2 senatorial district, and to the same electoral district, (for the purpose of choosing a president and

3 president of the United States,) as the county of Logan.

and the county of Logan shall together send one delegate 2 to the house of delegates, in the general assembly of Virginia, until a reapportionment of repre3 sentation shall take place, or until otherwise ordered by the said general assembly. And all sepa4 rate elections heretofore authorized to be holden in and for the counties of Kanawha, Cabell and 5 Logan, and falling within the boundary of the new county of shall be conducted for

6 the said new county, in the same manner as heretofore, for the county in which it was established. shall be holden in the

12. For the purpose of running and marking the lines constituting the boundary of said new 2 county of and forming the division between the counties of Kanawha, Cabell and

3 Logan, and other counties as designated by this act, all the provisions of the act, entitled "an act 4 for making more effectual provision for running and marking the boundaries of new counties," 5 passed February the eleventh, eighteen hundred and forty-five, shall be regarded as the rule, and 6 acted upon in this case.

13. And be it further enacted, That the treasurer of the school commissioners of the counties of 2 Kanawha, Cabell and Logan shall be, and they are hereby authorized and required to pay to the 3 treasurer of the school commissioners of the new county of

, upon the order of

4 the commissioners last mentioned, out of the fixed and surplus quotas of the school fund of the 5 said counties of Kanawha, Cabell and Logan, for the present fiscal year, (eighteen hundred and 6 forty-six,) such sum as shall seem to them to be in due proportion to the population of the said new 7 county of taken from the said counties of Kanawha, Cabell and Logan respec

8 tively, including any balance now remaining unexpended; as also of the due proportion as afore9 said, accruing from such quotas to which said counties of Kanawha, Cabell and Logan are or may

10 be entitled for any former year. And it shall be the duty of the second auditor to reapportion the 11 fixed and surplus school quotas of the said counties of Kanawha, Cabell and Logan for the fiscal 12 year eighteen hundred and forty-seven, and subsequent years, between the said counties of Ka13 nawha, Cabell, Logan and agreeably to their respective number of white tith

14 ables which may be returned therein by the commissioners of the revenue for the present year

15 eighteen hundred and forty-seven.

14. This act shall commence and be in force from and after the first day of May next.

A BILL

To incorporate the Manassa's Gap Turnpike Company.

March 10, 1847-Read first to be read second time.

1. Be it enacted by the general assembly, That for the purpose of constructing a turnpike road 2 from Farrowsville in the county of Fauquier near Manassa's gap to some point on the Ashby's gap 3 turnpike not lower down than the town of Middleburg, it shall be lawful to open books for receiv4 ing subscriptions to the amount of forty-five thousand dollars in shares of fifty dollars each. The 5 said books shall be opened at Farrowsville under the direction of Benjamin R. Bradford, Thomas 6 S. Hall, Cam T. Page and William Stribling, or any one of them; at Front Royal under the 7 direction of William M. Buck, Cloud and

, or any one of them; at Middleburg under the direction of H. B.

9 Powell, George Love, Samuel J. Tibbs, Alfred Reid and Caleb Rector, or any one of them; at 10 Rectortown under the direction of Alfred Rector, Aquila Glascock, Richard H. Carter and Wil11 liam Glascock, or any one of them; and at Salem under the direction of Edward C. Marshall, 12 Thomas M. Monroe, Hugh Rogers, jr., and Samuel Bayly, or any one of them.

2. Be it further enacted, That when two hundred shares shall have been subscribed, the subscri2 bers, their executors, administrators and assigns, shall be, and are hereby incorporated into a com3 pany by the name and style of "The Manassa's Gap Turnpike Company," subject to the provi4 sions of the act, entitled "an act prescribing certain general regulations for the incorporation of 5 turnpike companies," passed February the seventh eighteen hundred and seventeen: Provided, 6 That the said company shall be at liberty to dispense with a summer or side road to the said turn

7 pike, if they shall deem it expedient to do so; and that said turnpike shall be at least

3. Be it further enacted, That the Board of public works be, and are hereby authorized to sub

2 scribe on behalf of the commonwealth for three hundred and sixty shares, being two fifths of the

3 capital stock of the said company, agreeably to the terms of the act, entitled "an act prescribing 4 certain general conditions on which future subscriptions to the capital of joint stock companies 5 shall be made on behalf of the commonwealth," passed February the eleventh eighteen hundred 6 and thirty-two; and the said board are likewise instructed, as soon as practicable after the passage 7 of this act, to cause to be surveyed by some competent engineer the best route for the road autho8 rized by this act, and to have returned to the said board a report and estimate of the cost of the 9 said road.

4. This act shall be in force from its passage.

A BILL

Authorizing the State's guarantee to certain Bonds of the Chesapeake and Ohio Canal Company.

February 19, 1847-Read first to be read second time.

Whereas by an act of the general assembly of Maryland, passed the tenth day of March eighteen 2 hundred and forty-five, entitled "an act to provide for the completion of the Chesapeake and Ohio 3 canal to Cumberland, and for other purposes," the president and directors of the Chesapeake and 4 Ohio canal company were authorized to borrow upon the bonds of the said company, with pre5 ferred liens on its revenues, such sums of money as might be required to pay for the completion of 6 the said canal to Cumberland, under a contract or contracts thereafter to be made by the president 7 and directors of said company: And whereas it has been represented to the general assembly of 8 Virginia that in pursuance of the said act, the said president and directors, under a contract for 9 that purpose, have made arrangements to raise the amount of money necessary for the completion 10 of the said canal to Cumberland, provided the further sum of three hundred thousand dollars can 11 be procured:

1. Be it therefore enacted by the general assembly of Virginia, That to enable the said presi2 dent and directors, or their contractors, to complete their said arrangements, and to raise the said 3 sum of three hundred thousand dollars in the mode and for the purpose aforesaid, the treasurer of 4 this commonwealth be, and he is hereby authorized and required to subscribe or endorse the gua5 rantee of this state to the bonds of the said Chesapeake and Ohio canal company, to be issued in 6 pursuance of the said act of the general assembly of Maryland, to an amount not exceeding three 7 hundred thousand dollars, to the effect following:
