days after the passage of this act." Now it appears to your committee, that from that part of the said section above quoted, it is evident that the Legislature did not believe that they could interfere in a case circumstanced like that of the petitioner, or else they would not have limited the operation of the act to those cases in which the justices had not already determined by lot the classes to which the individuals so elected should respectively belong.

Your committee, for the reasons stated, are of opinion that no legislation is necessary to enable the petitioner to sustain his vested right to the said office; they therefore recommend that the said petitioner have leave to withdraw his said petition.
