An Act to amend an Act of the Thirty ninth and Fortieth
Year of His present Majesty, to prevent Frauds and Abuses
in the Trade of Hops.

WHEREAS by an Act made in the Thirty ninth and Fortieth 39 & 40 G. 3.

Year of the Reign of His prefent Majefty, intituled An c.81. Aa to repeal an A&, made in the Fourteenth Year of the Reign of His prefent Majefty, intituled An Ad to prevent Frauds in the buying and felling of Hops, and for the better Collection of the Duty on Hops; and to prevent Frauds and Abufes in the Trade of Hops, it is, among other things, enacted, that every Owner, Planter or Grower of Hops, before he shall begin to put any Hops into any Bag or Pocket, fhall mark or caufe to be marked, on the "Outfide thereof, his Name and Place of Abode: And Whereas

of every Bag or Pocket of Hops, the Name of the Parish and of
the County in which the Hops put into any fuch Bag or Pocket,
fhall be grown: And Whereas many Perfons not only mark their
⚫ own Names and the Parishes and Counties in which the Hops
⚫ were grown on fuch Bags or Pockets, but alfo in addition thereto
the Name and Symbol of other Counties, to the great Injury of
fuch Owners or Growers whofe Defcription they fo ufe, as well

Hops, before he, fhe or they fhall begin to put any Hops into any any Name or
Bag or Pocket, fhall mark or caused to be marked on the Outfide Place of Abode,
of each and every fuch Bag, in large plain and legible Letters, of
Four Inches in Length at the leaft, and Half an Inch in Breadth,
and on the Outfide of every fuch Pocket in large plain legible Letters
of Three Inches in Length and Half an Inch in Breadth at the least
with durable Ink or Paint, his, her or their Name or Names, and the
Parish and County in which the faid Hops, to be packed therein,
were actually grown; and if any Owner, Planter or Grower of Hops,
or any other Perfon or Perfons fhall put any Hops into any Bag or
Pocket, without having marked or caufed to be marked thereon in
manner hereinbefore directed, the feveral Matters and Things herein-
before required and prescribed, or fhall before or at any future time
after fuch Hops have been packed, or fhall† mark or cause to be
marked thereon the Name of any other Perfon, Parish or County,
than as is hereinbefore directed or prescribed, or the Symbol apper-
taining to, or any thing denoting to be the Symbol of any other
County or Place, every such Owner, Planter or Grower, or other
Perfon or Perfons fo offending, fhall, for every fuch Offence, forfeit
and pay the Sum of Twenty Pounds for every fuch Bag or Pocket,
to be recovered and applied in manner directed by the faid recited

II. And be it further enacted, That if any Owner, Planter or Grower of Hops fhall knowingly put or fuffer to be put any Hops of different Qualities and Value in the fame Bag or Pocket, every fuch Owner, Planter or Grower, fhall forfeit and pay the Sum of Twenty Pounds for every fuch Bag or Pocket, to be recovered and applied in manner before directed.

An Act to permit the Importation of Tobacco and Snuff into
the Port of Plymouth.

the Reign of His prefent Majefty King George the Third, intituled An Ad for repealing the Duties on Tobacco and Snuff, and for granting new Duties in lieu thereof, it was, amongst other things, enacted, that no Tobacco or Snuff whatever should be imported or • brought into any Part of Great Britain except the Ports of London, Bristol, Liverpool, Lancaster, Cowes, Falmouth, Whitehaven, Hull, Port Glasgow, Greenock and Leith, upon Pain of Forfeiture of all fuch Tobacco and Snuff refpectively as fhould be imported or · brought into any Part of Great Britain, except fome or one of the faid Ports hereinbefore enumerated, together with the Hogfheads, Cafks, Chefts, Cafes and other Packages refpectively con⚫taining fuch Tobacco or Snuff refpectively, and the Ship or Veffel in or on board which the fame fhould be fo imported or brought, together with her Guns, Furniture, Ammunition, Tackle and Ap. parel: And Whereas it is expedient to permit the Importation of Tobacco and Snuff into the Port of Plymouth;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from and after the Fifth Day of January One thoufand eight hundred and fifteen, nothing in the faid recited A&t fhall extend or be deemed or conftrued to extend to prevent the Importation of Tobacco and Snuff into the faid Port of Plymouth; but that it fhall and may be lawful to import Tobacco and Snuff into the Regulations of faid Port of Plymouth Provided always, that on the Importation of Tobacco and Snuff into the faid Port of Plymouth the fame fhall be fubject and liable to all and each and every the Rules, Regulations, Conditions, Reftrictions, Penalties and Forfeitures, to which Tobacco and Snuff are refpectively fubject and liable by virtue of the faid recited Act or any Act or Acts of Parliament in force on and immediately before the faid Fifth Day of January One thoufand eight hundred and fifteen, on being imported into any of the Ports particularly enumerated in the faid recited Act; and all and every the Claufes, Powers, Directions and Authorities in and by the faid recited Act and every other A&t and Acts of Parliament in force on and immediately before the faid Fifth Day of January One thousand eight hundred and fifteen, relating to Tobacco and Snuff imported into any of the said enumerated Ports fhall apply and be put in full Force and Execution with respect to Tobacco and Snuff imported into the faid Port of Plymouth, as fully and effectually to all Intents and Purposes as if the faid Claufes, Powers, Directions and Authorities, were particularly repeated and re-enacted in the Body of this

An Act to continue, until the End of the next Seffion of Parliament, an Act made in the Forty fixth Year of His prefent Majesty, for permitting the Importation of Mafts, Yards, Bowfprits and Timber, for Naval Purposes, from the British Colonies in North America. [23d July 1814.] THEREAS the Law hereinafter mentioned has by Experience been found useful and beneficial, and it is expedient that the fame fhould be further continued;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That an A& made in the Forty fixth Year of His prefent Majesty's Reign, intituled 46 G. 3. c. 117. An Act to permit until the First Day of January One thousand eight hundred and nine, the Importation of Mafts, Yards and Bowfprits, or of Timber fit for Naval Purposes, from the British Colonies in North America, Duty-free; which faid Act was by an Act paffed in the 52 G. 3. c.33. Fifty fecond Year of His Majefty's Reign laft continued until the Expiration of Six Months after the Conclufion of the War, fhall, from and after the Expiration of the faid Six Months, be, and the fame is hereby further continued, until the End of the next Seffion of Parliament.

Kingdom of Portugal.

WHEREAS by an Act of Parliament, paffed in the Eighth
Year of the Reign of His Majefty King George the First,
'intituled An AB for more equal paying, and better collecting certain
fmall Sums therein mentioned, for the Relief of fhipwrecked Mariners
and diflreffed Perfons (His Majefty's Subjects in the Kingdom of
Portugal, and for other pious and charitable Purposes ufually con-
tributed to by the Merchants trading to Portugal, certain Perfons
therein mentioned were authorized to levy fmall Sums of Money
by a Rate on the Freight and Tonnage of all Goods imported into
the Dominions of the King of Portugal in British and Irifb Veffels,
to be applied to the Support and Subfiftence of a Minifter of the
Gospel, to the Relief of fhipwrecked Mariners and diftreffed Per-
fons, His Majefty's Subjects, and for other pious, charitable and

public Ufes: And Whereas it is expedient to alter and amend the faid Act in as far as regards the Portuguese Dominions in South • America and their Dependencies, and to new regulate the fame ;' May it therefore please Your Majefty that it may be enacted; and be it enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from and after the First Day of January One thousand eight hundred and fifteen, it shall and may be lawful for the Conful General and Confuls for the time being, appointed for His Majefty's Subjects trading to, from or in the Portuguese Dominions in South America and their Dependencies, and for any Person or Perfons duly authorized by him or them refpectively, to recover and receive from all Masters or other Chief Officers or Commanders of all Ships and Veffels belonging in the Whole or in Part to any of His Majefty's Subjects which may enter any of the Ports or Places within or belonging to the faid Portuguese Dominions in South America, and their Dependencies, the following Sums in lieu of the Sums directed to be levied by the Portugal Contribution Act before mentioned, to be employed in the pious, charitable and public Ufes hereinafter mentioned; that is to fay, any Sum or Sums of Money in Addition to the Sums now collected by the faid Conful General and Confuls, or Perfon or Perfons authorized by him or them refpectively, for their Support and Maintenance, by virtue and Authority of His Majefty's Royal Letters Patent, as fhall not, together with the faid Sums collected under the Patent, exceed in the Aggregate One Half per Centum on the Value of all their refpective Cargoes, both Inwards and Outwards, laden or unladen, in any of the Ports or Places within the Dominions aforefaid; the Value of fuch Cargoes to be estimated in manner following; that is to fay, the Value of the Goods and Effects compofing the Inward Cargoes to be afcertained by the Pauta or Cuftom House Valuation at the refpective Cuftom Houses of the Ports or Places within the faid Dominions in South America and their Dependencies, at which fuch Ships or Veffels may unlade; and in cafes where no Valuation has been fixed, then by the Current Market Prices, exclufive of the Import Duty; the Value of the Goods and Effects compofing the Outward Cargoes to be eftimated by the Current Market Prices of the Articles compofing the fame at the Period of Shipment, exclufive of the Export Duties; and in cafe any Difference of Opinion should arife as to the faid Market Price, the fame fhall be determined and fixed by Two indifferent British Merchants refiding on the Place, One to be chofen and appointed by the faid Conful General or Confuls, or Perfon or Perfons authorized by him or them refpectively, and the other by the Master of the Veffel or the Confignee or Shipper of the Cargo; and in cafe the Two Perfons fo chofen fhall not agree and award the fame within Seven Days after fuch Appointment, then fuch Two Persons shall choose a Third Perfon, being alfo a British Merchant refiding on the Place, who shall decide and determine the faid Current Market Price within the Space of Three Days after his Appointment, unless it fhall be otherwife mutually agreed upon between the faid Conful General or Confuls, or Perfon or Perfons authorized by him or them refpectively, and the Confignee or Shipper of the Cargo; and fuch Sum shall be paid in either cafe as fhall be agreeable to this

II. Provided always, and be it further enacted, That Diamonds, Diamonds, Specie, Bullion and Precious Stones of all kinds, shall not be liable Specie, &c. not to any Duty under this Act; but are exprefsly excepted from and liable to Duty. fhall be free of all Contribution Charges.

III. And be it further enacted, That all Mafters, Commanders Manifefts of or other Chief Officers of all British Ships and Veffels trading to Cargoes deliveror from any of the Ports or Places in the Portuguese Dominions within a limited in South America and their Dependencies aforefaid, and unloading time. or delivering the Ship or Veffel, or any of the Cargo there, fhall, within Forty eight Hours after the Arrival of fuch Ship or Veffel, deliver to the Conful General or Confuls, or Perfon or Perfons authorized by him or them for that Purpofe refpectively, a true Manifeft in Writing upon Oath, specifying the Particulars of the whole Cargo of fuch Ship or Veffel, fo to be unloaded or delivered, or of fuch Part thereof as shall be unloaded or delivered there, and to whom configned; and likewife, Twenty four Hours before the faid Mafters, Commanders or other Chief Officers require the Outward Clearances or Paffports for their faid Ships or Vessels, they fhall deliver to the faid Conful General or Confuls, or Perfon or Perfons authorized by him or them for that Purpose refpectively, a true Manifeft in Writing upon Oath, specifying the Particulars of the whole Cargo of fuch Ship or Vessel laden there, or of fuch Part thereof as fhall have been laden or received on board fuch Ship or Veffel in the faid Port or Place, which Oaths the Conful General, Confuls, or Perfon or Perfons authorized by him or them refpectively, is and are hereby empowered and required to adminifter gratis upon Requeft.

IV. And be it further enacted, That all Bills of Lading of fuch Bills of Lading Ships and Veffels fhall fpecify to pay the faid Monies accordingly, to specify Conunder the Denomination of "Contribution as per Act of Parlia-tribution, as per ment," or to that Effect, and the Perfons paying the same shall be re-imbursed by the Perfons to whom the faid Goods and Merchandizes fhall be configned or who fhall receive the fame, or by their refpective Freighters; and in cafe the Mafter or Commander of fuch Mafter, &c. Ship or Veffel fhall neglect to specify the Payment of the faid anfwerable. Monies in the Bill or Bills of Lading as aforefaid, he shall be answer

able for the fame.

V. And be it further enacted, for the better fecuring and collecting the Payment of the faid Monies herein directed to be levied for the Purposes aforefaid, That the Conful General or Confuls for the time being within the Portuguese Dominions in South America and
