XLII. XLIII. XLV. It shall be lawful for any Member of a County Financial Board to enter and examine any Pauper Lunatic Asylum belonging 10 or partly belonging to his County at all reasonable Hours of the Day, visit an Asy- and so often as he shall see fit: Provided always, that if the Medical Officer of any Asylum shall be of opinion that it will be injurious to any Lunatic either to permit him or her to be visited and examined, or to permit the Examination of the Room in the Asylum in which 15 such Lunatic may be confined, and such Medical Officer shall state in Writing the Reasons why such Lunatic should not be visited or such Room examined, and shall sign such Statement, and deliver the same to the Person so requiring to visit and examine such Lunatic or such Room, then and in such Case it shall be lawful for such 20 Medical Officer to refuse such Visit and Examination.

XLVI. From and after the Twenty-ninth Day of September One thousand eight hundred and fifty-three all Powers and Duties theretofore lawfully and usually exercised or performed in any County by Justices of the Peace for Counties at any General or Quarter Sessions 25 the County (not herein otherwise provided for), relating to the making, assessing, and levying of County Rates, and the Application and Expenditure thereof, and the erecting, providing, repairing, altering, enlarging, and removing of all Buildings, Bridges, and Works wherewith County Rates or County Funds are by Law chargeable, and the 30 borrowing and raising of Money, the auditing, settling, and allowing of the Accounts of Treasurers for Counties, and the appointing and removing, and the fixing, reducing, augmenting, or altering the Salary or Allowance of all public Officers (except the appointing and removing of Officers of Gaols, Houses of Correction, Court Houses, 35 Shire Halls, and Judges Lodgings, and Inspectors and Examiners of Weights and Measures, but not excepting the fixing, reducing, augmenting, or altering the Salary or Allowance of such last-mentioned Officers or any of them,) that now are in the Nomination or Appointment of Justices of the Peace for Counties in General or Quarter 40 Sessions assembled, and who are or shall be paid out of County Rates or County Funds, and the granting of any Annuity or other Payment by way of Superannuation, shall cease to be exercised and performed by Justices of the Peace for Counties, and shall thence

XLVII. All Contract sand Covenants made or entered into before Existing the passing of this Act with, to, or in favour of, or by, for, or on behalf Contracts to of, the Justices of the Peace of any County, or by or with any force. 20 Committee of Justices of any County, for or relating to the erecting, providing, enlarging, or repairing of any Gaol, House of Correction, Pauper Lunatic Asylum, Lock-up House, Bridge, or other Building, shall from and after the Twenty-ninth Day of September One thousand eight hundred and fifty-three be and remain as good, valid, and 25 effectual in favour of and against and in reference to the County Financial Board of the County to which such Contracts respectively relate, and may be proceeded on and enforced by or against the County Financial Board of the County, to all Intents and Purposes as if the County Financial Board had been Parties to and had 30 executed the same, or had been named or referred to therein, instead of the Justices of the Peace of the County or a Committee of Justices of the Peace of the County.

XLVIII. In order that the County Financial Board of each County may know the Particulars of the several Contracts which shall be 35 existing in their County on the Thirtieth Day of September One thousand eight hundred and fifty-three, the Justices of the Peace of each County shall, at their Quarter Sessions to be held next after the Twenty-fourth Day of June One thousand eight hundred and fifty-three, direct and order that there be delivered on the Thirtieth 40 Day of September then next, by some Officer of such Justices, to the County Financial Board of their County, a true and perfect List or Schedule, so far as the same can be prepared, of all Contracts then subsisting between such Justices of the Peace and any Person or Persons.

XLIX. No Action, Suit, Prosecution, or other Proceeding whatsoever, commenced either by or against the Justices of the Peace of any County previous to the Twenty-ninth Day of September One thousand eight hundred and fifty-three, shall abate or be discontinued or affected by the passing of this Act, but the same shall continue and 5 take effect, either in favour of or against the County Financial Board of the County, in the same Manner in all respects as the same would have continued and taken effect in relation to the Justices of the Peace of such County if this Act had not passed.

L. The First General Meeting of the County Financial Board 10 shall be held on the Thirtieth Day of September One thousand eight hundred and fifty-three, at the Hour of Twelve at Noon, and such Meeting shall be held at such Place and in such Court House in each County as the General or Quarter Sessions of the Justices of the Peace of the County, next after the Twenty-fourth Day of June One 15 thousand eight hundred and fifty-three, shall be first held; and every County Financial Board at such First Meeting shall in the first place be appointed. elect and appoint Two Members of such Board, to be the Chairman and Vice Chairman respectively of such Board until the First General Meeting of such County Financial Board next after the Twenty-ninth 20 Day of September in the following Year, when, and at every subsequent General Meeting held next after the Twenty-ninth Day of September in each Year, the County Financial Board shall in like Manner elect a Chairman and Vice Chairman for the ensuing Year; and the Chairman, or in case of his Absence at the Commencement of any Meeting 25 the Vice Chairman, shall preside at all Meetings of such Board; and in case at the Commencement of any Meeting the Chairman and Vice Chairman shall both be absent, then some other Member of such Board, to be chosen by the major Part of the Members present, shall preside as Chairman at such Meeting; and whenever any Chairman 30 or Vice Chairman shall die or resign, or shall refuse or become incapable to act, before the Expiration of his Term of Office, the County Financial Board of such County shall, at their General Meeting to be held next after such Death, Resignation, or Refusal or Incapacity to act, elect and appoint some other Member of the said Board in his Stead. 35

LI. Every Person elected a Member of any County Financial Board shall continue a Member thereof until the Twenty-ninth Day of September in the Year next following the Year in which he was so elected, and from and after such last-mentioned Day the several Persons elected at the then next preceding Elections shall enter upon the Duties of their Office. 40

LII. In case it shall appear at any General Meeting of the County Financial Board that any Member has been elected by more than One of the several Boards and other Bodies of Guardians respectively entitled to elect Members of such County Financial Board, or by

One or more of such Boards and Bodies of Guardians, the presiding elected a Chairman of the Meeting shall call upon the Member so elected, if Member of the Board by then present, to declare for which of the Unions or Parishes in respect Two or more of which he has been so elected he will remain a Member of the Parishes or Unions, &c. 5 County Financial Board; and such Member may declare his Option in Writing under his Hand, addressed to the Clerk of the County Financial Board, and delivered to such Clerk before the General Meeting next after the Election; and in case such Member be absent, or decline or neglect to declare his Option as aforesaid, such Meeting 10 shall determine for which Union or Parish such Member shall remain a Member of the County Financial Board; and in either of these Events the presiding Chairman of such Meeting shall declare the Office of Member of the County Financial Board for the Union or Parish or each Union or Parish in respect of which such Member has 15 been elected, and does not remain a Member, to be vacant, and shall direct the Clerk of such County Financial Board to communicate the happening of such Vacancy to the Board or Body of Guardians entitled to supply the same as herein-after mentioned; and every Vacancy in the County Financial Board under this Provision shall be 20 supplied in the same Manner by the Board or Body of Guardians entitled to elect a Member in respect of the Union or Parish, as the Case may be, as if the Member whose double Election occasioned such Vacancy had ceased to be a Member of such County Financial Board.

LIII. If any Member of any County Financial Board shall die, or Providing 25 resign, or become disqualified or incompetent to act as a Member of cies in such Board, or otherwise cease to be a Member of such Board by any County other Cause than that of going out of Office at the Expiration of his Year of Office, the elected Guardians of the Board of Guardians, or the Guardians of the Poor, (as the Case may be,) by whom the said 30 Member so dying, resigning, becoming disqualified, or incompetent to act, or otherwise ceasing to be a Member, shall have been elected, shall, at their next Meeting after receiving from the Clerk of the County Financial Board Notice of such Vacancy (which Notice he is hereby required to give forthwith upon such Vacancy coming to his 35 Knowledge), elect in his Place another Person, duly qualified as aforesaid, to be a Member of such County Financial Board, and such Member so elected to fill up any such Vacancy shall continue in Office as a Member of the said County Financial Board so long only as the Person in whose Place he shall have been elected would have been 40 entitled to continue if he had remained in Office; and the due Election of any Member so elected to fill up any such Vacancy as aforesaid shall be proveable in all Courts of Law and Equity in like Manner as the Elections of the respective Members of County Financial Boards are herein-before directed to be proved.
