4 entry the aforesaid act of the twenty-fifth of February eighteen hundred and forty-six shall be void 5 and of no effect in said county or city; and it shall be the duty of said county or hustings court to 6 divide said county or city, as the case may be, into districts, and appoint school commissioners in 7 accordance with the requirements of the act passed the fifth day of March eighteen hundred and 8 forty-six, entitled "an act amending the present primary school system," and of such other acts 9 amendatory of said last named act as may be enacted by the general assembly.

3. It shall be the duty of said county or hustings court, in which said district free school system 2 shall have been rejected as aforesaid, to sell the property, whether real or personal, that may have 3 been purchased by the commissioners appointed under the aforesaid act of the twenty-fifth of Feb4 ruary eighteen hundred and forty-six, on such terms as shall seem most judicious to said court, and 5 shall collect of the commissioners last aforesaid, any moneys still in their hands and unappropriated, 6 which may have been raised by a levy upon the persons or property in said county or city, by vir7 tue of the act last aforesaid; and the moneys arising from such sale or sales, and the moneys so 8 collected from said commissioners, said county or hustings court, as the case may be, shall pay over 9 to the overseers of the poor in said county or city, to be used by them, so as to diminish the next 10 ensuing levy for the support of indigent paupers in their county or city.

4. This act shall be in force from its passage.

A BILL

Concerning Offences against the Sovereignty of the State.

1. Treason against the state shall consist in levying war against the same, adhering to its enemies, 2 giving them aid and comfort, establishing or causing to be established, without authority of the 3 legislature, any government within its limits separate from the existing government, holding or exc4 cuting, in such usurped government, any office, place or appointment, swearing allegiance or pro5 fessing fidelity to it, or resisting the execution of the laws under colour of authority derived from 6 or protection afforded by it; and any person found guilty thereof, shall be punished with death.

2. Any free person who, having knowledge of the commission of any treason, shall not, as soon 2 as may be, make known the same to the governor of this state, to one of the judges of the supreme 3 court of appeals, or of the general court, or a justice of the peace, shall be guilty of misprision of 4 treason, and be punished by fine not exceeding one thousand dollars, or by imprisonment in the 5 penitentiary for not less than three nor more than five years.

3. No person shall be found guilty of treason unless on the testimony of two witnesses to the 2 same overt act, or confession in open court.

4. Any free person who shall advise or conspire with a slave to rebel or make insurrection, or con2 sult, advise or conspire with another to induce, entice or excite any slave to rebel or make insur3 rection, whether such rebellion or insurrection be made or not, shall be punished with death.

5. Any free person who shall attempt to establish, without authority of the legislature, any go2 vernment within the limits of this state, separate from the existing government, and commit some 3 overt act for promoting such attempt, or by writing or advised speaking, endeavour to instigate 4 others to establish such government, shall be guilty of a high misdemeanor, and be punished by 5 confinement in the jail not exceeding twelve months, and be fined not exceeding one thousand 6 dollars.

A BILL

Concerning Offences against the Lives and Persons of Individuals.

1. Unlawful homicide shall be murder of the first degree, murder of the second degree, or man

2 slaughter.

2. Murder committed by poison, lying in wait, duress of imprisonment, starving, excessive whip2 ping, cruel treatment, or any kind of wilful, deliberate and premeditated killing, or in the commis3 sion of, or attempt to commit any arson, rape, robbery or burglary, shall be murder of the first de4 gree; all other murder shall be murder of the second degree.

3. Murder of the first degree shall be punished with death.

4. Murder of the second degree, committed by a free person, shall be punished by confinement 2 in the penitentiary for not less than five nor more than eighteen years.

5. Voluntary manslaughter, committed by a free person, shall be punished by confinement in the 2 penitentiary for not less than three nor more than ten years; but if the jury shall find that the ac3 cused did not intend to destroy life, or do great bodily harm, it shall be punished as a misdemeanor. 6. Involuntary manslaughter, committed by a free person, shall be a misdemeanor.

7. Any free person who, by previous agreement, shall fight a duel or single combat with deadly 2 weapon, and in so doing kill his antagonist, shall be punished with death; or, at the discretion of 3 the jury, by confinement in the penitentiary for not less than three nor more than ten years; and 4 any such person who, with intent to fight such duel or single combat, shall leave this state and ac5 tually fight such duel or single combat without the limits thereof, and in so doing kill his antagonist, 6 shall be as guilty, and suffer the same punishment, as if he had fought such duel or single combat 7 within the limits thereof.

8. Any person indicted under the preceding section of this act, may plead a former conviction or 2 acquittal of the same offence in any other state; and such plea, if admitted and established, shall 3 be a bar to all further or other proceedings against such person for the same offence within this state.

9. Any free person who, with intent to maim, disable, disfigure, kill, commit a felony or do some

2 grievous bodily harm, shall unlawfully or maliciously cut out or maim the tongue, put out an eye, 3 slit, cut, tear, or bite off or mutilate the nose, ear or lip of another, or by cutting, wounding, biting, 4 stabbing or shooting, shall disable or disfigure the nose, ear, lip or face, or any limb or member of 5 another, shall be punished by confinement in the penitentiary for not less than three nor more than 6 ten years.

10. Any free person, being armed with a dangerous weapon, who shall assault another, and rob 2 from his person any thing which may be the subject of larceny, shall be punished by confinement 3 in the penitentiary for not less than five nor more than ten years.

11. Any free person, not being armed with a dangerous weapon, who shall by force and violence, 2 or by assault and putting in fear, rob from the person of another any property which may be the 3 subject of larceny, shall be punished by confinement in the penitentiary for not less than three nor 4 more than ten years.

12. Any free person who, verbally or by written or printed communication, shall maliciously 2 threaten to accuse another of any crime or offence, or by any written or printed communication, 3 maliciously threaten any injury to the character, person or property of another, and shall thereby 4 extort money or any pecuniary advantage whatever, shall be punished by confinement in the peni5 tentiary for not less than three nor more than five years.

13. Any free person who shall unlawfully seize, take away or secrete a child of another from any 2 person having lawful charge of the person of such child, with intent to extort money or any pecu3 niary advantage whatever, shall be punished by confinement in the penitentiary for not less than 4 three nor more than five years.

14. Any white person who shall ravish and carnally know any female of the age of ten years or 2 more, by force and against her will, or shall unlawfully and carnally know and abuse any female 3 child under the age of ten years, shall be punished by confinement in the penitentiary for not less 4 than ten nor more than twenty years.

15. Any white person who shall unlawfully take away any female against her will, with intent to 2 marry or defile her, or cause her to be married or defiled by another, or shall unlawfully take away
