Preamble.

CA P. LXVI.

An act for providing an additional burying ground for the use of the pari of Saint Pancras, in the county of Middlefex; and for fhutting up the prefent foot path leading through the church yard, and making a com modious one in lieu thereof.

Trustees. When trustees are reduced to ten, new ones to be elected the furvivors. First meeting of the trustees to be upon ten days notice the church. Truftces to defray their own expences. Majority at public meetings to act, if five of the trustees are prefent. Actions to be brough in the name of the churchwardens, who fhall be reimbursed their e pences. Truftees to appoint officers; and take security. Power to purcha lands. Perfons refuling to treat and agree, jury may affefs the value Money affeffed how to be tendered. Money belonging to corporation &c. to be reinvefted. By whom the expences of the jury and witne are to be defrayed. To caufe the additional new burying ground to enclosed with a brick wall seven feet high, and to build a houfe for a par fon to refide in, and protect the said ground, and may build vaults f burial of the dead. Power to borrow money. Power to raise money by annuities. No greater fum to be taken from the poor's rates, than one penny in the pound at the rack rent. Securities for monies lent may be transferred. Copies of affignments and transfers to be entered in a book. No preference to be given to perfons lending money. The churchwar dens to account yearly, and pay their balances to the trustees. The over feers alfo to pay half yearly the fums required by the trustees, not exceed ing one penny in the pound. An act for extending certain acts therein mentioned to petty officers and feamen, non-commiffioned officers of marines, and marines, ferving, or who may have ferved, on board any of his Majefty's fhips, and refiding in Ireland.

31Geo.2.c.Io. WHEREAS an act paffed in the thirty-first year of the reign of

his late majesty King George the Second, intituled, An að for the encouragement of feamen employed in the royal navy; and for establishing a regular method for the punctual, frequent, and certain payment of their wages; and for enabling them more eafily and readily to remit the fame for the support of their wives and families; and for preventing frauds and abuses attending fuch payments and also another act, paffed in the third year of the reign 3 Geo.3.c.16. of his present Majefty, intituled, An act to impower the commiffioners or governors of the royal hofpital for feamen at Grem wich, after defraying the neceffary expences thereof, to provide for fuch feamen worn out and become decrepit in the fervice of their country, who fhall not be provided for within the said holpital; and to enable them to receive fuch penfions as fhall be granted them by the faid commiffioners or governors in the most eafy and convenient manner; and for preventing frauds and abufes attending the fame and also another act, paffed in the twenty-fixth 16Geo.3.c.63. year of the reign of his prefent Majesty, intituled, An act for the further preventing frauds and abufes attending the payment o

fhould be allotted and paid to his faid wife, father or mother, grandfather, grandmother, brother or fifter, by any collector or revenue officer in Ireland, then and in fuch cafe the captain or commander of fuch fhip or veffel is hereby ftrictly required and enjoined to cause four lifts to be made out, which shall contain the names of all fuch inferior officers, feamen, non-commiffioned officers of marines, and marines, as fhall be defirous to remit to their wives, fathers or mothers, grandfathers, grandmothers, brothers or fifters, the whole or any part of their wages or pay, except for the laft fix calendar months of their service as afore. faid; in which lifts the amount of the wages or pay so defired to be paid, the name and place of abode of the wife, father or mother, grandfather, grandmother, brother or fifter of such officer, feaman, non-commiffioned officer of marines, or marine, to whom fuch wages or pay are to be remitted and paid, and the district or addrefs of the collector or revenue officer by whom fuch wages are to be made payable in Ireland, fhall be specified and defcribed in three feparate diftinct columns oppofite to the name of fuch officer, feaman, non-commiffioned officer of marines, or marine, in the faid lifts, and every fuch officer, feaman, non-commiffioned officer of marines, or marine, who fhall fo defire that any such part of his wages or pay may be allotted and paid to his wife, father or mother, grandfather, grandmother, brother or fifter, fhall write his name or make his mark in a separate diftinct column in the faid lift, which lift fhall be forthwith completed and figned by the captain or commander, and proper figning officers of fuch fhip or veffel, and fuch captain or commander fhall tranfmit the faid lifts by the firft fafe opportunity, without any neglect or delay whatfoever, to the commiffioners of the navy at their board.

II. And be it further enacted by the authority aforefaid, That the faid commiffioners of the navy, or any three of them, upon receiving fuch lifts as aforefaid, wherein any fuch allotment fhall to make out be made by any fuch inferior officer or feaman, non-commiffionduplicate cer- ed officer of marines, or marine, of any fuch part of his wages or pay to his wife, father or mother, grandfather, grandmother, brother or fifter, fhall immediately, and they are hereby directed and required to make out, or caufe to be made out, two certifi cates for every fuch allotment, which certificates fhall be duplicates, and joined together with oblique lines, flourishes, or devices, in fuch manner as the faid commiffioners, or any three or more of them, fhall think proper, and which shall specify and defcribe the name and place of abode of the faid wife, father or mother, grandfather, grandmother, brother or fister, and shall 'certify that fuch wife, father or mother, grandfather, grandmother, brother or fifter, refpectively, is intitled to receive fo much of the wages or pay of fuch inferior officer or feaman, noncommiffioned officer of marines, or marine, as fhall be therein alfo fpecified, and fhall be addreffed to the commiffioners of the revenue of Ireland; and the certificates, being numbered and dated, fhall be figned by any three of the commiffioners of the

N. B. The perfonating or falsely affuming the name and character of
the wife or relation of any inferior officer, feaman, non-commif-
fioned officer of marines, or marine, or procuring any other to do
the fame, in order to receive wages due to fuch officer, feaman, non-
commiffioned officer of marines, or marine, is made felony, without
benefit of clergy, by an act paffed in Ireland, thirty
George the Third.

THE officer to whom the within bill is addreffed is directed by act paffed in Ireland thirty George the Third, cap. to examine the duplicate thereof when prefented, and enquire into the truth, by the oath of the perfon presenting the fame; and, being fatisfied, he is to teftify to that purpose upon the back of the bill, and pay the amount without fee or reward; but if he fhall not be able to pay the amount, from not having publick money fufficient in his hands, he fhall note the caufe of his refufing payment, and fhall appoint another day, within one month at furtheft from that time, and shall deliver back the bill, so noted,

to the perfon presenting it. And if, upon complaint to the commiffionen. it fhall appear that the officer to whom this is addreffed has unneceffari delayed payment, taken any fee, or made any deduction whatsoever, fhall be fined a fum not exceeding fifty pounds.

made out in the following

form.

III. And be it enacted by the authority aforefaid, That z foon as the aforefaid certificates fhall be fo made out and figned, the faid commiffioners of the navy fhall cause the fame to br cut afunder, indentwife, through the oblique lines, flourishes, ar devices, and fhall caufe one of the faid certificates to be tranmitted forthwith to the perfon nominated and specified in fuc lifts as the wife, father or mother, grandfather, grandmother. brother or fifter of fuch inferior officer or feaman, non-commifioned officer of marines, or marine, and the other of the fait certificates to be tranfmitted forthwith to the faid commiffionen of the revenue in Ireland.

IV. And be it further enacted by the authority aforesaid, The when payable, when and so often as any wages or pay due to any inferior officer or feaman, non-commiffioned officer of marines, or marine, fhail be paid at the pay office of the navy, or at any of the out-ports, if any fuch officer, feaman, non-commiffioned officer of marines, or marine, fhall be defirous to remit the amount, or any part of fuch wages or pay to their wives, children, or parents, in Ireland, or to fuch other perfon in Ireland as they fhall judge proper, and fhall defire to receive a certificate to entitle them to receive the fame, to be addressed to the commiffioners of the revenue in Ireland, then and in fuch cafe two certificates, being duplicates of each other and joined together with oblique lines, flourishes, or devices, fhall be immediately made out, numbered and dated by the clerk of the treasurer of the navy appointed to pay fuch wages or pay, and be figned, if made out at the pay office of the navy in London, by the commiffioner of the navy comptrolling the payment when fuch certificates fhall be fo made out, or if made out at any of the out-ports, by the commiffioner of the navy comptrolling fuch payment there, and be attefted at the foot thereof by the first clerk of the treasurer of the navy at fuch pay office or out-port, and fuch certificates fhall fpecify and defcribe the name and place of abode of fuch perfon or perfons in whose favour they fhall have been made out as aforefaid, and shall certify that such perfon or perfons is or are intitled to receive the whole amount, or fo much of the wages or pay of fuch inferior officer or seaman, non-commiffioned officer of marines, or marine, as shall be therein also specified, and fhall be addreffed to the commiffioners of the revenue in Ireland, and written or printed according to the form following, or to the like effect.
