A BILL relating to the appointment of officers for the collection of the customs, and to provide for their compensation.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, as follows:

SECTION. 1. For the collection district of New York, the President of the United States shall, by and with the advice and consent of the Senate, appoint a collector, naval officer, surveyor of the port, and an appraiser, who shall each receive an annual salary as follows, viz: The collector, eight thousand dollars; the naval officer, five thousand dollars; the surveyor of the port, five thousand dollars; and the appraiser, three thousand five hundred dollars. The Secretary of the Treasury shall appoint for said district an auditor, who shall receive an annual salary of four thousand dollars; and on the nomination of the collector, as many deputy collectors as he shall deem necessary for said collector, who shall each receive such annual salary, not exceeding three thousand dollars, as the Secretary of the Treasury shall direct. The Secretary of the Treasury shall appoint seven assistant appraisers for said district, at such annual salary, not exceeding three thousand dollars cach, as he shall direct, and a sufficient number of examiners in the appraiser's office at an annual salary of not exceeding two thousand dollars each; and shall also, on the nomination. of the naval officer and surveyor, respectively, appoint as many deputies for those officers as he shall deem necessary, who shall each receive such annual salary, not exceeding three thousand dollars, as he shall direct. He shall also, in like manner, on the nomination of the collector, appoint for said port a competent number of weighers, gaugers, and measurers, who shall receive an annual salary of not less than eighteen hundred nor more than two thousand dollars each; and such number of inspectors as shall be necessary for the business of said port, who shall each receive a sum not exceeding four dollars per day for their services. The collector. naval officer, surveyor of the port, and appraiser, shall employ, subject to the approval of the Secretary of the Treasury, such number of clerks, night inspectors, laborers, and other persons in aid of the revenue, as shall be necessary to a faithful and efficient discharge of the duties of their respective offices. But the Secretary of the Treasury shall have the power to limit their number and fix their compensation, and from time to time. increase or diminish said force, as in his judgment the public interests may require.

SEC. 2. For the collection district of San Francisco, the President shall, in like manner, appoint a collector, naval officer, surveyor of the port, and an appraiser, who shall each receive an annual salary as follows, viz: The collector, eight thousand dollars; the naval officer, five thousand dollars; the surveyor of the port, five thousand dollars; and the appraiser, three thousand four hundred dollars. The Secretary of the Treasury shall, on the nomination of the collector, appoint not exceeding seven deputy collectors; one, if the Secretary shall deem it necessary, to be stationed at each of the ports of Benicia, Stockton, and Sacremento city. On the nomination of the naval officer, one

deputy naval officer; and on the nomination of the surveyor, one deputy surveyor of the port; who shall each receive an annual salary of three thousand dollars, excepting the deputy collectors who may be appointed for the ports of Benicia, Stockton, and Sacramento city, whose salary shall be fixed by the Secretary of the Treasury at a sum not exceeding three thousand dollars per annum. He shall also appoint a sufficient number of assistant appraisers for said port, who shall each receive a salary of three thousand dollars per annum, and a sufficient number of examiners in the appraiser's office, at an annual salary not to exceed two thousand dollars each. He shall, on the nomination of the collector, also appoint for said district a competent number of weighers, gaugers, and measurers, at a compensation not exceeding two thousand dollars per annum each, and as many inspectors as he shall deem necessary, at a compensation not exceeding four dollars per day each. SEC. 3. For the collection district of Los Angeles, in California, the President shall, in like manner, appoint a collector, who shall perform the duties of collector and surveyor of the port, and shall receive a salary of three thousand dollars per annum. The Secretary of the Treasury shall appoint one clerk for said collector, who shall act as auditor in comptrolling his accounts, at a compensation not exceeding eighteen hundred dollars per annum. He shall also, on the nomination of the collector, appoint such number of weighers, gaugers, and measurers as he shall deem necessary, at a compensation not exceeding five dollars per day each, and a competent number of inspectors, at a compensation not exceeding four dollars per day each.

SEC. 4. For the collection district of Monterey, in California, the President shall, in like manner, appoint a collector, who shall perform the duties of collector and surveyor of the port, and shall receive a salary of three thousand dollars per annum. The Secretary of the Treasury shall appoint one clerk for said collector, who shall act as auditor in comptrolling his accounts, under such regulations as the said Secretary may prescribe, at a compensation not exceeding eighteen hundred dollars per annum. He shall also, on the nomination of the collector, appoint such number of weighers, gaugers, and measurers as he shall deem necessary, at a salary not exceeding five dollars per day each, and a competent number of inspectors, whose compensation shall not exceed four dollars per day each.

SEC. 5. For the collection district of Astoria, the President shall, in like manner, appoint a collector, who shall perform the duties of collector and surveyor of the port, and who shall receive an annual salary of three thousand dollars. The Secretary of the Treasury is hereby authorized to appoint one clerk for said collector, to act as auditor in comptrolling the accounts of the office, under such regulations as the said Secretary may prescribe, at an annual compensation not exce ding one thousand eight hundred dollars. He shall also, on the nomination of the collector, appoint for said district such number of weighers, gaugers, and measurers as he shall deem necessary, at a compensation not exceeding five dollars per day each, and a competent number of inspectors, at a compensation not exceeding four dollars per day each.

SEC. 6. For the collection district of Puget's Sound, the President

shall, in like manner, appoint a collector, who shall perform the duties of collector and surveyor of the port, and receive an annual salary of three thousand dollars. The Secretary of the Treasury shall appoint one clerk for said collector, to act as auditor in comptrolling the accounts of the office, under such regulations as the said Secretary may prescribe, at an annual compensation not exceeding one thousand eight hundred dollars. He shall also, on the nomination of the collector, appoint for said district such number of weighers, gaugers, and measurers as he shall deem necessary, at a compensation not exceeding five dollars per day, and a competent number of inspectors, whose compensation shall not exceed four dollars per day for each person so appointed.

SEC. 7. For each of the collection districts of Cape Perpetua and Port Orford, in the Territory of Oregon, the President shall, in like manner, appoint a collector, who shall perform the duties of collector and surveyor of the port, and who shall each receive an annual salary of two thousand dollars. The Secretary of the Treasury may, if he shall deem it expedient, appoint one clerk for each of said collectors, to act as auditor in comptrolling the accounts of the office, under such regulations as the said Secretary may prescribe, at an annual compensation not exceeding fifteen hundred dollars. He shall also, on the nomination of the said collectors, appoint for said districts, if in his judgment they are necessary, a competent number of weighers, gaugers, and measurers, at a compensation not exceeding five dollars per day each, and such number of inspectors as he shall deem expedient, at a compensation not exceeding four dollars per day each

SEC. 8. For the collection districts of Galveston and Brazos de Santiago, in Texas, the President shall, in like manner, appoint a collector for each, who shall perform the duties of collector and surveyor of the port. The collector for Brazos de Santiago shall receive an annual salary of two thousand dollars, and the collector at Galveston an annual salary of one thousand six hundred dollars. There shall also be appointed, in like manner, for each of the districts of Indianola, Aransas, and Paso del Norte, a collector, who shall perform the duties of collector and surveyor of the port, and who shall each receive an annual salary of fifteen hundred dollars. The Secretary of the Treasury may, if he shall deem it expedient, appoint for the collector of each of said districts a clerk, to act as auditor in comptrolling the accounts of the office, under such regulations as the said Secretary may prescribe, and who shall receive an annual compensation not exceeding twelve hundred dollars. He shall also, on the nomination of the respective collectors, appoint for the districts named in this section, whenever in his judgment such officers are necessary, a competent number of weighers, gaugers, and measurers, whose compensation shall not exceed four dollars per day, and as many inspectors as he shall deem expedient, whose compensation shall not exceed three dollars per day for each person so appointed.

SEC. 9. The collection districts in the United States not heretofore named shall be divided into eight classes, and the districts and ports of delivery hereinafter named shall be classified as follows, to wit: The first class shall include the districts of Mississippi, Philadel

phia, Baltimore, and Boston, and other districts that shall hereafter collect an amount of revenue exceeding one million of dollars in any one year.

The second class shall include the district of Charleston, in South Carolina, and all other districts which shall hereafter collect, annually, five hundred thousand dollars of revenue and not exceeding one million.

The third class shall include the districts and ports of delivery of Salem, Portland, New Haven, Savannah, Mobile, Oswego, St. Louis, Cincinnati, and all other districts which shall hereafter collect, annually, one hundred thousand and not exceeding five hundred thousand dollars of revenue.

The fourth class shall include the districts and ports of delivery of Buffalo, Champlain, Sandusky, Cleveland, Richmond, Petersburg, Norfolk, Louisville, Nashville, and all other districts that shall hereafter collect, annually, fifty thousand and not exceeding one hundred thousand dollars of revenue.

The fifth class shall include the districts and ports of delivery of Passamaquoddy, Portsmouth, Vermont, Gloucester, Providence, Middletown, New London, Niagara, St. Lawrence, Cape Vincent, Cape Fear, Detroit, Potomac, Pittsburg, New Albany, and all other districts that shall hereafter collect, annually, twenty thousand and not exceeding fifty thousand dollars of revenue.

The sixth class shall include the districts and ports of delivery of Bangor, Newburyport, Bristol, Sackett's Harbor, Genesee, Chicago, New Bedford, Georgetown, (D. C.,) Apalachicola, Memphis, and all other districts that shall hereafter collect, annually, ten thousand and not exceeding twenty thousand dollars of revenue.

The seventh class shall include the districts and ports of delivery of Bath, Milwaukie, Miami, Penobscot, Waldoboro', Belfast, Marblehead, Fall River, Barnstable, Edgartown, Fairfield, Stonington, Perth Amboy, Delaware, Vienna, St. Augustine, Camden, (N C.,) Plymouth, (N. C.,) Pensacola, Key West, St. Marks, St. John's, Michilimackinac, Wheeling, Vicksburg, Evansville, and all other districts that shall hereafter collect, annually, one thousand and not exceeding ten thousand dollars of revenue.

The eighth class shall include the districts and ports of delivery of Pembina, Natchez, Machias, Frenchman's Bay, Wiscasset, Saco, Kennebunk, York, Plymouth, (Mass.,) Sag Harbor, Bridgetown, Great Egg Harbor, Little Egg Harbor, Newark, Erie, Tappahannock, Cherrystone, Yorktown, Edenton, Washington, (N. C.,) Newbern, Beaufort, Winyaw, Broad River, (S. C.,) St. Mary's, (Ga.,) Brunswick, (Ga.,) Pearl River, Grand Gulf, Knoxville, Paducah, Madison, Portsmouth, Marietta, (Ohio,) Alton, Galena, Burlington, (Iowa,) Florence, (Alabama,) Prairie du Chien, St. Paul's, (Minnesota,) Dunkirk, Michigan City, Quincy, and all other districts which shall collect less than one thousand dollars of revenue annually.

SEC. 10. The Secretary of the Treasury shall have authority, with the approval of the President, and it shall be his duty, annually, to transfer any district from the class in which it is here placed to the appropriate one, according to the amount of revenue collected in said

district for the current fiscal year, and the salary of the officers shall be paid accordingly. He shall also have power, with like approval of the President, to designate the class in which any new district, hereafter created, or any port of delivery at which a collector may be appointed, shall be placed, until its proper class shall be ascertained by the amount of revenue collected; and shall have power and authority, with like approval by the President, to annex any of the districts, not herein included in any one of the eight classes, to one of said classes, according to the revenue collected within the same the preceding year; and thereafter the salary and compensation of the collector and other officers of the customs for such districts shall be in accordance with the salary of the like officers of the class to which it is attached.

SEC. 11. For the districts in the first and second classes, the President shall appoint, by and with the advice and consent of the Senate, a collector, a naval officer, and surveyor of the port, for each district. And for the districts and ports of delivery in the third and fourth classes he shall appoint, in like manner, a collector and naval officer for each district. And a surveyor shall also be appointed for each port of entry in the third, fourth, and fifth classes, who shall also discharge the duties of an inspector of the customs when so directed by the Secretary of the Treasury. And for the districts and ports of delivery in the fifth, sixth, seventh, and eighth classes, he shall appoint, in like manner, a collector of the customs.

Suc. 12. The collectors of customs appointed for the districts in the first class shall receive an annual salary of six thousand dollars; and those appointed for districts in the second class, an annual salary of four thousand dollars; and those appointed for districts in the third class, an annual salary of fifteen hundred dollars, and a further compensation of one-half of one per cent. on the net amount of revenue collected in said districts; those appointed for districts in the fourth class, an annual salary of one thousand dollars, and a further compensation of one per cent. on the net amount of revenue collected in said districts; those appointed for districts in the fifth class, an annual salary of eight hundred dollars, and a further compensation of two per cent. on the net amount of revenue collected in said districts; those appointed for districts in the sixth class, an annual salary of six hundred dollars, and a further compensation of three per cent, on the net amount of revenue collected for said districts; those appointed for districts in the seventh class, an annual salary of four hundred and fifty dollars, and a further compensation of six per cent. on the net amount of revenue collected in said districts; and those appointed for districts in the eighth class, an annual salary of four hundred dollars, and a further compensation of eight per cent. on the net amount of revenue collected in said districts. And the Secretary of the Treasury shall have power and authority, with the approbation of the President, to grant an additional compensation to the collectors in classes numbers seven and eight, when, in his judgment, the character of the service requires it; and shall state such cases in his annual report, together with changes made in the classification from the revenue col
