place, parish, or ward, within the same division, he shall vote in any one of the places, parishes, or wards in which it is situate.

If there be any ward or place for which no separate polling place is appointed, the voter shall give his vote at the polling place appointed by the deputy returning officer for the purpose. 16. The poll shall commence at 8 a.m. and close at 9 p.m.

17. Subject to the provisions of this Order, the poll shall be taken in like manner as a poll at a contested municipal election is directed by the Ballot Act, 1872, to be taken; and the provisions of that Act shall apply to the election in like manner as if they were contained in this Order, with the substitution of the term "School Board Election" for the term " Municipal Election": Provided that

(a) Every voter for a division shall be entitled to a number of votes equal to the number of the members of the school board to be elected for such division, and may give all such votes to one candidate, or may distribute them among the candidates as he thinks fit.

(b) The voter may place against the name of any candidate for whom he votes the number of votes he gives to such candidate in lieu of a cross, and the form of directions for the guidance of the voter in voting, contained in the Ballot Act, 1872, shall be altered accordingly.

(c) The provisions of sections three, four, eleven, and twentyfour of the Ballot Act, 1872, shall be deemed to be regulations contained in this Order, which involve a penalty within the meaning of section ninety of the Elementary Education Act, 1870.

18. The person presiding at the poll may, and if required by any two voters shall, put to any voter at the time of his applying for a ballot paper, but not afterwards, the following questions, or one of them, but no other:

(a) In the City:

(1.) Are you the person whose name appears as A.B. on the list of persons entitled to vote in the election of common councilmen for the City?

(2.) Have you already voted at the present election?

(b) Outside the City:

(1.) Are you the ratepayer whose name appears as A.B. in respect of the property described as

book containing the rate made on

(2.) Have you already voted at the present election?

And no person required to answer any of the said questions shall be permitted or qualified to vote until he has answered the same.

19. At the close of any poll the person presiding at the poll shall, if he is not the deputy returning officer, as soon as possible transmit the ballot papers to the deputy returning officer of the division.

20. The deputy returning officer shall proceed in the usual manner to ascertain the result of the poll, and shall certify to the returning officer the number of votes given for each candidate.

DECLARATION OF RESULT.

21. The returning officer shall ascertain the candidates who have obtained the largest number of votes in each division, and such candidates shall be deemed to be elected on the day fixed for the election; and in case of an equality of votes the returning officer shall determine by lot the persons to be elected.

22. The returning officer shall publish notice of the result of the poll in the several divisions, and a list of the names of all the persons elected, with their places of abode and descriptions as members of the School Board, and shall forthwith transmit a copy of such notice and list to the Education Department. The ballot papers shall be kept by him for six months subject to the directions of the Education Department.

EXPENSES.

23. The expenses incident to the election shall be ascertained and determined by the returning officer, who shall, within three weeks after the date of the election, deposit at the office of the School Board a detailed statement of all such expenses, whether incurred by himself or by the deputy returning officers, and of his own and the deputy returning officers' remuneration, with vouchers or bills in support of the same. Such statement and vouchers shall remain so deposited for four weeks, and shall be open to inspection, by any person or persons authorised by any of the several rating authorities in that behalf, and the returning officer immediately after so depositing them shall inform the several rating authorities of their deposit and of the time for which they will remain deposited. If any question shall arise between the returning officer and any of the several rating authorities as to his bill for expenses or remuneration, such bill shall be referred, forthwith, at the end of the four weeks for which the statement and vouchers or bills shall remain deposited, to the Education Department, whose decision thereon shall be final and conclusive.

Immediately after such decision of the Education Department, or, if no question has arisen between the returning officer and any of the rating authorities, immediately upon the expiration of the

four weeks during which the statement shall remain deposited, the returning officer shall apportion the amount of his bill or of such bill as settled by the Education Department as the case may be according to the last apportionment of the amount required to be raised to meet the deficiency of the school fund of the Metropolis; and the several rating authorities shall pay to such person or persons as the returning officer shall by precept direct the several amounts so apportioned out of the rates or funds out of which their contributions to the school fund are payable (which rates and any increase therein may be levied for that purpose), and for obtaining payment of the amount specified in any such precept, the returning officer shall have the like powers as the School Board under section 37 of the Elementary Education Act, 1870.

GENERAL.

24. Notices and other matters required by these regulations to be published shall be published in the manner provided by the 26th section of the Metropolis Management Act, 1855, and in such other manner as is usually adopted in elections of vestrymen in the Metropolis.

25. Words used in this Order shall, so far as is consistent with the context, have the same meaning as the same words used in the Elementary Education Acts, 1870 and 1873.
