a black Staff, having a Head with the Arms of this State thereon; which Staff he fhall carry upon Proper Occafions, as a Token or Badge of his Office; which the Select-men of each Town are to take Care to provide at the Town's Charge; upon Penalty of Eighty-four Cents for every Month's Neglect; one Half to be to him or them that fhall profecute for the lame, and the other Half to the Town Treasury.

16. And in Cafe any Town, by the Death or Removal of the Conftable or Conftables thereof, fhall become wholly deftitute of fuch Officers; fuch Town fhall forth with affemble, and proceed to the Choice of a Conftable or Conftables, to fupply the Vacancy fo made: who shall be sworn according to Law.

An Act to prevent the Importation of Convicts. [ENACTED IN OCTOBER 1788.]

E it enacted by the Governor and Council, and Houfe of Reprefentatives, in General Court affembled, That no Person convicted of any Crime, in any foreign Country, and fentenced therefor to be transported abroad, fhall be imported into this State; and that any Perfon or Perfons who fhall, contrary to the true Intent and Meaning of this Act, import, or bring into this State any fuch Convict; or be aiding or affifting therein, knowing fuch Perfon fo imported to be a Convict, and fentenced as aforefaid, fhall forfeit and pay to the Treasurer of this State, the Sum of Three Hundred and Thirty-Four Dollars, for every fuch Convict, fo imported as aforefaid. And whenever any Perfon or Perfons fhall be profecuted for any Breach of this Act, fuch Perfon fhall be adjudged guilty of the fame, unless they fhall make full Proof that they had lawful Right to import the fame; and that fuch Importation was not contrary to the true Intent and Meaning of this A&.

2. And it is hereby made the Duty of the feveral State's Attorneys, and of the Grand-Jurors in this State, to make Information and Prefentment of all Breaches of this A&t.

An Act to prohibit the coining of Copper, without Permission first had and obtained of the General-Affembly.

[ENACTED IN OCTOBER 1785.]

BE it enacted by the Governor and Council, and Houfe of Repre

fentatives, in General Court affembled, That no Perfon whatever fhall coin, or manufacture any Copper Coin of any Defcription or Size, without Permiffion firft had and obtained from the General Affembly, on Pain of forfeiting for each Offence the Sum of Three Hundred and Thirty-Four Dollars: which Forfeiture fhall be, if fued for by a private Perfon, one Moiety thereof to the ufe of the Perfon profecuting to effect, and the other Moiety

thereof to the Treasurer of this State, to and for the Ufe of this State; and fhall be recoverable by Action of Debt, or Information before any Court proper to try the fame.

An Act to prevent paffing counterfeit Bills of Credit, Coins or Currencies, and emitting and paffing Bills on private Credit; and to prevent Injustice by paffing counterfeit Bills, or Coins.

PAR. 1. BE it enacted by the Governor and Council, and Houfe of Reprefentatives, in General Court affembled, That

when and so often as it fhall happen, that any falfe, forged, alter- Treasurer to ed, or counterfeit Bill made in Imitation of, or purporting to be, fecure coun a Bill of Public Credit emitted by Authority of this State, or of terfeit bills, any one of the United States, fhall be brought to the Treasurer &c. of this State, or offered to him in the Payment of Rates, or to be exchanged, he fhall fecure fuch Bill; and he is hereby authorifed to feize and retain the fame, entering on the Back thereof the Name of the Perfon, in whofe Poffeffion it was; and then deliver the fame into the Hands of fome Authority, to be enquired into.

2. And every Affiftant or Juftice of the Peace is hereby authorized and empowered, to Seize and Take into his Cuftody, every fuch falfe Bill which he fhall See, obferve, or have Knowledge of, Affistant or juftice may and the Same to retain, entering on the Backfide thereof, the feize counter Name of the Perfon from whom he takes the Same; and at his feits, &c. Discretion to Cause the Perfon from whom he took fuch Bill, or the Perfon from whom the Treasurer took fuch Bill, and lodged with him, to be examined in the Premifes; and to adminifter an Oath to fuch Perfon or Perfons to declare of whom he or they received it; and thereon to proceed in his Enquiries, in the manner aforefaid, after the Author of the Mischief, as far as fuch Authority's Difcretion fhall guide him.

3. Be it further enacted, That whenever any Perfon fhall be the Poffeffor of any fuch falfe or counterfeit Bill (on, his discovering it to be fuch) he fhall deliver the fame to fome Affiftant or Juftice what method of the Peace; and inform him that he concludeth the fame to be to take. false, and counterfeit; and if fuch Affiftant or Juftice fhall fuppose the fame to be false as aforefaid, he fhall take the fame, and write the Name of the Perfon of whom he received it, on the back. of said Bill; and that it was delivered him as a counterfeit Bill.

4. And fuch Perfons that fo deliver up fuch Bill, or from whom fuch Bill is taken, in either of the Methods aforelaid, may after May demand fuch Delivery or taking go to the Perion of whom he received the payment of, fame, and demand of him Pay therefor, informing him where fuch Bill is lodged.

5. And if any Person of whom he received faid Bill, fhall refufe or neglect to make him Satisfaction therefor; or without fuch Demand, Information or Refufal, (if need fo require) may bring

his Action for Damage, in not paying him for faid Bill, or for putting off fuch Bill to him, before any Court, Afliftant or Juftice of the Peace, proper to try the fame; alledging the fame to be taken or delivered up as aforefaid.

6. And in the Trial of any fuch Cafe, if the Bill be found to be falfe, forged or counterfeit, to the Satisfaction of the Court that tries the fame, the faid Court fhall proceed to enquire into the Equity of the Cafe, by examining the Parties under Oath, and taking any other Evidences as they fhall judge juft and right: and upon their finding to their Satisfaction, that fuch Plaintiff received the fame Bill of the Defendant for a true Bill, they fhall give Judgment for the Plaintiff, for his juft Damages and Coft.

Provided always, Such Bill be delivered up or taken, as aforefaid, before the Plaintiff offered the fame back to the Perfon of whom he received it.

Provided alfo, That no Perfon be profecuted in Form as aforefaid, but within one Year after he puts off fuch Bill; which Fact may be enquired into in Form aforefaid.

7. Be it further enacted, That all and every Perfon that hath at any time had any fuch Bill that shall be taken from the Poffeffor, The remedy or fhall by the Poffeffor be delivered up, as aforefaid, and hath faextended, &c. tisfied the Perfon to whom he put off faid Bill, for the fame, fhalk have the like Liberty in profecuting, and taking remedy, as aforefaid, against the Perfon of whom he received the fame.

8. And that every Affiftant or Juftice, that fhall have fuch Bill in his Hands, fhall at the Coft of the Party, fafely convey the Rill conveyed fame to any Court where the fame may be wanted in the Trial of to Court, &c. the Cafe.

9. And that if any Court, Affiftant or Juftice hath had the poffeffion of fuch false or counterfeit Bill, the space of one Year, he fhall deftroy the fame.

10.
