SEC. 5. Every medical practitioner summoned as 2 provided in this act who without reasonable excuse 3 shall neglect to attend such inquest at the time and 4 place appointed, shall forfeit the sum of dollars

5 to be recovered in an action of debt in the name of 6 the coroner or the county and for the use of the 7 county.

AN ACT to tax Railroads.

Be it enacted by the Senate and House of Representatives in Legislature, assembled, as follows:

SEC. 1. Railroad stock, in railroads in this state, 2 shall not be assessed to pay state, county or town 3 taxes.

SEC. 2. Railroads so far completed that cars can 2 run thercon, shall be taxed in the towns where the 3 same are located as real estate, and the same may be 4 valued at a sum not exceeding the rate of ten thou5 sand dollars per mile, and such town may annually

6 assess a tax thereon, not exceeding five mills to the

7 dollar.

SEC. S. In addition to the modes now prescribed by 2 law for collecting such tax, the treasurer of the town 3 assessing the same, may demand in writing the pay4 ment thereof, of the president, treasurer, or any 5 director of such road, and if the same is not paid 6 within sixty days from such demand, such town may 7 sue the railroad company therefor.

SEC. 4. All acts and parts of acts, inconsistent with 2 the provisions of this act, are hereby repealed.
