arife every where from War, and how many Advantages a certain and ftable Peace always brings along with it.

Therefore we being fully appriz'd of the great Benefits and Advantages that have accru'd to the Inhabitants and Subjects of the Lands and Countries of the faid Lord the Archduke of Auftria, as alfo of the Kingdom of England, from the Peace and Amity formerly enter'd into and contracted between the forefaid Princes, have agreed, contracted and concluded, and do by these Prefents agree, contract and conclude all and fingular the following Articles of Peace, Amity, Intercourse of Merchandizes, and mutual Freedom of Merchants, for the faid moft Illuftrious Prince our Lord, the forefaid Archduke of Auftria, and his Heirs and Succeffors, for them, and in their name, by the Authority granted to us by the faid Archduke our Prince, by his Letters Patent (the Tenor of which will follow after) with the Reverend Father in Chrift Richard, Bishop of Durham, Keeper of the Privy Seal to the moft Illuftrious King of England; John Welles, Viscount of Welles; John Kendall, Prior of St. John of Jerufalem's Houfe in England; William Warham, Doctor of Laws, Master and Keeper of the Rolls of Chancery to the faid Lord the King; Christopher Worfwike, Archdeacon of Richmond; and John Lesley Knight, Ambaffadors, Negotiators and Commiffioners for the underwritten, deputed by the Letters Patent of the forefaid moft Illuftrious Lord the King of England; the Tenor whereof will likewife follow af

I. It is agreed, accorded and concluded, that from this Day there be a good, fincere, true, entire, perfect and firm Friendship, League, Confederacy, Peace and Union by Sea, Land and fresh Water, to endure perpetually in all future Times, between the faid Lords the King and Archduke, and their Heirs and Succeffors, all their Kingdoms, Countries, Dominions, Lands, Vaffals and Subjects whatfoever, prefent and to come, as well Ecclefiafticks as Seculars, of whatever Degree or Condition they be, even tho they be rais'd to an Archiepifcopal, Ducal, or leffer Dignity, State or Degree, fo that the forefaid Vaffals and Subjects on both fides fhall be ob lig'd mutually to favour one another every where, and do one another reciprocal good Offices, and treat one another

another with fincere and honeft Affection; and they may fafely, freely and fecurely go, as well by Land as by Sea, and fresh Waters, and enter into the faid Kingdoms, Countries, Dominions and Lands, Cities, Towns, Places fortify'd and not fortify'd, and all their Ports and Districts whatsoever on both fides, and remain in the fame, and go about their Affairs, and there buy and fell Victuals, and all other Neceffaries whatsoever without any Contradiction; and alfo go, depart and return from the faid Kingdoms, Countries, Lands, Cities, Towns, Villages, Ports and Diftricts, or any of them, to their own Countries, or any other foreign Parts whatfoever, with their hir'd or borrow'd Ships, Waggons, Armour, Merchant-Goods, Packs, Goods, and other Things whatsoever, even as they could do all these things in their own Countries, and as the native Subjects of thofe Places and Countries could do: So that they fhall not want any Paffport, nor general or fpecial Licence, nor be oblig'd to ask any Paffport or Licence in any of the forefaid Places.

II. It is agreed, &c. That neither of the forefaid Princes, nor none of their Heirs and Succeffors, fhall act, do, treat, or attempt any thing against the other, or his Heirs and Succeffors, in any Place whatsoever, whether on Land or Sea, in Ports, or fresh Water, upon any occafion; nor give any Affiftance, Counfel, Favour or Affent to any thing's being done, acted, treated or attempted by either of them, or any others whatfoever, to the Hurt, Prejudice or Damage of the other, or his Heirs and Succeffors; but fhall exprefly and effectually contradict, oppose, refist, and really hinder all who fhall act, treat or attempt any thing against the other, within his forefaid Kingdoms, Countries, Dominions or Lands, as is fpecify'd above.

III. It is agreed, &c. That neither, yea none of the forefaid Parties, fhall give Affiftance, Counfel or Favour to the notorious and known Enemies of the other Party, endeavouring to infeft or invade him either by Land, Sea, or fresh Water; but fhall bona fide aid and affift one another, with reciprocal military Succours of arm'd Men, at the Expence of the Party demanding Help: In the Performance of which Succours, as to the number of arm'd Men, the Power and Ability of the Party whose Vol. II.

Affiftance

Affiftance fhall be ask'd and demanded, muft be confider'd; fo that he fhall not be oblig'd to do more than he can then conveniently do, confidering the Circumftance of Time and Place, and the State of his Affairs.

IV. It is agreed, &c. That neither of the forefaid Parties fhall receive a Rebel or Rebels, Fugitive or Fugitives of the other Prince into his Kingdoms, Countries, Lands or Dominions, Ports or Diftricts, or any of them; nor give or afford Afliftance, Counfel, Favour, Reception, arm'd Men, Ships, Mony or Victuals to them, or any of them, in any Place whatfoever, even without their Kingdoms, Countries, Dominions, Lands, Ports or Diftricts; nor permit any other or others whatsoever to receive them into their Kingdoms, Countries, Lands, Dominions, Ports or Diftricts; nor allow Affiftance, Counfel, Favour, Reception, arm'd Men, Ships, Mony or Victuals to be given, yielded, afforded or granted to them, or any of them, in any of the forefaid Places, but fhall exprefly and effectually forbid, oppofe and really hinder any fuch thing.

V. It is agreed, &c. That if either of the forefaid Parties fhall, by his Letters, fignify and declare to the other, that any one or more of his Rebels, or Fugitives, is or are receiv'd in his Kingdoms, Countries, Lands, Dominions, Forts or Diftricts, or that they lurk and hold themselves there, then that Party, who receives fuch Letters,or to whom in this manner it fhall be fignify'd and declar'd, fhall order and command, or caufe to be order'd and commanded, fuch Rebel or Rebels, Fugitive or Fugitives, to depart and go out of his Kingdoms, Countries, Lands and Dominions, or any of them, within a Month, reckoning from the Day of the forefaid Decla ration and if he or they do not depart and go away within fifteen Days after the Day of fuch Order or Command, he fhall be oblig'd to profcribe him or them immediately upon pain of Death, and fhall effectually punifh, or caufe to be punish'd, the Contemner or Contemners of fuch Profcription or Banishment.

VI. The forefaid Ambaffadors, Commiflioners, Negotiators and Meffengers of the faid Lord the Archduke, and for the faid Archduke, and in his name, and that of his Heirs and Succeffors, have openly and exprefly promis'd to the Ambaffadors, Comimiflioners, Negotiators

and Deputies of the faid moft Illuftrious King of Eng-` Land, and ftipulating for the faid Lord the King, in his name, and that of his Heirs and Succeffors, That no Rebel to the forefaid moft Illuftrious King of England, or his Heirs or Succeffors, fhall be receiv'd into any Caffles, Towns, Villages, Ports, Diftricts, or any other Places, which the most Illuftrious Lady Margaret, Relict of the late moft Illuftrious Lord Duke Charles, or any other Perfon, of any State or Dignity whatsoever, holds or poffeffes, or may afterwards hold and poffefs, by any Right, Dowry, or any other Title whatfoever, within the Countries, Dominions and Lands of the faid Lord the Archduke, or any of them; nor fhall fuch Rebel be permitted or fuffer'd to be receiv'd by her or any other Perfon; nor fhall he permit or fuffer Counfel, Affiftance or Favour to be given or afforded by the faid Lady Margaret, or any other Perfon whatsoever, to any fuch Rebel, in the forefaid Places, or any other whatfoever, either in Ships, arm'd Men, Mony, Victuals, or any other way whatsoever; but fhall forbid and hinder her, or any other Perfon, openly and exprefly from doing othis. And if, contrary to this Convention, the faid Lady Margaret, or any other Perfon whatsoever, fubject to the forefaid Lord the Archduke, fhall attempt, or caufe any thing to be attempted, then the forefaid Lord the Archduke fhall really, effectually, and for ever deprive (after it has appear'd that fhe or they have attempted any thing againit fuch Convention) and caufe to be depriv'd as well the faid Margaret, as others thus attempting, of all that the or they pretend to have, hold or poffefs by Right of Dowry, or any other Title, in the Caftles, Cities, Towns, Villages, or any other Places aforefaid.

And the Commiffioners, Negotiators and Deputies of the most Illuftrious King of England, ftipulating for the faid Lord the King, and in his name, and that of his Heirs and Succeffors, have openly and exprefly promis'd to the Ambaffadors, Commiffioners, &c. of the most Illuftrious Lord the Archduke, ftipulating for the fame Lord the Archduke, and in his name, and that of his Heirs and Succeffors, That no Rebel to the forefaid moft Illuftrious Lord the Archduke, or to his Heirs and Succeffors, fhall henceforth be receiv'd into any Castles,

Towns,

Towns, Villages, Ports, Diftricts, or any other Places, which the Subjects of the aforefaid Lord the King, of what Dignity or Condition foever they be, have, hold, or poffefs by any Title whatfoever, within his Kingdoms, Countries or Dominions, or may afterwards have, hold or poffefs in the fame Kingdoms, Countries and Dominions, nor be permitted or fuffer'd to be receiv'd by them or any of them; nor fhall he permit or fuffer Counsel, Afliftance or Favour to be given or afforded otherwife by his faid Subjects, or any of them, to fuch Rebel, either in Ships, arm'd Men, Mony, Victuals, or any other way whatfoever; but fhall hinder and forbid them, and every one of them, openly and exprefly, to do any fuch thing. And if, contrary to this Convention, the Subjects of the moft Illuftrious Lord the King fhall attempt, or caufe any thing to be attempted, then the forefaid Lord the King, after it has appear'd that his faid Subject or Subjects have attempted any thing contrary to this Convention, fhall really, effectually and perpetually deprive, and caufe to be depriv'd, all and fingular thus attempting, of all and every thing they pretend to have, hold or poffefs by any Title whatsoever, in the Caftles, Cities, Towns, Villages, and all other Places aforefaid.

VII. It is agreed, &c. That the faid moft Illuftrious Lord the King of England, his Heirs and Succeffors, fhall referve and comprehend the forefaid Lord the Archduke, his Heirs and Succeffors, if they are willing to be referv'd and comprehended, in whatfoever Confederacies and Treaties of Amity are henceforth to be contracted by them with any Prince, Community, Society or Perfon whatsoever.

And in like manner the faid moft ferene Lord the Archduke, his Heirs and Succeffors, fhall referve and comprehend the forefaid moft Illuftrious Lord the King of England, his Heirs and Succeffors, if they fhall be willing to be referv'd and comprehended, in all their Confederacies and Treaties of Friendship to be henceforth contracted with any Prince, Community, Society or Perfon whatsoever.

VIII. That in the prefent Treaty of Peace and Amity may be comprehended the Allies, Friends and Confede rates of both Parties, viz. fuch as fhall be nam'd by the
