26. And the Form of the Oath to be taken by the Sheriffs of faid City, fhall be the fame prescribed by Law to be taken by the Sheriffs, mutatis mutandis.

27. And the Form of the Oath to be taken by the Clerk of faid City, fhall be as follows, viz.

YOU being chofen Clerk of the City of Middletown, do fwear by the Name of the everliving God, that you will truly and faithfully attend and execute the Office of Clerk of faid City, according to your beft Skill, and make true Entries and Records of all the Votes and Proceedings of faid City, and fuch other Matters as by Law or by the By-Laws of faid City are to be recorded in your Office, and that you will deliver true Copies of the Records in your Hands, when they fhall be required. of you, taking only your lawful Fees. So help you GOD.

28. Which Oaths may be adminiftered by any Assistant of this State, or Justice of the Peace within and for the County of Hartford, or by the Mayor or either of the Aldermen of said City, provided the Mayor or Alderman administering such Oath hath been fworn according to this A&t.

29. And the Perfon adminiftering the Oath prescribed by this be given and Act, fhall give a Certificate thereof under his Hand to the Officer to whom he administered fuch Oath, which Certificate shall be recorded in the Records of faid City, before the Person to whom it is given fhall be capable of executing the Office to which he was chofen.

Power to make by-laws.

30. And be it further enacted, That there fhall be a Court of Common Council of faid City, of which the Mayor, Aldermen and Common Council of faid City fhall be the Members, who, or a Majority of them shall have Power to make By-Laws relative to the erecting and regulating Markets, and relative to Commerce within the Limits of faid City; relative to Perfons fummoned to serve as Jurors at faid City Courts and neglecting or refusing to ferve; relative to the Streets and Highways of faid City; relative to Nufances within faid City Limits; relative to Landing-Places, Wharves, anchoring and mooring of Veffels; relative to Trees planted for Shade, Ornament,Convenience or Ufe public or private, and to the Fruits of fuch Trees; relative to Trefpaffes committed in Gardens; relative to Walks and Buildings public or private; relative to the sweeping of Chimneys and preferving faid City from Fire; relative to the Forms of Oath to be taken by the Treasurer of faid City, and Inspectors of Produce brought to faid City for Sale or Exportation; relative to the manner of warning Meetings of faid City and the Court of Common-Council, and the Time and Place at which they shall be holden; relative to the Qualifications in point of Property of the Mayor and Aldermen ; relative to the Bonds to be given by the Sheriffs of faid City for a faithful Difcharge of their Duty; relative to the Penalties to be incurred by thofe who being chofen to any City Office, fhall (not being excused by said City) refuse to ferve; relative to a

City Watch; relative to the Burial of the Dead; relative to the public Lights and Lamps of faid City; relative to restraining Geefe and Swine from going at large within the Limits of faid To inflict pe City, and to inflict Penalties for the Breach of fuch By-Laws; ties not excuniary penalprovided however, that fuch Penalty fhall in no Cafe exceed the ceeding 34dol. 31. And all Grants and Leafes of any real Eftate belonging to

faid City, figned by the Mayor of faid City, and fealed with the Grants and City Seal, and approved by faid City in legal Meeting affembled, by the mayor, fhall be good and effectual in Law to convey the Eftate intended &c. to be conveyed by fuch Grant or Leafe, provided the fame is recorded in the Records, of the Town where the Lands leafed or granted lie.

32. And faid City fhall have power to appoint Inspectors of Infpectors of every Kind of Produce of the United States brought to faid City for Sale or Exportation.

33. And the Vote or Choice of the major Part of the Freemen prefent at a legal Meeting of faid City, fhall be confidered in all Cafes as the Vote or Choice of faid City.

34. And whenever the Mayor of faid City, or any other Officer of faid City, eligible by the Freemen thereof, fhall refign, or be removed by Death or otherwife, another Perfon fhall be chofen in his Place by faid City, and (if an annual Officer) fhall continue in Office until the expiration of the Month of January next following, unless another fhall be fooner chofen and sworn in his Stead.

fary, which Meeting may be from Time to Time adjourned, and a Copy of this Paragraph of this A&t certified under the Hand of the Secretary of this State and published on the Sign-Poft in faid Town of Middletown, at least three Days before faid fecond Tuefday of faid July shall be a legal Warning of the Freemen of faid City to attend faid first Meeting, and the annual Officers chofen at faid Meeting fhall continue in Office until the Expiration of next January, unless others are fooner chofen and First meeting qualified in their stead. And the faid City fhall at fuch Meeting first choose a Clerk of faid City, who fhall be immediately fworn, and fhall forthwith make a Record of his being chofen and fworn; and the Record thus made by him in fuch Calc fhall be good and effectual, any Thing in this Act to the contrary notwithstanding; and fuch Record may be made by Clerks hereafter chofen of their being chosen and fworn and fhall be good and effectual, any Thing in this Act to the contrary notwithftanding; and faid City fhall thereupon proceed to choose a Mayor and the other Officers of faid City eligible by the Freemen thereof; and the Juftices of the Peace within and for the County of Hartford, living and inhabiting within the Limits of faid City and prefent at fuck firft Meeting. fhall have, as to the election of the Mayor, Aldermen, Sheriffs, Common Council-men and Clerk of faid City, the fame Powers and proceed in the fame Manner as Firft modera- the Mayor, Aldermen and Sheriffs of faid City by this A&t are to have and proceed in at the future Elections of faid City. And the fenior Juftice of the Peace within and for the County of Hartford, living within the Limits of faid City, prefent at said firft Meeting, fhall be Moderator thereof, until there fhall be a Mayor or Alderman chofen and qualified according to this Act; and faid City fhall when holden, at their firft Meeting appoint a Time and Place for holding the first Court of Common Council, which Court fhall have Power to adjourn frem Time to Time; and the firft City Court of faid City fhall be holden on the first Tuesday of Auguft next, at the TownHouse in faid City, and the City Courts of faid City may be holden in faid Town-Houfe from Time to Time, or in fuch other Place in faid City as faid City fhall provide and Judge proper.

37. 38. Always provided, That any Thing in this Act notwithstanding, the Inhabitants living within the Limits of faid City fhall to all Intents and Purposes be and remain a Part of the faid Town of Middletown.

33. Provided neverthelefs, That if this Act, or any of the Provifions therein contained, fhall be found inconvenient, or in Provifo. any respect inadequate, the fame on Representation of the City or otherwise, may be altered or revoked by the General Affembly.

40. Provided nevertheless, and it is hereby enacted, That the Provifo. Judges of faid City Court may, and they are hereby authorifed to hear, try and finally determine all Causes brought before the City Court by a Jury of fix Freemen, or without a Jury, where neither of the Parties defire to have a Caufe decided by a Jury, or by more than fix Jurors.

41. And this A&t fhall to all Intents and Purposes be a public Public A. A&t.

An Act in addition to an Act, entitled an Act, for incorporating a Part of the Town of Middletown.

E it enacted by the Governor and Council, and Houfe of

Power and Authority be, and hereby is granted unto the Court to the Courts
of Common Council for the City of Middletown, or the major of Common
Part of them, to make By-laws relative to the Mode of Taxation,
as to Taxes levied by faid City.

Provided, That fuch By-laws made by faid Court of Common
Council, fhall be approved by faid City, in legal Meeting allem-
bled; and after being fo approved fhall be publifhed at least three Provifo.
Weeks fucceffively, in fome public Newspape: in or near faid
City. And all fuch By-laws of faid City, made as aforefaid, fhall
at any Time after they are made, be liable to be repealed by any
Superior Court holden in the County of Middlefex, if by fuch
Superior Court, on hearing judged to be unreasonable or unjuft.

all Freemen of this State, Inhabitants of said New-Haven, dwel-
ling and inhabiting within the following Bounds, viz. Beginning porated.
at the North-East Corner of the Long-Bridge (fo called) in said
New-Haven, and running on the North-Side of faid Bridge and
the Highway, fo as to take in faid Bridge and Highway to the
North-Eaft Corner of the Neck-Bridge; then a-crofs the fame on

Bridge; then in a direct Line Weftward to the Bridge a-crofs City.

2. And whereas there are many Perfons living within faid Limits, who by Law are qualified to be Freemen of this State, that have not taken the Oath provided by Law to be taken by Freemen.

Be it enacted, That all fuch Perfons, living within faid Limits, who fhall, before the fecond Monday of February next, procure the major Part of the Select-men of faid Town of New-Haven, to certify that they are qualified to be admitted and made free of this ring a certifi- State, and fhall after procuring fuch Certificate, take before fome cate, &c. to be Affiftant of this State, or Juftice of Peace within and for the ftate and city. County of New-Haven, the Oaths provided by Law for Freemen, fhall to all the Purposes in this Act mentioned, be confidered as Freemen of this State, and Freemen of the faid City of New-Ha
