fhall appear to be in their respective Hands to fuch Trustees, or any five or more of them, or to fuch Perfon or Perfons, and to fuch Ufes and Purposes as they the faid refpective Trustees, or any five or more of them, shall direct and appoint; and that all and every the faid Officers and Perfons fo accounting as aforefaid fhall, if required as aforefaid, upon their feveral Oaths (which faid Oaths the faid Trustees, or any two or more of them are hereby impow ered to adminifter) verify his and their faid Accounts, and the particular Items and Articles thereof: And Penalty on if any fuch Officer or other Perfon, refufing to being required fo to do, fhall refufe or neglect to render and give up fuch Account of Accounts as aforefaid, or to produce or deliver up to fuch Trustees, or any two or more of them, the Receipts and Vouchers relating to the fame, or to verify the Items or Articles thereof upon his Oath as aforefaid, then and in any or either of the faid Cafes it fhall be lawful, upon the Complaint

of any two or more of the faid Trustees, for any one Juftice of the Peace for the County, Liberty, or Place wherein fuch Officer or other Perfon fhall refide or be found, to make Enquiry concerning fuch Default, as well by Confeffion of the Party as by the Teftimony of one or more credible Witnefs or Witneffes upon Oath; and upon Conviction fuch Juftice fhall commit every fuch Officer or other Perfon fo convicted to the common Gaol of fuch County, Liberty, or Place,there to remain without Bailor Mainprize until fuch Account fhall be rendered, given, and verified, and the Receipts and Vouchers relating thereto be delivered up as aforefaid; and if any fuch Officer or other Perfon fhall refufe or neg lect to pay any Sum or Sums of Money which fhall appear to remain in his Hands, it shall be lawful, upon the Complaint of any two or more of the faid Trustees, for any one Justice of the Peace for the County, Liberty, or Place

wherein fuch Officer or other Perfon fhall refide or be found, to make Inquiry concerning fuch Neglect or Refufal in the manner aforefaid, and by a Warrant under his Hand and Seal caufe fuch Sums of Money as fhall appear to him to be due and unpaid to be levied by Distrefs and Sale of the Goods and Chattels of every fuch Officer or other Perfon, rendering the Overplus (if any) after the Money remaining due and the Charges of making fuch Diftress and Sale fhall be deducted; and if fufficient Distress, cannot be found, then fuch Justice shall commit every fuch Officer or other Perfon to the common Gaol of fuch County, Liberty, or Place, there to remain without Bail or Mainprize until fuch Offender shall have made fuch Payment to the faid refpective Trustees, or any five or more of them, or according to their Appointment as aforefaid, or compounded for the fame, and paid: fuch Compofition-money to the faid Trustees, or any five or more of them,

them, or to their Treasurer or Treasurers; which Compofition the faid Truftees, or any five or more of them, are hereby impowered to make.

Provided always, That no fuch Officer or other Perfon fhall remain in fuch Gaol for a longer Space of Time than twelve Calendar Months after having rendered a true and perfect Account as before required.

And be it further enacted, That to deliver up if any Clerk, Collector, or other Papers to the Perfon employed by the faid refpec

of the said Trustees, make Inquiry of and concerning fuch Default in a fummary Way, and upon Proof thereof made before fuch Juftice or Juftices, by the Oath of any one or more credible Witnefs or Witneffes, or by Confeffion of the Party complained of, fhall commit fuch Clerk, Collector, or other Perfon fo making Default, by Warrant under his or their Hand and Seal or Hands and Seals, to the common Gaol of fuch County, Liberty, or Place, there to remain without Bail or Mainprize until he fhall deliver or caufe to be delivered to the faid respective Trustees, or any five or more of them, or to their Order, all and every fuch Books, Papers, and Writings, or until he fhall give fuch Satisfaction to the faid Trustees, or any five or more of them, as they fhall think reafonable, concerning the faid Books, Papers, and Writings.
