Establish County Financial Boards for the assessing of County Rates, and for the Administration of County Expenditure in England and Wales.

HEREAS it is expedient that County Financial Boards for Preamble. the assessing of County Rates and for the Administration of County Expenditure, and for other County and public Purposes, not of a judicial Nature, should be established in the several 5 Counties of England and Wales, and that the several Powers, Authorities, Duties, and Provisions relating to such Rates, Expenditure, and other Matters now vested in Justices of the Peace for Counties should cease to be exercised by such Justices, and should be transferred to and be applicable to and be exercised by County Financial Boards: May it therefore please Your Majesty that it may be enacted; and be it enacted by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, as follows:

Financial

I. A County Financial Board for the Purposes herein-after men- County tioned shall be established in every County throughout England and Boards to be Wales Provided always, that each of the Three Ridings of the established. County of York, and each of the Parts or Divisions of Lindsey and Kesteven and Holland in the County of Lincoln, shall for all the 20 Purposes of this Act be deemed to be a distinct and separate County.

The several Liberties of Saint Alban's in the County of Hertford, Peterborough in the County of Northampton, and the Isle of Ely in the County of Cambridge, shall for all the Purposes of this Act be deemed to be separate and distinct Counties of themselves, so long as the same shall respectively remain and be independent Liberties, and shall not 5 be by any "Order of Union" of Her Majesty united with any of the themselves. IV. The County Financial Board in each County in England and 15 of the County Wales (save and except in the Counties mentioned in Schedule (A.) to this Act annexed) shall consist of the several Persons to be elected Members thereof as herein-after mentioned by the elected Members of each Board of Guardians in the County, by the Guardians of the Poor of each Union of Parishes in the County formed under the Pro- 20 visions of the Act of the Twenty-second Year of King George the Third, Chapter Eighty-three, and by the Guardians of the Poor acting within the County under any Local Act for the Relief of the Poor in any single Parish or in any united Parishes: Provided always, that in each County the elected Members of each of the said Boards 25 of Guardians and each of the said Bodies of Guardians of the Poor of the said Unions and of the said Parishes shall respectively elect Two Persons to be Members of the County Financial Board of the County as herein-after directed.

V. of Persons, qualified as herein-after directed, to be Members of the County Financial Board of such County as shall be elected by the elected Guardians in each other Union of any such County: Provided also, that in case the Poor Law Board shall at any Time hereafter 5 diminish the Number of Unions in any of such Counties, the aggregate Number of Members of the County Financial Board to be elected by the elected Guardians of all the Unions in such County shall remain the same as before such Diminution of the Number of such Unions; and the said Poor Law Board are hereby required, at the Time of dimi10 nishing the Number of such Unions in any of such Counties, to declare and appoint by an Order under their Seal of Office which Union or Unions in such County shall have the Power of electing an additional Number or additional Numbers of Members of the County Financial Board, and in their Order they shall specify and define how many of 15 such additional Members each of such Unions shall respectively elect, and the elected Guardians of each Union in such County so appointed to elect additional Members of the County Financial Board, present at the First Meeting of the Board of Guardians of such Union or Unions next after the Thirty-first Day of August in every Year, shall at such 20 Meeting elect so many additional Members, qualified as herein-after directed, of the County Financial Board as shall be specified in the said Order of the Poor Law Board.

VI. In each of the said several Counties mentioned in Schedule (A.) to this Act annexed, at the First Meeting of each Board of Guardians 25 next after the Thirty-first Day of August in every Year, the elected Financial Guardians present at each such Meeting shall elect the Number of Board in Persons specified in the said Schedule (A.), or such increased Number Rutlandshire, as aforesaid, to be Members of the County Financial Board of their Flintshire, HuntingdonCounty, and in addition to the Qualification herein-after directed, shire, West30 One Half in Number of the Persons to be so elected at each such moreland, DenbighMeeting shall be Justices of the Peace residing within and acting for shire, Pemthe County; and a Copy of the Minute or Resolution recording every brokeshire, such Election made by such elected Guardians, purporting to be under shire, and in the Seal of the Board of Guardians, and to be subscribed by the the Liberty 35 presiding Chairman of the Meeting, and to be countersigned by the acting Clerk at the Meeting, shall, unless the contrary be shown, be taken to be sufficient Proof of the due Election of every such Member, and shall be received in Evidence by and before all Courts of Law and Equity, without any Proof of the Signatures or of the official 40 Characters of the Persons signing the same, or of the Seal, or of the Meeting, or of the Election of the Persons acting as elected Guardians at any such Meeting.
