The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirinative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

The Assembly bill. (No. 2297) entitled "An act to amend chapter 181 of the Laws of 1899, entitled 'An act to amend section 674a of the Penal Code in relation to unauthorized wearing the badge or the button of the Grand Army of the Republic"" (Rec. No. 717), was read the second time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

The Assembly bill (No. 2399) entitled "An act to amend the Code of Civil Procedure, relative to the designation of a person upon whom to serve process, during the absence of a resident from the State" (Rec. No. 726), was read the third time.

Clemens, for cancellation of tax sales of lot No. 98 South Bay tract in the town of Dresden, Washington county, for unpaid taxes" (Rec. No. 678), was read the third time.

Ordered, That the Clerk return said bill to the Assembly, with a message that the Senate have concurred in the passage of the same. Mr. Johnson offered the following:

Resolved, That the committee of the whole be discharged from the further consideration of Assembly bill No. 1789, entitled "An act to amend chapter 223 of the Laws of 1890, entitled 'An act to authorize towns to raise money to defray the expenses of the proper observance of Memorial or Decoration Day,' relating to the raising of money by towns for the proper observance of Memorial or Decoration Day" (Rec. No. 442), and that the same be ordered to a third reading.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative. Mr. Brown offered the following:

Resolved, That the committee of the whole be discharged from the further consideration of As embly bill No. 2102, entitled "An act to amend the Fisheries, Game and Forest Law, in relation to pollution of waters used by State hatcheries" (Rec. No. 616), and that the same be ordered to a third reading.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Ford moved that the motion to suspend the rules, 1, 4, 9, 12, 15, 19, 31 and 45, for the purpose of reading, passing and transmitting to the Assembly out of its order the Assembly bill (No. 2116, Senate reprint No. 1484) entitled "An act to amend chapter 376 of the laws of 1896, entitled 'An act relating to domestic commerce law, constituting chapter 34 of the general laws,' in relation to auctions and auctioneers" (Rec. No 588), be made a special order for to-morrow immediately after the receipt of messages from the Assembly.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. Higgins, from the committee on finance, to which was referred the nomination of Sheldon E. Broadhead, as manager of the Buffalo State Hospital, reported the same to the Senate for confirmation.

Mr. Higgins, from the committee on finance, to which was referred the nominations of Mathias I. Arnot, Ansley Wilcox, Henry G. Danforth and Thomas Sturgis, as managers of the New State Reformatory at Elmira, reported the same to the Senate for confirmation.

Mr. Higgins, from the committee on finance, to which was referred the nominations of Courtland Crossman, W. Austin Wheelock and William S. Stratton, as trustees of the New York State School for the Blind, reported the same to the Senate for confirmation.

Mr. Higgins, from the committee on finance, to which was referred the nominations of Herbert E. Mills and Christian A. Herber, as managers of the House of Refuge for Women at Hudson, reported the same to the Senate for confirmation.

Mr. Higgins, from the committee on finance, to which was referred the nomination of Sarah J. Fee, as manager of the Western House of Refuge, reported the same to the Senate for coufirmation.

The Senate went into open executive session, and after some time spent therein legislative business was resumed, and the President announced that said nominations had been confirmed.
