[ENACTED IN OCTOBER 1795.]

Provided nevertheless, That no Perfon fhall in Virtue of fuch Provifo. Grant be confidered as intitled to the Rights of a free Citizen of this State, or as acquiring a Right of Inhabitancy in that Town. within which the City granting fuch Freedom lies..

fhall and may be lawful, for all and every Town, Trustees for Communities Schools, Proprietors of common and undivided Lands, Grants, how to fue &c. and other Eftates and Intereft, and all other lawful Societies or Communities whatever, to fue, commence and profecute any Suits or Actions, for the maintaining, recovery, or defence of their Grants, Interefts and Eftates, in any Court proper to try the fame; and to appear either by Themfelves, Agents, or Attornies; and in like Manner to defend in all Suits and Actions, as fhall be brought or commenced against them.

2. And when any fuch Town, Trustees, Proprietors, or Society as aforefaid, fhall be fued, it fhall be fufficient Notice for them to appear and anfwer, to leave a true and attefted Copy of the Writ or Summons, containing fuch Suit or Action, with their Clerk, or either of the Select-men or Committee-men, twelve Days before the fitting of the Court where the cafe is to be heard; as in other Actions is provided.

An Act for inftituting, defining and regulating the Of-
fice of Comptroller of the Public Accounts,

[ENACTED IN MAY 1788.]

PAR. 1. BE it enailed by the Governor and Council, and Houfe of

Reprefentatives, in General Court affembled, That there fhall be annually appointed by the General Assembly, a Comptroller of all public Accounts of this State, with Power to appoint from Time to Time, one Clerk, or more if neceflary, to affift him in his Office and duty.

2. That the faid Comptroller fhall have Power to fuperintend, all Matters that refpect the Subject of the Finances of the State, and fhall advife as to the Mode of keeping, ftating, adjufting, and liquidating the Public Accounts, fubject to the Controul and Order of the General Affembly; and fhall take fuitable Care, that the regular and neceffary Checks, in the Mole of keeping Accounts, be inflituted and maintained, and lay before the Legiflature, at the opening ofeach Seffions, fuch Plans, and Calculations, as in his Opinion may be expedient for leffening the Public Expenfes, for using and improving the Public Monies to the beft advantage for promoting Frugality and Oeconomy in the Public Expenditures, for fupporting the Credit of the State, and in general, for the well Ordering, and regulating the Business of his Department.

3. And it fhafl, in particular, be the Duty of fuch Comptroller, from Time to Time diligently to examine and state the Amount

4. Further it fhall be the Duty of fuch Comptroller, to exhib

Time to Time, will admit, and a regular Statement thereof lay before the General Affembly at their Seffions in May annually.

7. And be it further enacted, That no Orders hereafter to be drawn upon the Treasurer, fhall be paid, until the fame shall be entered on the Comptroller's Books, and a Certificate of fuch Entry shall by him be endorsed on such Orders.

8. This A&t to continue and be in force two Years, from, and after the Rifing of this Aflembly.

[This Statute was paffed in May, 1788, and has ever since been continued in operation by fpecial Acts of Affembly.

An Act relating to Conftables.

E it enacted by the Governor and Council, and Houfe of

PAR. 1. Conftables in each Town in this State, fhall be yearly chofen to that Office; and fworn by fome Affiftant or Juftice of the Peace; yearly chofen or where there are no fuch Authority in any Town, by the Town Clerk of that Town, before the fift Day of January in each Year.

2. And that one, and but one Conftable, fhall be appointed by cach Town, tolevy and gather their State Taxes, and make up their Accounts thereof with the Treasurer.

3. That every Conftable shall duly receive all Hue-and-cries; and the fame diligently purfue to full Effect; fuch as are granted and fent out after Capital or Criminal Offenders, at the Coft and Charge of this State; but fuch as are taken out by particular Perfons in their own Cafes, at the Coft and Charge of those who take them out.

4. That every Conftable within this State, is hereby authorized, When to pur- and fully empowered, to put forth Purfuits or Huc-and-cries after fue murderers Murderers, Peace-breakers, Thieves, Robbers, Burglarians, and &c. without other Capital Offenders, where no Magiftrate or Juftice of the

warrant.

5. As alfo without Warrant, to apprehend fuch as are guilty of Allo fabbath Drunkennefs, profane Swearing, Sabbath-breaking, alfo vagrant, breakers, &c. Perfons, unfealonable Night-walkers, or any others that fall of

6. or commanded by any Affiftant or Juftice of the Peace, to appre-
hend or arrest
any Perfon or Perfons, he fhall not do it without a

10. Be it further enacted, That all Conftables may, and from
Time to Time fhall, make diligent Search throughout the Limits
of their Town, upon the Lord's-Days, and on all other Times, (as
oft as they fhall be informed, or fee Caufe,) for fuch Offenders as
fhall lie Tippling in any Inn, or Houfe of Entertainment, or pri-
vate Houfe, exceffively, or unfeasonably; and after fuch as retail
ftrong Drink without Licence: And alfo warn all those that fre-
quent Taverns, and spend their time there idly, to forbear: And
also warn all thole Perfons that keep fuch Houses, not to suffer
any fuch Perfons in their Houfes. And to make duc Prefent-
ment of all Breaches of Law (coming within their Knowledge
to fome Authority proper to receive the fame, once in every
Month.

11. And if upon due Information, any Conftable shall refuse or neglect to make fuch Search, Seizure and Presentment, and be Penalty for thereof legally convicted, he shall pay a Fine of Eighty-four Cents refuting, &c. to the Treafury of the Town whereto he belongs.

And be it further enacted, That if any Perfon fhall refufe at Time to affift Conftable in the Execution of his Office, not affifting a Penalty for being by him duly thereunto required, he shall forfeit One Dollar conftable, &c, and Sixty-Seven Cents.

13. And if it appear that any Perfon fhall wilfully, obftinately, Obftinate reor contemptuously refufe to affift fuch Conftable, as is before ex- fusal, penalty preffed, he fhall forfeit and pay to the Ufe of the Town where 7 dol. the Offence is committed, Seven Dollars; the faid Offence to be heard and tried by any Affiftant or Juftice of the Peace.
