Sum of 3s. 4d. for every fuch Offence, to be levied and recovered as hereafter mentioned: And also that no Perfon fhall pick or fift any Dirt, Duft, or Ashes, in any Street, Lane, or publick Way within the faid City, Suburbs, or Liberty aforefaid, on Pain of forfeiting the like Sum for every fuch Offence, to be levied and recovered in like Manner: And that no Carriages not to remain longer Waggon, Cart, or other Carriage, fhall in the Streets remain longer in any fuch Street, Lane, than neceffary, or publick Way, than whilft the fame can be conveniently loaded or unloaded, and not after it is dark, nor without fome Perfon able to guide the Horfes drawing the fame, nor fo as to obftruct or hinder other Carriages from fafely paffing by the fame: And that no Coach, Chaise, Cart, Waggon, or other Carriage, or any Part thereof, fhall be fet in any fuch Street, Lane, or publick Way to make or mend; and that no empty Coach or Chaife shall remain longer in any fuch Street, Lane, or publick Way, than whilft the fame is in Waiting for Company, nor without fome Perfon able to guide the Horfes drawing the fame: And that no Perfon fhall turn out or drive, or caufe to be turned out or driven, any Horfe or Horfes loofe and unguided into or in any fuch Street, Lane, or publick Way: And that no Driver of any Coach, Chaife, Waggon, Cart, or other Wheel Carriage or Dray, nor any Perfon or Perfons riding or leading any Horfe or Horfes, fhall, without Neceffity, drive, ride, or lead the fame upon the FlagStones defigned for Foot-Paffengers, or fo near the Houfes in any of the faid Streets, Lanes, or publick Ways, that Foot Paffengers cannot fafely pafs by the fame, on Pain that any Driver of any fuch Coach, Chaife, Cart, Waggon, or other Carriage,

or any Coach-maker, Wheel-wright, or other Perfon, who fhall, by Act or wilful Default, offend in the Premifes, shall for

feit and pay the Sum of 5s. for each Of On Penalty of fence, to be levied and recovered as here- 5 so

after mentioned.

Pavements in

And for the keeping the Pavements of Occupiers of the faid City, Suburbs, and Liberty, in Houfes and good Repair and Order, Be it further en- Tenements to acted by the Authority aforefaid, That all keep their and every Occupier or Occupiers of any Houfe, Building, Garden, or Grounds, Repair. adjoining to any Street, Lane, or publick Way within the City, Suburbs, or Liberty aforefaid, and the Owner or Owners of any fuch House, Building, Garden, or Grounds, being empty, or untenanted or unoccupied, refpectively, and the Churchwardens of each of the Parish Churches within the faid City, and the Owners, Governors, Directors, Wardens, or Managers of all Meeting-Houfes, Halls, or publick Buildings, within the City, Suburbs, and Liberty aforefaid, fhall, before the 29th Day of September, 1763, put into good and fufficient Repair, and from thenceforth keep well and fufficiently repaired, all the Pavements within the faid City, Suburbs, and Liberty, which, by Tenure, Ufage, or otherwife, ought to be by them refpectively repaired and maintained: And alfo that the Mayor and Commonalty of the faid City, and the faid Dean and Chapter, and the faid Sub-Chanter and Vicars Choral of the faid Liberty, refpectively, fhall, before the 29th Day of September, 1763, caufe all the Pavements within the faid City, Suburbs, and Liberty, which, by Tenure, Ufage, or otherwife, ought to be repaired and maintained at the Charges of the faid Mayor and Commonalty, Dean and Chapter, Sub-Chanter, and Vicars Choral, refpectively, to be put into like

good and fufficient Repair, and from thenceforth to be kept well and fufficiently repaired: And that when any Pavement in the faid City, Suburbs, or Liberty, fhall be laid anew, or repaired, the fame fhall be laid upon a Level with the adjoining Pavements on each Side thereof, and with a fufficient Slope for the Water to run off towards the Channel; and in Cafe any fuch Occupiers or Owners, Churchwardens, Governors, Directors, or Managers as aforefaid, fhall neglect to repair and make good fuch Pavements in Manner aforefaid, for the Space of ten Days after Notice given thereof to the Perfon or Perfons, Body Politick or Corporate, who ought to maintain fuch Pavement, (which Notice the Mayor, or any Juftice of the Peace of the faid City, or any Juftice of the Peace for the faid Liberty, or the Surveyors to be nominated or appointed as hereafter mentioned, or any of them, are or is hereby required to give, or caufe to be given) then the Surveyors of the refpective Parishes and Places wherein fuch Neglect or Default fhall be, or any two or more Juftices of the Peace within whofe Jurifdiction fuch Pavements fhall lie, fhall and may, and they are hereby authorized and required to order and appoint fuch Perfon or Perfons, as they respectively fhall think fit, effectually to repair and make good the fame, or caufe the same to be fo repaired and made good, at the Charges of fuch Occupier or Occupiers, Owner or Owners, Churchwardens, Governors, Directors, or Managers, refpectively, who is or are refpectively liable by Law to repair and make good the fame : And in Cafe any fuch Perfon or Perfons, fo liable, fhall refufe to pay the Charges of fuch Paving or Repairing as aforefaid upon Demand, any two or more fuch Ju

ftices fhall and may, and are hereby authorized and required, by Warrant under their Hands and Seals, to levy and raise, by Diftrefs and Sale of the Goods and Chattels of the Perfon or Perfons fo refufing, fuch Sum of Money as will answer and pay the Charges and Expences of fuch Paving and Repairing as aforefaid, and alfo the Charges and Expences attending fuch Distress and Sale, leaving the Overplus in the Hands of the Conftable for the Ufe of the Owner or Owners of fuch Goods and Chattels : And in Cafe of fuch Default in the faid Mayor and Commonalty, Dean and Chapter, or Sub-Chanter and Vicars Choral, refpectively, fuch Penalty fhall be paid by and levied upon their feveral Officer or Agent, called the City Steward, or Receivers of the faid Dean and Chapter, Sub-Chanter, and Vicars Choral.

And it is hereby further enacted, That Pavements when any Pavement in the faid City, Sub-taken up for urbs, or Liberty, fhall be taken up for laying Pipes, to the Purpose of laying, fixing, or repair- be well paved ing, any Pipe or Pipes under the fame, for conveying Water from the WaterWorks in the faid City to any House or Building, the Pavement fo taken up fhall, within one Day after fuch Pipe or Pipes is or are fo laid, fixed, or repaired, be well and fufficiently renewed and made firm and level with the rest of fuch Pavement, to the Satisfaction of the Perfon or Perfons, Body Politick or Corporate, who fhall by Law be bound to keep fuch Pavement in Repair; and in the mean-time, untill the fame is repaired, the Owner, Agent, or Manager of fuch Water-Works, fhall, at his own Charges, fix up a fufficient Light fo near the Place fo dug up, that the fame may be diftin&tly feen, and fhall continue fuch Light from Sun-fet to VOL. Sun-rifing, on Pain that fuch Owner, On Penalty of Agent, or Manager of fuch Water-Works zos. for each fhall forfeit and pay the Sum of 10s. for Neglect. every Neglect or Default in not fo repairing any Pavement fo dug up, or not fixing up and continuing fuch Light as aforefaid, to be levied and recovered as hereafter mentioned.

Causeways in

Provided always, That it fhall and may the Suburbs be lawful for the faid Mayor and Commay be thrown up and covered monalty to caufe any of the Roads in the with Gravel. Suburbs of the faid City, which they fo ought to repair as aforefaid, to be thrown up and covered with Stone and Gravel in the Manner of Turnpike Roads, fo as fuch Roads be kept conftantly well covered with good Gravel, and in good Order and Condition, on the Penalty aforefaid.

Wheels of

Provided alfo, That nothing herein contained fhall extend to charge any Perfon or Body Corporate with the Repairs of any fuch Streets, or publick Paffages or Places, who or which is not by Law now chargeable with the Repairs thereof.

And it is hereby further enacted, That Waggons, &c. the Wheels of every Waggon, Cart, or to have Fellies other Carriage of the like Kind, kept or fix Inches wide. ufed for carrying Goods or other Things

for Hire, within the faid City, Suburbs, or Liberty; and the Wheels of every Waggon, Cart, or other fuch Carriage, in which Bricks, Tiles, Stones, or Gravel fhall be carried within the faid City, Suburbs, or Liberty; or in which Coals are carried from the River Ouse, or any CoalYards in the faid City, Suburbs, or Liberty, to be delivered in the fame City, Suburbs, or Liberty; and the Wheels of every Dray, Rully, or other Carriage of the like Conftruction, or ufed or to be used for the like Purposes as Rullies are now used for, and which fhall be drawn and ufed within the faid City or the Suburbs thereof, or Liberty
