2.a Los Cónsules, en todo lo que sea esclusivamente relativo al ejercicio de sus funciones, serán independientes del Estado en cuyo territorio residan.

3. Los Cónsules, sus Cancilleres o Secretarios, estarán esentos de todo servicio público, de contribuciones personales i de las estraordinarias que se impongan en el pais de su residencia. Esta esencion no comprende a los Cónsules i sus Cancilleres o Secretarios que sean nacionales del pais en que residan.

4. Siempre que sea necesaria la asistencia de los Cónsules en los tribunales o juzgados, se les citará por escrito.

5. A fin de que las habitaciones de los Cónsules sean fácil i jeneralmente conocidas, para la conveniencia de los que tengan que ocurrir a ellas, les será permitido enarbolar en ellas la bandera i poner sobre sus puertas el escudo de armas de la Nacion a que sirve el Cónsul, con una inscripcion que es prese el empleo que ejerce; pero estas insignias no suponen derecho de asilo ni sustraen la casa o sus habitantes a las pesquisas que los majistrados del pais podrán hacer en ellas, lo mismo que en las casas de los demas habitantes en los casos determinados por las leyes.

Art. 6. Las personas i casas de los Cónsules estarán sometidas a las leyes i autoridades del pais, en todo aquello en que no se les haya concedido una espresa esencion por esta convencion, i de la misma manera que lo estén los demas habitantes.

Art. 7. Los Cónsules no darán pasaporte a ningun individuo de su Nacion o que se dirija a ella, que tenga que responder ante alguna de las autoridades, juzgados o tribunales del pais, por delito o falta que hubiere cometido, o por demanda que hubiere sido legalmente admitida, siempre que se haya dado al Cónsul el aviso correspondiente; i cuidarán de que los buques de su Nacion no quebranten la neutralidad cuando la Nacion en que el Cónsul resida se halle en guerra con otra.

Art. 8. La presente convencion será ratificada por los Gobiernos de las Repúblicas contratantes, i los instrumentos de ratificacion serán canjeados en Bogotá en el término de dieziocho meses contados desde esta fecha, o ántes si fuere posible.

Art. 9. La presente convencion obligará a las partes contratantes mientras que permanezca vijente el tratado de paz, amistad, navegacion i comercio entre la Nueva Granada i los Estados Unidos, canjeado en Washington el diez de junio de mil ochocientos cuarenta i ocho.

2. Consuls, in all that exclusively concerns the exercise of their functions, shall be independent of the State in whose territory they reside.

In order that the dwellings of Consuls may be easily and generally known, for the convenience of those who may have to resort to them, they shall be allowed to hoist on them the flag and to place over their doors the coat of arms of the nation in whose service the Consul may be, with an inscription expressing the functions discharged by him; but those insignia shall not be considered as importing any right of asylum, nor as placing the house or its inhabitants beyond the authority of the magistrates who may think proper to search them, and who shall have that right with regard to them in the same manner as with regard to the houses of the other inhabitants, in the cases prescribed by the laws.

Art. 6. The persons and dwellings of Consuls shall be subject to the laws and authorities of the country in all cases in which they have not received a special exemption by this Convention, and in the same manner as the other inhabitants.

Art. 7. Consuls shall not give passports to any individual of their nation or going to their nation, who may be held to answer before any authority, Court or judge of the country for delinquencies committed by them, or for a demand which may have been legally acknowledged, provided that in each case proper notice thereof shall have been given to the Consul, and they shall see that the vessels of their nation do not infringe the rules of neutrality when the nation in which the Consul resides, is at war with another nation.

Art. 8. The present convention shall be ratified by the Governments of the two contracting Republics, and the ratifications shall be exchanged at Bogota, within the term of eighteen months counted from this date or sooner if possible.

Art. 9. The present convention shall be binding upon the contracting parties so long as the treaty of peace, friendship, navigation and commerce between the United States and New Granada, the ratifications of which were exchanged at Washington on the tenth of june one thousand eight hundred and forty eight, shall remain in force.

Habiéndonos reunido los infrascritos, Victoriano de Diego Parédes, Secretario de Relaciones Esteriores de la Nueva Granada, i Yelverton P. King, Encargado de Negocios de los Estados Unidos en la Nueva Granada, con el objeto de canjear las ratificaciones de la convencion consular entre esta República i los Estados Unidos, firmada en la ciudad de Washington el dia cuatro se mayo de mil ochocientos cincuenta, hacemos constar:

Que despues de haber confrontado las dichas ratificaciones una con otra i ámbas con el orijinal de la mencionada Convencion, verificamos el canje con las debidas solemnidades.

En fe de lo cual, hemos firmado esta dilijencia por duplicado, en Bogotá, el dia 30 de octubre, en el año del Señor mil ochocientos cincuenta i uno, i le hemos puesto nuestros respectivos sellos.

We, the undersigned, Yelverton P. King, Chargé d'Affaires of the United States to New Granada, and Victoriano de Diego Parédes, Secretary for Foreign Relations of New Granada, having met for the purpose of exchanging the ratifications of the consular convention between the United States and that Republic signed in the city of Washington on the fourth day of may one thousand eight hundred and fifty, certify:

That after comparing the said ratifications each with the other and both with the original of the said convention, the exchange aforesaid was made by us with all due solemnities.

In witness whereof, we have signed this certificate in duplicate at Bogota, the thirtieth day of october in the year of Our Lord, one thousand eight hundred and fifty one, and have hereunto affixed our respective seals.

TRATADO DE AMISTAD, COMERCIO I NAVEGACION

ENTRE LA REPÚBLICA DE LA NUEVA GRANADA I LAS CIUDADES LIBRES ANSEÁTICAS DE LUBECK, BREMEN I HAMBURGO.

Habiéndose establecido desde algun tiempo relaciones de comercio entre la República de la Nueva Granada i las Ciudades libres Anseáticas, se ha creido útil que dichas relaciones sean confirmadas i protejidas por medio de un tratado de amistad, comercio i navegacion.

Con este objeto han nombrado sus respectivos Plenipotenciarios, a saber:

El Presidente de la República de la Nueva Granada, al señor Ezequiel Rójas, Encargado de Negocios de dicha República en Paris i en Lóndres; i el Senado de la República i Ciudad libre i Anséatica de Lubeck, el Senado de la República i Ciudad libre i Anseática de Brémen i el Senado de la República i Ciudad libre i Anseática de Hamburgo cada una separadamente al señor Vicente Rumpff, Ministro residente de las Ciudades libres de Alemania en Paris, quienes despues de haberse comunicado sus plenos poderes, hallados en buena i debida forma, han convenido en los artículos siguientes:

Art. 1.0 Habrá paz perfecta i amistad sincera e invariable entre la República de la Nueva Granada i las Repúblicas Anseáticas.

Art. 2.o Habrá igualmente entre la República de la Nueva Granada i las Repúblicas Anseáticas una recíproca libertad de comercio i navegacion.

En consecuencia, los ciudadanos de cualquiera de ellas podrán ir libre i seguramente con sus buques i cargamentos a todos aquellos parajes, puertos i rios en los territorios i dominios de la otra a los cuales se permite o permitiere ir a otros estranjeros; entrar, permanecer i residir en ellos; alquilar i ocupar casas i almacenes para los objetos de su comercio; quedando sinembargo sujetos a las leyes i estatutos de los respectivos paises.

Art. 3.o Los ciudadanos de las Repúblicas contratantes, residentes o transeuntes en los territorios de la otra, gozarán en sus personas i propiedades i en el ejercicio de su industria i de su relijion de la misma proteccion, seguridades, derechos i privilejios concedidos o que se concedieren a los ciudadanos o súbditos de la Nacion mas favorecida; tendrán libre i fácil acceso a los tribunales de justicia para sostener i defender sus derechos e intereses, bajo las condiciones impuestas a los naturales de la Re
