VIII. And whereas, by the above-mentioned a&t, paffed in the thirty-first year of the reign of his late Majefty, the fum of fixpenc per diem was thereby directed to be allowed and paid to British gover nors, minifters, confuls, and merchants, refiling in foreign parts, for the fubfiftence of all feafaring men and boys, fubjects of Great Britain, that should be shipwrecked, captured, or by other unavoidable accidents be driven or caft away, or that should be difcharged unferviceable from any fhips or veffels of the royal navy, and the like fum of fixpence per diem was directed to be paid and allowed to every master or perja having charge of a ship or, vessel taking on board fuch feafaring mas, in the manner in the faid at mentioned; be it hereby enacted, That, gd. per diem to be allowed from and after the first day of August one thousand seven hundred in cafes where and ninety-two, the fum of nine-pence per diem fhall be allowed 6d. was di- and paid in the ftead of the aforefaid fum of fixpence; which fid rected and al- fum of nine-pence per diem fhall be paid in the fame manner, and lowed by 31Gco.2.c.ro. under the fatne regulations and reftrictions, as are directed by the aforefaid a refpecting the fum of fixpence per diem thereby allow ed, any thing to the contrary in any former act contained notwithstanding. The navy board to af fign for payment tickets prefented or tranfmitted to them, &c. IX. And be it further enacted, That as foon as any petty offcer or feaman, non-commiffioned officer of marines, or marine, who fhall have been in any way discharged abroad, as aforefaid, fhall prefent that part of the ticket or tickets which fhall have been delivered to him as herein-before directed, together with a certificate of discharge in cafe he shall have been fent fick to any hofpital or fick quarters, and a ticket or certificate from the commander of any packet or trading fhip or veffel, if he fhall have fo arrived in any port in Great Britain, to the commiffioners of the navy, at their board, they fhall examine, or caufe the fame to be examined, by the mufter books, or other returns for the time, if received; and, upon being duly fatisfied that the perfon fo prefenting the fame is the petty officer or feaman, non-commiffioned officer of marines, or marine, upon whofe account the fame was made out, they, or any three of them, fhall immediately affign for payment that part of fuch ticket or tickets which fhall have been fo prefented to them by fuch petty officer or feaman, non-commiffioned officer of marines, or marine, or that part of the fame which fhall have been tranfmitted to them by any captain or commanding officer in his Majefty's fervice, if fuch part fhall have come to their hands, or either of fuch parts; and the part fo affigned fhall include the time that fuch petty officer or feaman, non-commiffioned officer of marines, or marine, upon whofe account the fame fhall have been fo made out, fhall have been in any of his Majefty's foreign hofpitals or fick quarters, in cafe he fhall have been in any fuch hofpital or fick quarters, and of which he fhall have produced certificates, as herein-before directed, from the agent of fuch hofpital or fick quarters, and also the time which fuch petty officer or feaman, non-commiffioned officer of marines, or marine, fhall have been in any packet, or trading fhip or veffel, on his paffage home, if he fhall have fo come home, and of which he thall have produced certificates, as herein before directed, from the may examine tick. are to affign the commander of fuch packet, or trading fhip or veffel; and the faid commiffioners having fo affigned and otherwife completed fuch ticket, they fhall-immediately deliver, or caufe the fame to be delivered to the petty officer or feaman, non-commiffioned officer of marines, or marine, upon whofe account the fame fhall have been made out; and being fatisfied that fuch tickets or certificates were made out for and on account of the faid perfon, he fhall immediately tranfmit them to the commiffioners of the navy at their board, who fhall caufe the day upon which they fhall receive the fame to be indorfed thereon, and fhall examine, or cause them to be examined, by the mufter books, or other returns for the time, if received; and they, or any three of them, fhall affign for payment that part of fuch ticket or tickets which hall have been fo tranfmitted to them, or that part of the fame which fhall have been tranfmitted to them by any captain or commanding officer in his Majefty's fervice, if fuch part fhall have come to their hands, or either of fuch parts; and the part fo affigned fhall include the time that fuch petty officer or feaman, non-commiflioned officer of marines, or marine, upon whofe account the fame fhall have been fo made out, fhall have been in any of his Majefty's foreign hofpitals, or fick quarters, in cafe he fhall have been in any fuch hofpital or fick quarters, and of which he shall have produced certificates as herein-before directed, from the agent of fuch foreign hofpital or fick quarters, and alfo the time which fuch petty officer or feaman, non-commiffioned officer of marines, or marine, fhall have been in any packet or trading fhip or vefiel on his paffage home, if he fhall have fo come home, and of which he fhall have produced certificates, as herein-before directed, from the commander of fuch packet, or trading fhip or veld; and the Tickets, fo faid commiffioners having fo affigned, or otherwife completed fuch aligned, to he ticket, they shall immediately return, or caufe the fame to be re- port for y turned to the commiffioner at fuch port who fhall have tranfmitted the fame to them; and the faid commiffioner, upon receiving fuch ticket, fhall immediately deliver, or caufe the fame to be delivered, to the petty officer or feaman, non-commiffioned officer of marines, or marine, upon whofe account it fhall have returned tothe men out lifts of the vouchers. been made out; and fhall direct payment to be made thereon without delay, and fhall allow the faid powers and privileges of remittance as aforefaid. Agents of hof X. And be it further enacted by the authority aforefaid, That, pitals to make when and fo often as any petty officers or feamen, non-commiífioned officers of marines, or marines, fhall be fent fick to any petty officers, &c. fent there, hofpital or fick quarters at home or abroad, from any ship or which, when veffel in his Majefty's fervice, the agent of fuch hofpital or fick figned as herequarters fhall make out or caufe to be made out from the refpecin directed, fhall be their tive fick tickets of fuch petty officers and feamen, non-commiffioned officers of marines, and marines, a lift containing their names, and the numbers at which they refpectively stood upon the books of the fhip or veftel from which they fhall have been fent; and the officer of fuch fhip or veflel who fhall have attended them on fhore fhall examine fuch lift, and finding the fame to be juft and true, fhall date and fign the fame, and deliver it to the agent, who fhall take the firit opportunity thereafter to procure to the fame the fignature of the captain or commander of fuch ship or veffel, and which lift fhall remain with him, and be to him a fufficient voucher for having received fuch petty officers and feamen, non-commiffioned officers of marines, or marines, into fuch hofpital or fick quarters, in lieu and inftead of the fick ticket directed to be made out, fent, and delivered by the aforefaid act of the thirty-first year of the reign of his late Majesty. fick tickets with the agents, &c. but if they are difcharged as unferviceable, or fent into Petty officers, XI. And be it further enacted, That when and so often as any &c. returning petty officer or feaman, non-commiffioned officer of marines, or to their fhips from holpitals marine, fhall be fent fick to any hofpital or fick quarters at home to leave their or abroad, and shall afterwards be discharged therefrom to return to the fhip from which he fhall have fo been fent, he shall leave his fick ticket in the hands of the agent of fuch hofpital or fick quarters, who fhall tranfmit the fame to the commiflioners of the navy, with their monthly or quarterly returns; but if fuch petty officer or feaman, non-commiffioned officer of marines, or marine, fhall be difcharged unferviceable from fuch hofpital or fick quarany other ship, ters, or be difcharged therefrom to ferve in any other ship or to keep them, vellel, he fhall keep and preferve fuch ticket for payment: provided always, that if fuch petty officer or feaman, non-commiffioned officer of marines, or marine, thall be fo discharged to ferve in any other fhip or vellel, fuch ticket fhall not be payable until the fhip on board of which he fhall go from fuch hospital or fick quarters fhall come in courie of payment, or until he fhall be in any way difcharged therefrom. &c. Petty officers, tain to be al Navy board to XII. And be it further enacted, That any fuch petty officer or feaman, non-commiffioned officer of marines, or marine, who fhall be fo fent fick from any fhip or veffel into any of his Majefty's hofpitals or fick quarters in Great Britain, fhall not be allowed wages or pay for more than thirty days of the time which he hall remain in fuch hofpital or fick quarters. XI. And be it further enacted by the authority aforefaid, That when and fo often as any petty officer or feaman, noncommiffioned officer of marines, or marine, being abfent from officers, &c. his ship upon any detached fervice or employment, fhall be left ets for petty behind when the fhip or veffel to which he belongs fhall proceed left behind on to fea or foreign fervice, then, and in every fuch cafe, the com- fervice, when miffioners of his Majefty's navy fhall, upon application from the fhips proceed captain of the ship on board of which he fhall be ordered to serve, to sea, &c. make out, or caufe to be made out, from the monthly mufter books of fuch fhip or veffel, as foon as the fame fhall be received for the time, a ticket for every such petty officer or feaman, noncommiffioned officer of marines, or marine, as fhall be fo left behind, which ticket they fhall check and examine, and on fuch application fhall affign and deliver the fame to the faid petty. officer or feaman, non-commiffioned officer of marines, or marine, but which shall not be paid or payable until the ship or veffel into which he fhall be fent fhall come in course of payment, or until he shall be regularly difcharged therefrom. viceable from commiflioner XIV. And be it further enacted, That if any petty officer or Petty officers, feaman, non-commiffioned officer of marines, or marine, fhall &c difcharg have been duly discharged, as difabled or unferviceable, from his ed as unferfhip, or be discharged as difabled or unferviceable from any of his hofpitals, be Majesty's hofpitals or fick quarters, at home or abroad, and shall ing at ports arrive or be at any port in Great Britain where no commiffioner where no of the navy fhall be or refide, and fhall at fuch port, or at any of the navy reother place in Great Britain, be defirous to receive payment of fides, and any ticket or tickets, certificate or certificates, which thall have withing to rebeen made out on his account as herein-before directed, and for ceive payment any time when fuch petty officer or feaman, non-commiffioned of tickets, to officer of marines, or marine, fhall have been upon his paffage collectors of apply to the home, after having been discharged from fuch fhip, or from fuch the cuftoms, hofpital or fick quarters, he fhall apply to the collector of the &c. customs, collector of the excife, or receiver-general of the land tax, or clerk of the check, who may be at or nearest to such port or other place in Great Britain, and fhall present and deliver to him fuch ticket or tickets, together with the certificate of his having been duly difcharged from fuch fhip, or fuch hospital or fick quarters, as the cafe may be, and likewife (if he has received no wages or other confideration for his fervices in any packet or trading fhip or veffel on board of which he may have arrived in Great Britain), a certificate thereof from the mafter or commander of fuch packet or trading fhip or veffel; and fuch collec- Collectors. tor of the customs, collector of the excife, receiver general of the &c. on fuch land tax, or clerk of the check, in Great Britain, to whom he application to may apply respectively, is hereby required and directed to receive identity of the fuch tickets and certificates, and to require a certificate from the perty, and master of the packet or veffel in which fuch feaman fhall have tranfmit tickcome home, if he fhall have fo come home, or from fome re- cts, &c. to the navy, board, putable inhabitant of fuch place, that he knows the perfon apply- &c. ing to him as aforefaid, or believes fuch perfon to be the party entitled to hold the tickets or certificates which he thall have fo prefented, and whofe addrefs they fhall alfo fpecify; and the faid collector of the customs, collector of the excife, receiver general of the land tax, or clerk of the check, as the cafe may be, being fatisfied L13 afcertain the Tickets fo be examined, fatisfied in every refpect with regard to the identity of fuch petty officer or feaman, non-commiflioned officer of marines, or ma rine, fhall grant an acknowledgement or receipt to him for fuch tickets and certificates as he fhall fo deliver, and fhall immedi ately tranfmit the fame, together with the certificate, and party's addrefs, taken by him as before directed, addrefled to the commiffioners of his Majefty's navy, at their board in London, who fhall caufe the day upon which they fhall receive the fame to be tranfmitted,to indorfed thereon, and they fhall immediately caufe fuch ticket or andremittance tickets, and certificate or certificates to be examined by the mui bills made out ter books, if received, and fhall make or caufe to be made out for the time, within three days, a remittance bill for the net balance due upon fuch tickets and fuch certificates, or upon the fhip's books for which fuch ticket or tickets fhall have been made out, in cale the fhip or fhips fhall have been paid for the time, and which remittance bills they are hereby directed and required to make out, align, atteft, forward, and tranfinit, in the manner herein-before directed in cafes of foreign remittances, and which remittance bill for payment fhall be made payable only to fuch petty officer or feaman, non-commiffioned officer of marines, or marine, to whom fuch wages fhall be due; and fuch remittance bills fra be made out in the form herein-before directed, in cafes of parties defiring their wages to be remitted from abroad, or to the Eike effe&t. Other tickets may be made for thofe loft, on application to the navy office, &c. XV. Provided always, and be it further enacted and declared by the authority aforefaid, That in cafe both parts of any fuch remove ticket, herein before directed to be granted and delivered to fuch officer or feaman, non-commiffioned officer of marines, petty or marine, and to be tranfmitted to the commiffioners of the navy as aforefaid, or that part of fuch ticket which fhall contain the certificate et difcharge herein before directed to be granted by the agents of his Majefty's hofpitals or fick quarters, fhall happen to be loft or deftroyed before the fhip or velel fhall be paid for the time for which fuch ticket fhall have been made out, then, and in any fuch cafe, another ticket or other tickets, or another certificate or other certificates, fhall, upon application to the commilioners of the navy, (upon their being fatisfied of the identity of the party), be immediately made out from the mufter books and hofpital returns refpectively if received, and which other ticket or tickets, certificate or certificates, fhall be to fuch petty officer of feaman, non-commiffioned officer of marines, or marine, in every refpe&t the fame as the ticket or tickets, and certificate or certif cates, which were fo loft or deftroyed; and provided also, that in cafe any petty officer or feaman, non-commiflioned officer ked, if not pre-marines, or marine, to whom fuch ticket or tickets, and certifcate or certificates, fhall have been made out, fhall not appear in perfon and prefent the fame, in order to obtain payment as afore faid, before the fhip or velel fhall be paid for the time for which fuch ticket or tickets fhall have been made out, then, and in every such case, the pay or wages due to fuch petty cfficer of feaman, non commiffioned officer of marines, or marine, for fuch Such tickets to be cancel fented before the hip be paid, &c. |
