be, Starch of which no Account had been taken by the Officer for the faid Duties upon Starch; and the Maker or Makers of fuch Starch, in whofe Stove fuch Piece or Pieces fhall be fo difcovered and found, fhall forfeit and lofe, for every fuch Offence, the Sum of one hundred Pounds. XVIII. And be it further enacted by the Authority aforefaid, That, from and after the fifth Day of July one thousand seven hundred and feventy-nine, if any Maker of Starch fhall, at any Time whilft his Starch is in Operation, and under Water, mix, or caufe to be mixed, any of the Starch-waters of one Making with those of another Making, every fuch Maker of Starch fhall forfeit and lofe, for every fuch Offence, the Sum of one hundred Pounds, except fuch Mixing be made in the Presence of an Officer for the Duties on Starch. 6 XIX. And whereas fraudulent Starch-makers have, in many Inftances, been rather encouraged in car⚫rying on their Frauds, by reafon of the Smallness of the Penalties already provided in thefe Cafes; now, for the more effectual preventing the like Frauds, be it further enacted by the Authority aforefaid, That if, after the faid fifth Day of July one thousand feven hundred and feventy-nine, any Maker of Starch fhall remove, or caufe to be removed, any Quantity whatsoever of Starch, after the fame fhall be dried, out of his, her, or their Stove or Stoves, or out of any other Place or Places, made ufe of by them for the drying of Starch, before the fame has been weighed, and an Account taken thereof, by the proper Officer appointed for that Purpose, he, she, or they fhall refpectively forfeit and lofe, for every fuch Offence, the Sum of two hundred Pounds; any Law, Cuftom, or Ufage to the contrary notwithstanding. XX. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of July one thousand seven hundred and feventy-nine, if any Maker of Starch fhall fraudulently hide or conceal, or fhall cause or fuffer to be hid or concealed, any Starch, to the Intent to deceive his Majefty of the juft Duties chargeable on the fame, that then, and in every fuch Cafe, the Party fo offending thall forfeit and lofe the Sum of one hundred Pounds; any Law, Cuftom, or Ufage notwithstanding.

Penalties and

XXI. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of July one thoufand feven hundred and feventy-nine, if any Maker of Starch, fhall obftruct or hinder any of the Officers for the Duties upon Starch, in the Execution of any of the Powers and Authorities given to him or them by this or any other Act, for the afcertaining and fecuring the Duties upon Starch, the Perfon or Perfons offending therein fhall, for every fuch Offence, forfeit and lofe the Sum of fifty Pounds. XXII. And be it further enacted by the Authority aforefaid, That all Fines, Penalties, and Forfeitures imposed by this Act, fhall be fued for, recovered, levied, or mitigated, by fuch Ways, Means, and Me- Forfeitures. thods, as any Fine, Penalty, or Forfeiture, is or may be fued for, recovered, or mitigated by any Law or Laws of Excife; or by Action of Debt, Bill, Plaint, or Information, in any of his Majefty's Courts of Record at Westminster, or in the Court of Exchequer in Scotland, respectively; and that one Moiety of every fuch Fine, Penalty, or Forfeiture fhall be to his Majefty, his Heirs and Succeffors, and the other Moiety to him or them who fhall difcover, inform, or fue for the fame.

XXIII. And be it further enacted by the Authority aforefaid, That if any Perfon or Perfons fhall, at any Time or Times, be fued, molefted, or profecuted, for any Thing by him or them done in purfuance or by Colour of this Act, or of any Matter or Thing in this Act contained, fuch Perfon and Perfons fhall and may plead the General Iflue, and give this Act and the Special Matter in Evidence in his or their De- General Iffue. fence; and if afterwards a Verdict fhall pafs for the Defendant or Defendants, or the Plaintiff or Plaintiffs fhall become nonfuited, or difcontinue his, her, or their Action or Profecution, or Judgement fhall be given against him, her, or them, upon Demurrer or otherwife, then fuch Defendant or Defendants fhall have Treble Cofts awarded to him or them against fuch Plaintiff or Plaintiffs.
