CA P. LIII.

An act for granting to his Majesty a certain fum of money, to be raised by a lottery.

806,250l. to be raised by a lottery. All perfons who have made depofits, pursuant to the refolution of the house of commons, are required to pay the remainder of their fubfcriptions at certain times fpecified, viz. al. by July 1, 1791; 2l. by August 5, 1791; 21. by September 16, 1791; 31. by October 21, 1791; 21. by December 9, 1791; and the remaining 41. by January 13, 1792; and the contributors for each 16l. 2s. 6d. advanced, to have, upon each fortunate ticket, the lot fallen to him; and those that pay contributions before the time limited, to be allowed discount at 31. per cent. per ann. and if the whole fum of 806,250l. be paid, to have lottery tickets delivered at the rate of 161. 21. 68. each. Cafhier to give fecurity, to the fatisfaction of the commiffioners of the treasury; and to pay all monies received into the exchequer. Commiffioners of the treafury impowered to apply the money paid in by the cashier. 500,000l. the amount of the prizes, to be paid out of any fupplies granted this feffion. Managers and directors of the lottery to be appointed by the treasury. Method of the lottery books. Managers to examine the books, with the tickets, and deliver them to the cashiers of the bank, taking a receipt for the same. Cashiers to return the books, with the undifpofed tickets, with an account. of money received and paid in. Undifpofed tickets to be delivered into the exchequer. Tickets of the middle columns to be rolled up, and fastened with thread or filk; and cut off indentwise into a box marked with the letter (A), and put into another box to be locked up, and fealed. Books to be prepared with two columns, on each of which 50,000 tickets are to be printed. The number and value of the fortunate tickets, two prizes. of 30,000l. two of 20,000l. three of 10,000l. five of 5,000l. ten of 2,000l. 15 of 1,000l. 30 of 500l. 50 of rool. 100 of 50l. 14,150 of 201. 1,000l. to the first-drawn ticket; 1,000l. to the laft-drawn. Tickets in the outermoft column of the laft-mentioned books to be rolled up and tied, and cut off into a box marked with the letter (B), &c. Publick notice to be given of putting the tickets into the boxes. Lottery to begin drawing Feb. 20, 1792. Method to be observed in drawing, &c. Number of the fortunate tickets, and the fums, to be printed. Difputes to be adjusted by the managers. Penalty on forging tickets, &c. capital felony and death. Offenders (not in prifon) discovering perfons guilty, to receive a pardon, and 5ol. reward. Provifo no attainder for fuch offences to make corruption of blood, lofs of dower, or disherison of heirs. A. B. as a manager and director of the lottery to be drawn in pursuance of an act of parliament, made in the thirty-first year of his Majefty's reign, do fwear, That I will faithfully execute the truft repofed in me; and that I will not use any indirect art or means, or permit or direct any perfon to use any indirect art or means, to obtain a prize or fortunate lot therein, for myself, or any other perfon whatsoever; and that I will do the utmost of my endeavours to prevent any undue or finifter practice to be done by any perfon whatsoever; and that I will, to the beft of my judgement, declare to whom any prize, lot, or ticket, of right does belong, according to the true intent and meaning of the said act.

Cafhier may receive the fums fubfcribed before receiving the lottery book; giving a note for the fame; which shall entitle the bearer to a ticket for every 161. 28. 6d. paid. After July 1, 1791, the cashier may deliver tickets

not exceeding in value half of the fum actually subscribed; and shall give receipts for the refidue of such fums, after deducting the value of the tickets fo delivered. Contributors, not making good their payments within the times limited, forfeit their depofits, and the tickets to be returned to the managers, &c. Commiffioners of the treasury may reward the managers, &c. as they shall think fit. The 500,000l. for the payment of the fortunate tickets, to be charged on any supplies granted this feffion; and shall be paid to the proprietors, without any deduction, on June 28, 1792, &c. Managers to give notice of the times for exchanging tickets for certificates. Certificates to be numbered, &c. and figned, &c. Commiffioners of the treafury impowered to defray the incidental expences attending the execution of this act. No fee to be taken for receiving or pay. ing contribution-monies, or for any receipts, &c. on penalty of 20l. No tickets to be divided into any other shares than halves, quarters, eighths, and fixteenths, on penalty of 50l. Form of fhares of tickets.

An act for establishing a company for carrying on trade between the kingdom of Great Britain and the coafts, harbours, and countries

Africa; and for enabling the faid company to hold, by grant from his Majefty, his heirs and fucceffors, and from the native princes of Africa, a certain diftrict of land, commonly called The Peninsula of Sierra Leone, now vefted in his Majefty, or belonging to the faid princes, for the better enabling the faid company to carry on the faid

trade.

7HEREAS the establishing of a general trade and commerce

thence to and with the feveral interior kingdoms and countries of that continent, would be highly beneficial to the manufactories and other trading interefts of these kingdoms: and whereas the interior kingdoms and countries of the faid continent have not hitherto been explored by Europeans, nor hath any regular trade ever been carried on therewith

from thefe kingdoms, nor can fuch undertakings be conveniently carried on and fupported, unless a confiderable capital joint stock is raised for that purpose: and whereas it is also necessary for the parties engaging therein, that they should have the fole and abfolute poffeffion of fome diftrict of land on the faid coafts, where they may form a factory or fettlement for their fervants, a fecure depofitory for their goods and merchandife, and a fafe harbour for their fhipping: and whereas feveral perfons have already formed themfelves into a fociety, and fubfcribed confiderable fums of money for the purpose of establishing and carrying on fuch trade and commerce; but are apprehenfrue that difficulties may arife as well in recovering debts which may grow due to the joint flock, as in defending fuits or actions which may be commenced or brought against the fubfcribers for any matter or thing relative to the fociety, as by law all the feveral fubfcribers and proprietors to and in the fociety muft in fuch cafe both fue and be fued, implead and be impleaded by their feveral and diftinct names and descriptions; and it is expedient that the feveral fubfcribers and proprietors fhall be protected from becoming liable. to the payment of any fum or fums of money, beyond their respective fbares in fuch capital joint ftock: and whereas many perfons who are not now liable to become bankrupts, within the intent and meaning of any of the laws now in force concerning bankrupts, are likewife fearful of fubfcribing money to carry on the laudable purposes of the faid fo ciety, as by becoming subscribers to and part owners of the faid capital joint flock, and by being engaged or concerned in the dealings to be carried on therewith, they may be liable to have commiffions of bankrupt iffued against them as traders: therefore, for the more easily effecting the purposes of the faid fociety, and for avoiding the difficulties aforefaid, the faid fociety are defirous of being incorporated, and having a common feal and name, by which they may be known and diftinguished, fue and be fued, implead and be impleaded: may it therefore please your Majefty that it may be enacted, and be it enacted by the King's moft excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That, Proprietors. II. And be it further enacted, That the faid company shall be able, and capable in law, and fhall have perfect and full power and ability in law, to have, purchase, take, hold, receive, poffefs, and enjoy lands, tenements, and hereditaments, of what nature or kind foever, fituate in any part of his Majesty's dominions, not exceeding in the whole the annual value of two thoufand pounds; and that any perfon or perfons, bodies politick or corporate, may give, grant, bargain, fell, or convey to the faid company any lands, tenements, or hereditaments for the ufe and benefit of the faid company, notwithstanding the ftatute of mortmain, fo that the fame, together with the lands fo to be purchafed as aforefaid, do not exceed in the whole the faid annual value of two thoufand pounds; and that the faid company fhall have full power and ability at law to fell, grant, alien, demife, or difpofe of fuch lands, tenements, and hereditaments, or any part thereof, at their free will and pleasure, and in their corporate name shall be able and capable in law to fue and implead, be fued and impleaded, answer and be anfwered, defend or be defended,

in all or any court of record, or elsewhere, in all actions, fuits and caufes whatsoever, for, touching, or concerning the faid company, or their capital joint ftock, or any of their property, eftate or eftates, in as large, ample, and beneficial manner and form as any other body politick and corporate, or any other the liege people of Great Britain, or other his Majefty's dominions, may or can have, purchase, take, hold, receive, poffefs and enjoy, fell, grant, alien, demife, or difpofe, fue, implead, anfwer, or defend, or be impleaded, fued, defended, cr anfwered, in any manner of wife, and shall and may by the name aforefaid do, perform, and execute, and caufe and procure to be done, performed, and executed, all or any lawful acts, matters, and things whatsoever, appertaining to thein to do, perform, or execute, for, touching, or concerning the general trade or dealings of the faid company.

III. And be it further enacted, That it fhall be lawful for the Power to raise faid company, in fuch general court or courts thereof as is or are a capital authorised to be holden purfuant to this act, to raife fuch capital joint stock. joint ftock for the establishing and carrying on of the trade or bulinefs of the faid company, at fuch times and in fuch proportions as to them fhall feem meet, not exceeding in the whole the fum of five hundred thousand pounds, by taking fubfcriptions from par ticular perfons (being or not being members of the faid company) for advancing money for this purpose, in fuch fhares as are hereinafter mentioned, according to the order or orders of fuch general court or courts for the time being of the faid company, or by fuch ways and means, and in fuch methods, as to fuch general court or courts hall feem meet and expedient, for making up the faid capital joint stock, and that the faid capital joint ftock so to be raifed fhall be divided into fhares of fifty pounds each.

IV. And be it further enacted, That all and every perfons and Subscribers to perfon by or for whom any fubfcription fhall be made or accept- have an ined, or any payment made pursuant to the orders of fuch general capital joint court or courts, for or towards the raifing of the faid capital joint ftock, accordstock as aforefaid, his, her, or their executors, administrators, or ing to the affigns refpectively, fhall have and be entitled to a fhare of and in amount of the faid capital joint stock of the faid company, in proportion to their fubthe monies which he or they fhall have contributed towards making up the fame, and to a proportionable fhare of the profits and advantages attending the fame capital joint ftock, and fhall be admitted to be members of the faid company; but that no perfon or perfons fhall be entitled to any greater fhare in the faid capital or joint stock of the faid company than the money which he, fhe, or they fhall have paid towards the fame; and that the feveral members of the faid company do and shall refpectively ftand refponfible and anfwerable to all juft debts and demands of the creditors of the faid company, to the full amount of their feveral and respective shares in the capital of the faid joint ftock, but fhall not be any further or otherwife liable, either perfonally or in their feveral and refpective lands, tenements, hereditaments, goods, chattels, or effects, for any undertakings, engagements, contracts, or agreements, VOL.
