THIS HIS Work contains, the Authors believe, a complete Collection of all the general statutory provisions relating to the acquisition of land by Corporations, Councils, and Companies, and to the compensation to be paid to Owners for the injury to their lands by the construction of works carried out by such public bodies. It also contains full notes of all the decided cases which bear upon the Law of Compensation. The Lands Clauses Consolidation Act, 1845, is, undoubtedly, the most important of these Statutes. It was passed with the view of consolidating in one General Act the provisions which had been usually inserted in Local and Personal Acts, relating to the acquisition of land, and to the compensation to be made to Owners in connection with such purchases. It may, therefore, be regarded as the foundation of the modern Law of Compensation. It has, accordingly, been placed first of all the Statutes included in this Work, and the various sections have been fully annotated. The Authors have endeavoured to indicate clearly the principles which underlie the cases in which Compensation has been claimed, and the Procedure which has been stereotyped by Statutes or by a long course of decided cases. A number of Precedents will be found in the Appendix. |
