BETWEEN

GREAT BRITAIN AND PRUSSIA,

FOR THE ESTABLISHMENT OF

INTERNATIONAL COPYRIGHT.

Signed at Berlin, August 24, 1846.

SA Majesté la Reine du Royaume Uni de la Grande Bretagne et d'Irlande, et Sa Majesté le Roi de Prusse, ayant conclu à Berlin, le 13 Mai, 1846, une Convention pour la protection réciproque du Droit d'Auteur contre la contrefaçon; et l'Article VIII de cette Convention ayant stipulé que ceux des Etats Germaniques qui composent avec la Prusse, l'Association de Douane Allemande, ou qui par la suite en deviendront parties, auraient le droit d'accéder à la dite Convention; Leurs Majestés Britannique et Prussienne ont fait adresser à Sa Majesté le Roi de Saxe l'invitation d'y accéder;

Et Sa Majesté le Roi de Saxe désirant profiter de l'occasion qui lui est offerte d'accéder à la susdite Convention;

Les Plénipotentiaires respectifs, c'est à dire,

De la part de Sa Majesté la Reine du Royaume Uni de la Grande Bretagne et d'Irlande, le Très Honorable Jean, Comte de Westmorland, Lord Burghersh, Pair du Royaume Uni, Membre du Conseil Privé de Sa Majesté Britannique, Lieutenant-Général, Commandeur de l'Ordre Militaire de Bath d'Angleterre, Grand-Croix de l'Ordre des Guelphes de Hanovre, Envoyé Extraordinaire et Ministre Plénipotentiaire de Sa Majesté Britannique près Sa Majesté le Roi de Prusse;

De la part de Sa Majesté le Roi de Prusse, le Sieur Erasme Robert, Baron de Patow, son Conseiller Intime Actuel de Légation, et Directeur au Ministère des Affaires Etrangères, Chevalier des Ordres de l'Aigle Rouge de la troisième classe avec le noeud de Prusse, et de la Maison d'Ernest de la Saxe Ducale;

Et de la part de Sa Majesté le Roi de Saxe, le Sieur Jean de Minckwitz, Son Ministre d'Etat, Lieutenant-Général et Aide-de-camp Général, Envoyé Extraordinaire et Ministre Plénipotentiaire près Leurs Majestés le Roi de Prusse et le Roi de Hanovre, Chevalier de l'Ordre Militaire de St. Henri, et Grand-Croix des Ordres du Mérite Civil de Saxe, de l'Aigle Rouge de Prusse, de Léopold d'Autriche, du Mérite Civil de Bavière, et du Faucon Blanc de la Saxe Grand-Ducale, décoré de la Médaille du Mérite Militaire de la Saxe Grand-Ducale, Grand-Croix de l'Ordre de la Maison d'Ernest de la Saxe Ducale, Chevalier de l'Ordre de Ste. Anne de la première classe de Russie, Grand Officier de la Légion d'Honneur de France, Grand-Croix de l'Ordre Militaire de Sa. Bento d'Aviz de Portugal:

Se sont réunis afin de constater en due forme l'Accession de Sa Majesté le Roi de Saxe, ainsi que l'Acceptation par Sa Majesté Britannique et par Sa Majesté Prussienne de la dite Accession de Sa Majesté

Saxonne.

Le Plénipotentiaire de Sa Majesté le Roi de Saxe en conséquence déclare, en vertu de ses pleins pouvoirs, que Sa dite Majesté accède tant à la Convention du 13 Mai, 1846, renfermant dix Articles, et dont une copie imprimée se trouve annexée au présent Acte, qu'aux dispositions particulières contenues dans les §§ 1-4 du Protocole séparé, également ci-joint en copie, et signé le même jour; promettant que les stipulations de la dite Convention, qui deviendra obligatoire pour le Royaume de Saxe à partir du ler Septembre, 1846, ainsi que celles du Protocole séparé, seront exécutées par Sa Majesté le Roi de Saxe en tous points, en tant qu'elles sont applicables aux rapports dans lesquels le Gouvernement Saxon se trouve vis-à-vis du Gouvernement Britannique et de ses sujets, avec la réserve expresse, cependant, que l'Article II de la Convention soit modifié, pour la Saxe, de la manière suivante, savoir :

Personne dans aucun des deux pays, ni dans le Royaume Uni de la Grande Bretagne et d'Irlande, ni dans le Royaume de Saxe, n'aura droit à la protection stipulée par l'Article I de la Convention, à moins que l'ouvrage à protéger contre la contrefaçon, n'ait été enregistré par l'auteur ou par ses ayants-droit, ainsi qu'il suit:

1°. Si l'ouvrage a paru d'abord dans les Etats de Sa Majesté le Roi de Saxe, il devra être enregistré dans le registre tenu par la Société des Libraires (register-book of the Company of Stationers) à Londres.

2o. Si l'ouvrage a paru d'abord dans les Etats de Sa Majesté Britannique, il devra être enregistré dans le registre tenu par la Direction Royale du Cercle (die Bücherrolle) à Leipzig.

Personne non plus n'aura droit à la susdite protection, à moins que les lois et réglemens des Etats respectifs n'aient été dûment observés par rapport à l'ouvrage à protéger; ni, dans le cas qu'il y aurait plusieurs exemplaires de l'ouvrage, avant qu'un exemplaire de la meilleure édition, ou de la meilleure forme, n'ait été délivré gratis à l'autorité établie à cet égard par les lois des pays respectifs.

Une copie légalisée de l'enregistrement dans le susdit registre de la Société des Libraires à Londres sera regardée dans les Etats Britanniques comme preuve du droit exclusif de publication, à moins qu'un meilleur droit n'ait été prouvé par un autre partie par-devant une cour de justice; et le certificat délivré d'après les lois de Saxe, de l'enregistrement d'un ouvrage dans le susdit registre de Leipzig, aura la même valeur dans les Etats de Sa Majesté Saxonne.

Les Plénipotentiaires de Sa Majesté la Reine du Royaume Uni de la Grande Bretagne et d'Irlande, et de Sa Majesté le Roi de Prusse, en vertu de leurs pleins pouvoirs, acceptent l'Accession de Sa Majesté le Roi de Saxe, promettant que les stipulations de la Convention du 13 Mai, 1846, ainsi que les dispositions particulières, tant du Protocole de la même date, que celles qui constituent la réserve ci-dessus mentionnée, seront exécutées par leurs Souverains respectifs en tous points vis-à-vis du Gouvernement Saxon et de ses sujets, comme entre les Gouvernemens Britannique et Prussien et leurs sujets.

En foi de quoi les Plénipotentiaires respectifs ont signé le présent Acte, et y ont apposé le cachet de leurs armes.

Fait à Berlin, le vingt-quatre Août, de l'an de grâce mil huit cent quarante-six.

HER Majesty the Queen of the United Kingdom of Great Britain and Ireland, and His Majesty the King of Prussia, having concluded at Berlin, on the 13th of May, 1846, a Convention for the reciprocal protection of Copyright against piracy; and it having been stipulated in Article VIII of that Convention, that those German States which, together with Prussia, compose the German Union of Customs, or which may hereafter join that Union, should have the right of acceding to the said Convention; Their Britannick and Prussian Majesties have addressed to His Majesty the King of Saxony the invitation to accede thereto;

And His Majesty the King of Saxony being desirous of availing himself of the opportunity thus afforded to him of acceding to the said Convention;

The respective Plenipotentiaries, that is to say,

On the part of Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, the Right Honourable John, Earl of Westmorland, Lord Burghersh, a Peer of the United Kingdom, a Member of Her Britannick Majesty's Privy Council, a Lieutenant-General, Commander of the Military Order of the Bath of England, Grand Cross of the Order of the Guelphs of Hanover, Her Britannick Majesty's Envoy Extraordinary and Minister Plenipotentiary to His Majesty the King of Prussia;

On the part of His Majesty the King of Prussia, the Sieur Erasmus Robert, Baron de Patow, His Privy Councillor of Legation, and Director of the Department for Foreign Affairs, Knight of the Orders of the Red Eagle of the third class with the clasp of Prussia, and of the House of Ernest of Ducal Saxony;

And on the part of His Majesty the King of Saxony, the Sieur John de Minckwitz, His Minister of State, a Lieutenant-General and Aide-decamp General, Envoy Extraordinary and Minister Plenipotentiary to Their Majesties the King of Prussia and the King of Hanover, Knight of the Military Order of St. Henry, and Grand Cross of the Orders of Civil Merit of Saxony, of the Red Eagle of Prussia, of Leopold of Austria, of Civil Merit of Bavaria, and of the White Falcon of Grand-Ducal Saxony; decorated with the Medal of Military Merit of Grand-Ducal Saxony, Grand Cross of the Order of the House of Ernest of Ducal Saxony, Knight of the Order of St. Anne of the first class of Russia, Grand Officer of the Legion of Honour of France, Grand Cross of the Military Order of St. Benedict d'Aviz of Portugal:

Met together for the purpose of recording in due form the Accession of His Majesty the King of Saxony, as well as the Acceptance, by Her Britannick Majesty and His Prussian Majesty, of the said Accession on the part of His Saxon Majesty.

The Plenipotentiary of His Majesty the King of Saxony in consequence declares, in virtue of his full powers, that His said Majesty accedes both to the Convention of the 13th May, 1846, containing ten Articles, and of which a printed copy is annexed to the present Act, and to the special provisions contained in §§ 1-4 of the separate Protocol signed on the same day, of which a copy is also hereunto annexed; promising that the stipulations of the said Convention, which shall come into operation in the Kingdom of Saxony, from and after the 1st of September, 1846, as well as those of the separate Protocol, shall be carried into execution by His Majesty the King of Saxony in all points, so far as they may be applicable to the relations which subsist between the Saxon Government and the British Government and its subjects; subject, however, to the express reservation, that Article II of the Convention shall be modified, with regard to Saxony, in the following manner, that is to say:

No person in either of the two countries, either in the United Kingdom of Great Britain and Ireland, or in the Kingdom of Saxony, shall be entitled to the protection stipulated by Article I of the Convention, unless the work to be protected against piracy shall have been registered by the author or his agents, in the following manner:—

1. If the work has first appeared in the Dominions of His Majesty the King of Saxony, it must have been registered in the register-book of the Company of Stationers in London.

2. If the work has first appeared in the Dominions of Her Britannick Majesty, it must have been registered in the register-book kept by the Royal Direction of the Circle (die Bücherrolle) at Leipzig.

Nor shall any person be entitled to the protection aforesaid, unless the laws and regulations of the respective States shall have been duly observed in regard to the work to be protected; nor, in cases where there are several copies of the work, unless one copy of the best edition, or in the best state, shall have been delivered gratuitously to the authorities appointed for that purpose by the laws of the respective countries.

A certified copy of the registration in the aforesaid register-book of the Company of Stationers in London, shall be valid in the British Dominions, as proof of the exclusive right of publication, until a better right shall be established by any other party before a court of justice; and the certificate given under the laws of Saxony, of the registration of any work in the aforesaid register-book at Leipzig, shall be equally valid in the Dominions of His Saxon Majesty.

The Plenipotentiaries of Her Majesty the Queen of the United King dom of Great Britain and Ireland and of His Majesty the King of Prussia, in virtue of their full powers, accept the Accession of His Majesty the King of Saxony; promising that the stipulations of the Convention of the 13th of May, 1846, as well as the special provisions which are contained in the Protocol of the same date, and those which form the reservation above mentioned, shall be carried into execution by their respective Sovereigns in all points, with regard to the Saxon Government and its subjects, in the same manner as between the British and Prussian Governments and their subjects.

In witness whereof the respective Plenipotentiaries have signed the present Act, and have affixed thereto the seal of their arms.

Done at Berlin, the twenty-fourth day of August, in the year of our Lord one thousand eight hundred and forty-six.
