6. Every Thousand of ten penny Nails fhall weigh not more than thirteen Pounds, and each Nail fhall not be less in Length than two Inches and one half.

7. Every Thouland of twelve penny Nails fhall weigh not more than fixteen Pounds, and each Nail fhall measure in Length not lefs than three Inches.

8. Every Thousand of twenty penny Nails fhall weigh not more than twenty Pounds, and each Nail fhall measure not lefs in Length than three Inches and one quarter.

9. Every Thoufand of twenty-four penny Nails fhall weigh not more than thirty Pounds, and each Nail fhall be made with a flat Point, and shall Measure in Length not less than four Inches and an half.

10. Be it enacted, That the Civil Authority and Select-men of ty and felect each Town where Nails are, or fhall be made, for Sale as aforefaid, men authori- be and are hereby authorized, and required fometime in the Month zed to appoint of January annually, to appoint fome fuitable Perfon or Perfons infpectors of to be Inspector, or Infpectors of Nails within fuch Towns, who nails. fhall be worn by fome Affiftant or Juftice of the Peace in the fame County, to the faithful performance of his, or their Duty, according to the requirements of this Act; and fhall receive as Fees, from the Owner of fuch Nails Thirteen Cents for every Cask of Nails fo infpected, and it fhall be the Duty of every Inspector of Nails, appointed as aforefaid, carefully to infpect every Cafk of Nails, made for Sale or Exportation in fuch Town or Place, and if he fhall find the fame are made conformable to the Affize, and Quality herein before directed, he fhall brand the fame with the Cafks of nails Letters A. P. and the Weight per Thoufand, and the Name of the how branded. Town or Place where he infpects the faid Nails, and the Infpectors Naine fhall be at Large on one Head of the Cafk, containing

11. Be it further enacted, That if any Inspector, or Inspectors of Nails appointed and fworn as aforefaid, fhall be guilty of any. Neglect or Fraud in inpecting Nails, contrary to the true Intent and Meaning of this Act, or fhall mark with their refpective Brands, or Stamps any Cafks containing Nails made for Sale, which he, or they have not actually and thoroughly inspected, he or they fhall forfeit and pay Fourteen Dollars for every Cafk of Nails, fo falfely marked or branded, to be recovered by Action of Debt in any Court of Record proper to try the fame, by any Perfon who fhall fue, and profecu.e therefor, and every Cafk, Parcel, and Quantity of Nails that fhall be offered for Sale, or Exportation after the first Day of January next, and which fhall have been wrought or made after that Day, which fhall not have been infpected, and the Cafks branded as aforefaid, fhall be forfeited; one half of fuch Forfeiture, fhall accrue to the Perfon, or Persons, who fhall feize the fame, by virtue of a Warrant to be issued by fome Affiftant, or Juftice of the Peace, on proper information for that Purpofe, and the other Half to the Town Treasury of the Town where fuch Nails may be found.

12. Be it further enacted, That if any Perfon, or Perfons fhall Penalty for knowingly put into any Cafk, after the fame has been infpected putting nails and branded as aforefaid, any Nails which have not been examined, and approved by the Infpector, or Infpectors of the Town branded. where fuch Nails were manufactured, and fhall expose them to Sale, contrary to the true Intent and Meaning of this Aft, he or they fhall for every fuch Offence, forfeit and pay double the value of every fuch Cafk, or Quantity of Nails to be recovered and appropriated as aforefaid.

13. And be it further enacted, That every Thoufand of Nails fhall be computed not lefs than Five Score to the Hundred, and all Nails which may be manufactured for Sale, or Exportation as aforefaid, shall be made of Iron of a fuitable and good quality well wrought and rofe headed.

14. And be it further enacted, That if any Manufacturer of Nails fhall prefume to fell any Nails of either of the denominations Penalty for afore-mentioned not being of the Quality, and Affize required by felling nails this A&t, he fhall for every Thoufand of Nails fo fold forfeit, and contrary to provisions of pay One Dollar, and in the fame proportion for any lefs Quantity, this act. to be fued for and recovered to the Ufe of the Profecutor, in any Court proper to try the fame.

15. Be it further enacted, That nothing in this Act fhall be confidered as controuling the Manufacture, and Sale of Nails, cut or made from cold Iron: any thing herein to the contrary notwithftanding.

B E it enacted by the Governor and Council, and Houfe of Reprefentatives, in General Court affembled, That New-Gate prifen confti the Cavern in the Copper Mines in Granby, belonging to tuted. this State, which has heretofore been used as a public Gaol and Work-Houfe, fhall be conftituted and made a public Gaol and Work-Houfe, for the Use of this State, and fhall be kept and maintained in good and fufficient Repair, at the Expence of this State, and fhall be called New-Gate Prifon.

2. Be it further enacted, That there fhall be erected and kept in repair over faid Cavern, a Prison-Houfe, fit and proper to keep fuch Prison-house Prisoners in as may be committed to faid New-Gate Prifon, when over the they are fick, and when brought up for the purpose of being put to fuch Labour, as may be ordered by the keeper of faid Prifon, and that fuch Houfe fhall be fo conftructed as to form a DwellingHoule for the Keeper of faid Prifon, that the faid Prifon-Houle fhall be inclofed with a Piquet fo extenfive, as that there may be built therein, proper Buildings or Apartments, for the Prifoners to labour in, at the Difcretion of the Overseers.

3. Be it further enacted, That there fhall be three Overfeers of Overfeers and faid Gaol and Work-Houfe, appointed from Time to Time by the their powers. General Affembly, as there may be occafion, who are authorised

and empowered to appoint a Mafter or Keeper of faid Prifon, as often as fhall be necellary. Which Keeper fhall be fubject to be removed at the pleasure of faid Overfeers; and that faid Master or Keeper fhall be affifted, with fuch Number of Men, not exceeding ten, as fhall be ordered by faid Overfeers, in safe-guarding faid Prifoners and keeping them at hard Labour.

4. Be it further enacted, That the Mafter or Keeper of faid Gaol and Work-Houfe, fhall receive into the fame all fuch Perfons as shall be sent there by Warrant from lawful Authority, and fhall keep them to fuch Labour as they fhall be capable of doing, and as fhall be directed by faid Overseers for fuch Time as they fhall be fentenced to remain therein, and may confine them at their Labour, or punish them by putting Fetters and Shackles upon them, and by moderate whipping, not exceeding ten Stripes for any one Offence, which Punifliment may be inflicted in cafe they be stubborn or diforderly, or do not well and faithfully perform their Tafk, as they fhall be reafonably required, or in cafe they fhall not fubmit to fuch Rules and Orders, as fhall be from Time to Time established for the well ordering and governing the fame.

5. And faid Mafter or Keeper fhall, whenever required by_faid Overfeers render his Account to them of the Labour and Earnings of fuch Prifoners, and for the materials which he fhall receive to be wrought by faid Prifoners, or any Perfons employed with them, and pay and deliver to faid Overfeers the Amounts thereof.

6. Be it further enacted, That faid Overfeers for the Time being, fhall provide for fuch Prifoners, neceffary and fuitable Food Overfeers to and Cloathing: and alfo fuch Tools, Implements and Materials provide for the prifoners. as fhall be proper for employing and keeping fuch Pritoners to work and fhall alfo provide for the relief of any fick or weak Prifoner, and fhall be paid for the fame, out of the Earnings of faid Prifoners, if the fame be fufficient, and if not, the furplus fhall be paid out of the Treafury of the State. And the faid Overfeers fhall keep true Accounts of their Conduct herein, and shall annually in May, fettle and adjust faid Accounts with the Comptroller of this State, or with fuch other Perfon or Perfons as the General Affembly may from Time to Time appoint for that Purpofc, and oftener if they fhall be thereto required. And said Overfeers fhall and may make all neceffary Rules and Orders for governing and punishing fuch Perfons as may be committed to faid Gaol; and fuch Rules and Orders fhall be of force, and fhall be duly executed.

7. Be it further enacted, That the Overfeers of faid Prifon for To make rules the Time being, be, and they hereby are authorized and directed for governing to make fuch Rules and Regulations for the Government and the guard, Punishment of the Guard as they fhall judge proper: Provided, That no Punishment fhall be inflicted on any of them, by force of fuch Regulations, except amercement, and to an Amount not exceeding three Months Wages, and their Cloathing fupplied by the State and alfo to make fuch Rules and Regulations, relative to Spectators and others who may be admitted within the Piquets

8. Be it further enacted, That fuch Overfeers and the Mafter of Compenfation faid Gaol and Work-Houfe, and the Perfons employed to affift faid Master shall be allowed for their Labour and Service, fuch Mafter, &c. rewards as faid Affembly fhall appoint.

9. Be it further enacted, That the Fees to the Sheriffs for committing one Person to faid Prison, shall be Thirty Four Cents per forcommitting Mile, for their Travel out, and for each additional Perfon, committed at the fame Time Seventeen Cents per Mile, in lieu of all other Fees and Expences.

Be it further enacted, That at the expiration of the Term of confinement for which any Prifoner is, or fhall be fentenced to In what cafes, New-Gate Prifon, if it appear by the Warrant of Commitment, overfeers may that he is ordered to stand committed until the Coft be paid, and affign prifoners fuch Prifoner fhall not be able to pay the Coft, or to fecure the fame, to the acceptance of the Overfeers of faid Prison, in such costs, Cafe, the Overfeers are hereby authorized and empowered to affign fuch Prisoner in Service, to fome Inhabitant of this State, or of any of the United States, for fuch Term as they fhall judge neceffary,to pay fuch Coft, taking reasonable fecurity of fuch Inhabitant to pay the fame to the State; but if no fuitable Perfon appear to take in Service such Prisoner the Overseers may direct the Mafter of the Prison to hold him in Service, within faid Prison: and Or direct the for fuch Term as may be limited by the Overfeers to pay fuch mafter to hold Coft; who are directed to allow fuch Prifoner, cuftomary Journeyman's Wages for like Services; and the Mafter of the Prifon fhall have Power to confine fuch Prifoner at his Labour, fo far as the fafe keeping of the Prisoners in general may demand. But if fuch Prifoner fhall be unable to Labour, the Overseers, first taking the best Security for the Coft, that may be obtained, fhall order the Mafter to discharge him.

Be it further enacted, That if any Prisoner fhall make his efcape from said Prison and shall be retaken, and recommitted, the neceffary Expence of purfuit, and re-commitment, to be allowed Prisoners, that by the Overfeers, fhall be paid and fatisfied, by fuch Prifoner, as efcape, and is herein provided, for the payment of original Bills of Coft, taxed by the Court; and the Overfeers fhall difpofe of fuch Prisoner accordingly; and in every cafe of re-commitment, the Time elapfed between the escape and re-commitment, fhall not be computed as Part of the Term of Imprifonment for which fuch Prifoner is fentenced,

An Act to prevent unfeasonable Night-walking; and for punishing Disorders committed in the Night-season.

PAR. 1. BE it enacted by the Governor and Council, and Houfe of Reprefentatives, in General Court affembled, That if any Perfons that are under the Government of Parents, Guardians or Mafters; or any Boarders or Sojourners fhall convene or meet together, or be entertained in any Houle without the confent or approbation of their Parents, Guardians, Mafters or Governors, after nine of the Clock at Night, any longer than to difcharge the Bufinefs they are fent about; or shall meet together and affociate themselves in Company or Companies in Streets or elsewhere, after the Time aforefaid; or fhall make any Rout, or commit any Disorder at any Time in the Night season, each Perfon fo offending fhall forfeit One Dollar for fuch Offence.

2. And the Head of the Family that entertains or tolerates fuch diforderly Meeting in his or her House, shall forfeit the like Sum; one Half of which Forfeitures fhall be to the Complainer, the the fame pen- other Half to the Treafury of the Town where the Offence is alties for entertaining, &c. committed.

Be it further enacted, That when and so often as any Disorders mitted in the and Damages are done in the Night-feafon, that upon Complaint night-feafon. fpeedily made thereof to any Court, Affiftant, or Juftice of the Peace, they are hereby empowered to iffue forth a Writ or Writs for the bringing before him or them any fufpected Perfon or Perfons, and examine him or them concerning fuch Disorders and Damages.
