WHEREAS an act of parliament was made in the twenty- Preamble. fecond year of the reign of his late Majefty, for making a free 22Geo.2.c.49. market for the fale of fish in the city of Westminster, and for other profes in the faid act mentioned; and by the faid act trustees were appated, with power to erect and build a fish market within the faid and certain duties were granted and made payable by all fishermen and other perfons bringing fish to the faid market, and a piece of ground, ate near Westminster Bridge, was conveyed to the faid trustees,

leafe, at a certain referved annual rent of fixty-five pounds, and the faid trustees are now in the receipt of the faid rent, and alfo of the duties granted to them as aforefaid; and are also poffeffed of the fum of four thousand two hundred pounds in the three per centum confolidated bank annuities, being the accumulated produce of the faid rents and du ties; but the faid trustees are not authorised to make any application thereof: and whereas the providing apprentices for fishermen, masters of fhips, or other perfons employed in the fea fervice, being one of the objects of the faid act of the twenty-second year of the reign of his late Majefly, in cafe the faid fish market had fucceeded, and there had been any furplus money to be difpofed of, it is expedient that the eftate and property of the faid trustees should be applied in augmentation of the fund of the marine fociety, to be difpofed of for the purposes of the faid fociety, or in fuch manner as is herein-after directed: may it therefore please your Majefty that it may be enacted; and be it enacted by the King's moft excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this present parliament affembled, and by the authority of the fame, That the faid trustees, or any five or more of them, fhall and are belonging to hereby authorised and required, on or before the twenty-ninth be transferred day of September one thousand feven hundred and ninety, to caufe and paid to, the faid fum of four thousand two hundred pounds three per cena tum confolidated bank annuities, belonging to the faid trustees, to ground vefted be transferred to the marine fociety, and alfo to pay, or caufe to in, the marine be paid, to the faid marine fociety, all fuch money as fhall be in fociety. the hands of the treasurer to the faid trustees, and all other money

which piece of ground was conveyed to them by the commiffion-
ers for building Westminster Bridge, by virtue of the power grant-
ed to them by the faid act of the twenty-fecond year of the reign
of his late Majefty, fhall be, and are hereby vested in the said ma-
rine fociety; and the duties granted or made payable to the faid
trustees as aforefaid, by the faid act of the thirty-third year of the
reign of his late Majefty, fhall alfo be, and are hereby vested in,
and fhall be payable to, the faid marine fociety; which money
and other property are hereby directed to be transferred and paid
to, and vested in, the faid marine fociety for the uses and purposes
herein-after mentioned; (that is to fay), The faid fum of four
thousand two hundred pounds, and the dividends and produce
thereof, and the rent referved by the faid leafe, and the other mo-

a time of war, fuch produce may be applied towards fitting out
boys or other perfons to ferve in the royal navy; and the faid ma-
ine fociety fhall have the like powers and authorities for appoint-
ing an infpector of the fishing veffels coming to the Nore, and of
btaining payment of the faid duties, as the faid trustees had im-
mediately before the paffing of this act; any thing in the faid re-
cited acts, or any of them, to the contrary hereof notwithstanding.

An act to enable fir William Hamilton, knight of the most honourable order of the bath, his heirs and affigns, to make and provide quays, docks, piers, and other erections; and to establish a market, with proper roads and avenues thereto refpectively, within the manor or lordship of Hubberton and Pill in the county of Pembroke.

Sir William Hamilton empowered to erect quays and buildings, and exe cate other works. Goods landed on the quays, to pay the fame rate of wharfage as in the port of London. Penalty on throwing rubbish, &c. to the creek, or caufing annoyances. Sir William Hamilton to appoint ay mafters. Goods may be landed at the quays to be made under this From fuch quays on the eaft fide of Hubberton Pill, as are not legal ays, fufferance goods may be shipped and landed. CA P. LVI.

An act to alter and amend an act, paffed in the laft feffion of parliament, for making and maintaining a navigable canal from or from near to Cromford Bridge, in the county of Derby, to join and communicate with the Erewash Canal, at or near Langley Bridge; and also a collateral cut from the faid intended canal, at or near Codnor Park Mill, to or near Pinxton Mill, in the faid county.

29 Geo. 3. c. 74, recited. No more than 1-20th of the water of the Derwent to be taken for the time allowed. Quantity of water flowing under Cromford Bridge to be ascertained; and none to be taken for the canal, unless 570 tons per minute paffes under the bridge. When that quantity paffes under the bridge, a certain proportion may be taken for the canal, 1-20th part of the average for 48 hours; viz. from 4 every Thursday afternoon till 4 every Saturday afternoon. Cromford fough, and Bonfall brook, if diverted into the Derwent, below Cromford Bridge, or into another channel, to be deemed part of the water at Cromford Bridge. Mode of ascertaining the quantity of water in Cromford fough and Bonfall brook, to be measured on a certain day in 1790, and a certificate of the average quantity, by the engineer, to be recorded at the firft general quarter feffions in 1791, to be figned by the clerk of the peace, to be evidence of the same. Manner of taking water from the Derwent at four places on the ground belonging to the Cromford Canal company only, on the furface or at the fides of the canal, and not at the bottom thereof. Water of the foughs running into the Derwent, not to be diminished by means of the canal. No water to be taken into the canal from mines weftward of the tunnel, except at the places and times mentioned. Weirs to be made weftward of the tunnel three inches lower than the weirs on the fummit level eaftward of the tunnel, fo that all the wafte water may flow into the Derwent. Back drains to be made to the canal weftward of the tunnel, in all places found to leak, fo that fuch leakage water be conveyed into Derwent, or ftreams belonging. Bed of the river at Cromford Bridge to be made level before any water taken for the canal. Perfons interefted in the Derwent, to have accefs to the places where water thall be taken into the canal. An engineer to be appointed to examine the quantity of water taken from the Derwent, &c. An engineer to be appointed by juftices at the feffions, and to take the oath, &c. Owners of mills and works on the Derwent may appoint agents to infpect the taking the water. Engineers and agents to be paid by the Cromford Canal company. Verdicts of juries may be removed by Certiorari. If Cromford Canal company become unable to make good damages, the power of diverting the water of the Derwent to cease. Erewash Canal company may open fhuttles of the locks on the Cromford Canal, &c. And may open locks when boats loaded pafs from a higher to a lower level of the Cromford Canal. Times of holding general affemblies varied, as they fhall appoint. Manner of appointing committees varied, nine perfons each, and five to act. Sir

LVII.

An act for making and maintaining a navigable communication between
Stowmarket and Ipfwich, in the county of Suffolk.

Taitees. Truftees impowered to make the navigation of the river Gip-. pen from Stowupland Bridge to two furlongs below Hanford Bridge; and navigable cut to join the Orwell; to fcour the Orwell to Stoke Bridge, and the common quay at Ipfwich, &c. to dig and cut banks of the rivers; to erect bridges, &c. Stones or pofts marked, to denote distances; and other works; to alter, repair, and amend the works; to divert, alter, and enlarge ways, bridges, &c. and do other neceffary works; to take lands adjoining or near the rivers; making fatisfaction for damages. This at an indemnity to truftees. No wharf, &c. to be made between Bofmere Mill and Hanford Bridge; or houfe, &c. to be taken, without confent of owners and occupiers, except certain gardens, &c. in the parish of Stowmarket. No lock to be made fo as to damage any mill, &c. Breadth of the rivers, cuts, and towing-paths; rivers to be not above 18 yards, except where cuts above 3 feet above surface of water, and there 20 yards. Bodies politick, &c. impowered to fell lands. Lands feparated into small parcels may be exchanged or fold. Contracts declared valid, and to be rolled with clerk of the peace. Copies to be evidence. Commiffioners appointed for determining differences, who may ascertain damages to be done to lands, &c. If trustees or others are diffatisfied with determinations of commiffioners, or proprietors, &c. fhall refufe tender of fatisfaction, jury to be fummoned. Jury to affefs damages, and fums or annual rent to be paid. Commiffioners to give judgement. Witnefs to be paid expences, trouble, and lofs of time. Expences of jury and inqueft, if they give more than previously offered, to be paid by truftees, if lefs, by the party. Notice of injury to proprietors before complaint. Penalty on giving falfe evidence, perjury. Verdicts, &c. to be recorded, and tranfmitted to the clerk of the peace, and kept among records. On payment er fecurity for fums or annual rents, truftees may take and ute lands. This act an indemnity for fo doing. Commiffioners to fettle proportions to the feveral perfons interested. Application of the purchase money be longing to corporations, &c. to the perfons intitled to the premises. Annual rents charged upon the rates; and if not paid, commiffioners may appoint a collector of the rates. Trustees impowered to fell land not used for the purposes of the act. Towing paths to be feparated from the adjoining lands and bridges, &c. by the trustees. Watering places for cattle. Banks to be made against rivers and cuts. At fords rendered impaffable, bridges, &c. to be made; and to be maintained by trustees. In default thereof, the fame may be done by land owners, who fhall be repaid the expence by the trustees. If the water be raised, the banks to be propor tionably raifed. Stones to be fet up, and the heighth of the water marked thereon. Overfalls to be made. Rates of tonnage to be collected. For corn, hops, ftone, timber, and other goods (except coal), id. per ton per mile: for coal, one halfpenny per ton per mile. Commiffioners impowered to increase the rates of tonnage. Rates of whartage as the commithioners fhall appoint, and the order for the fame to be kept amongst the records of quarter feffions, and advertised in newspapers. Veffels of lefs burden than 35 tons lading to be charged as having 35 tons. Manure exempted from rates, unless the commiffioners direct to the contrary, and then to be fubject to fame rates as coal. What quantity of timber shall be deemed a ton; viz. 40 cubic feet of oak, afh, elm, or beech timber, and 50 cubic feet of fir or deal balk, poplar, or birch, not cut into fcantlings, to be deemed a ton weight. Recovery of rates. Truftees may reduce the rates. Rates not to be altered until after three months notice. Rates not to be leafed. Masters of boats to give account of lading.
