The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Whitley, from the committee on affairs of cities, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

The Senate bill (No. 552, Int. No. 514) entitled "An act to amend the Railroad Law, in relation to the ownership and operation of motor vehicles upon highways," having been announced for third reading, Mr. Truman moved that said bill be recommitted to the committee on public service with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading. The President put the question whether the Senate would agree to said motion and it was decided in the affirmative.

Mr. Thayer, from the committee on public service, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

The President presented the report of Central New York State Parks Commission, which was laid upon the table and ordered printed.

The Senate met pursuant to adjournment. Prayer by Rev. George Robins.

The journal of March 21st was read and approved.

Mr. Mastick introduced a bill (Int. No. 1511) entitled "An act to amend the Tax Law, in relation to imposing a tax to be paid by banks, banking associations, trust companies and other financial corporations," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on taxation and retrenchment.

Mr. Downing introduced a bill (Int. No. 1512) entitled "An act to amend the Education Law, in relation to length of service for purpose of retirement of employees of boards of education in certain cities," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public education.

Mr. Dick introduced a bill (Int. No. 1513) entitled "An act to amend the charter of the city of Rochester, in relation to the city court of such city," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Mr. Schackno introduced a bill (Int. No. 1514) entitled "An act to amend the New York city municipal court code, in relation to return of jury fees," which was read the first, and by unanimous consent was also read the second time, and referred to the committee on codes.

Mr. Knight introduced a bill (Int. No. 1515) entitled "An act to authorize the town board of the town of Java in the county of Wyoming to borrow money in the faith and credit of the town to pay the existing indebtedness of lighting districts numbers one and two of such town incurred for lighting the highways of such districts and providing for the levy and collection of taxes in each district of the amount so borrowed for the district with interest, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Mr. J. F. Williams introduced a bill (Int. No. 1516) entitled "An act making an appropriation for the restoration and rehabilitation of the Bennington battlefield," which was read the first time, and by unanimous consent was also read the second time. On motion of Mr. J. F. Williams, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading and referred to the committee on finance, retaining its place on order of third reading.

Mr. Westall introduced a bill (Int. No. 1517) entitled "An act to amend the State Departments Law, in relation to the retention in service of inspectors of motor vehicles who have been permanently injured in the peformance of duty," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Westall, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Mr. Byrne (by request) introduced a bill (Int. No. 1518) entitled "An act to authorize the replacing of the original canvasses of State elections for governor, lieutenant governor and the presidential electors for the period from seventeen hundred and seventy-five to nineteen hundred and ten inclusive, and making an appropriation therefor," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

The Assembly sent for concurrence a bill (No. 2090, Rec. No. 384) entitled "An act to amend the Highway Law, in relation to establishing a new state route," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Westall, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading.

Also, a bill (No. 1505, Rec. No. 385) entitled "An act to amend the Highway Law, in relation to licenses to operate motor vehicles,' which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (No. 1544, Rec. No. 386) entitled "An act to repeal section one hundred and sixty-seven-b of the Highway Law, relating to the cost of elimination of railroad grade crossings in connection with the construction or improvement of the federal aid highways," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (No. 1585, Rec. No. 387) entitled "An act to authorize the issuance and sale of village bonds by the village of Granville, Washington county, in the sum of sixty thousand dollars, to pay the cost of the construction of a sewer system and providing for the payment of such bonds, and to provide that such bonds shall not be a part of the debt limitation prescribed by section one hundred and thirty of the Village Law," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Brereton, and by unanimous consent, said bill was substituted for Senate bill (No. 1045, Ins. No. 942), now on the order of third reading.

Also, a bill (No. 1040, Rec. No. 388) entitled "An act authorizing the commissioner of jurors of the county of Kings to reinstate Robert Furey in the office of clerk from which position he was dismissed without charges," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (No. 1727, Rec. No. 389) entitled "An act to amend the Workmen's Compensation Law, in relation to loss of hearing in one ear," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Truman, and by unanimous consent, said bill was substituted for Senate bill (No. 1709, Int. No. 1107), now on the order of third reading.

Also, a bill (No. 1898, Rec. No. 390) entitled "An act to amend the Education Law, in relation to the establishment and maintenance of kindergartens in cities and school districts," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public education.

Also, a bill (No. 1780, Rec. No. 391) entitled "An act to amend chapter four hundred and fifty-two of the Laws of nineteen hundred and eight, entitled 'An act to supplement the general laws relating to the government of the city of Yonkers, and to revise and consolidate the local laws relating thereto,' in relation to the division of the city of Yonkers into wards," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on affairs of cities.

Also, a bill (No. 2107, Rec. No. 392) entitled "An act to amend the Code of Criminal Procedure, in relation to insane veterans of the World War," which was read the first time and by unanimous consent was also read the second time, and referred to the committee on codes.

Also, a bill (No. 1592, Rec. No. 393) entitled "An act to repeal chapter five hundred and twenty-nine of the Laws of eighteen hundred and seventy-one, chapter nineteen of the Laws of eighteen hundred and eighty-three, chapter two hundred and thirty-six of the Laws of nineteen hundred and eleven and chapter one hundred and forty-eight of the Laws of nineteen hundred and twenty-three, relating to the town of Oswegatchie, in Saint Lawrence county, its town hall, fair ground and Eel Weir park, and acts amendatory thereof and supplemental thereto," which was read the first time, and by unanimous consent was also read the second time.

No. 394) entitled "An act to amend the Judiciary Law, in relation to the salary of attendants of courts in the First Department of the Appellate Division of the Supreme Court," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Also, a bill (No. 2131, Rec. No. 395) entitled " An act to amend the Judiciary Law, in relation to the salaries of the employees of the Appellate Division of the Supreme Court in the First Judicial Department, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Also, a bill (No. 1182, Rec. No. 396) entitled "An act to amend the Education Law, in relation to the State Teachers' retirement fund for public school teachers," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public education.

No. 1202) entitled "An act to amend the Tax Law, in relation to the taxation of gasoline tanks and pumps," reported in favor of the passage of the same, which report was agreed to.

Mr. Hickey, from the committee on general laws, to which was referred the Assembly bill introduced by Mr. Cuvillier (No. 1500, Rec. No. 353) entitled "An act to confer jurisdiction on the Court of Claims to hear, try and determine the claim of Louis A. Cuvillier for counsel fees and expenses incurred by him in successfully defending a certain charge of criminal libel preferred against him before a magistrate of the county of New York, and render judgment therefor, reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Thompson, from the committee on conservation, to which was referred the Senate bill introduced by Mr. Thompson (No. 1638, Int. No. 1408) entitled "An act to amend the Conservation Law, in relation to the training of dogs," reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Thompson, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading. Mr. Thompson, from the committee on conservation, to which was referred the Senate bill introduced by Mr. Gates (No. 1683, Int. No. 1452) entitled "An act to amend the Conservation Law, in relation to the open season for taking of grouse or partridge," reported in favor of the passage of the same, which report was agreed to.
