A message was received from the senate by Mr. WOOLFOLK, who informed the house that the senate had adopted a resolution for postponing the joint order of the day until to-morrow, in which they requested the concurrence of the house of delegates.

The said resolution was read as follows:

Resolved, That the joint order which has for its object the election of senator of the United States, to supply the vacancy which will be occasioned by the expiration of the term of service of William S. Archer, Esq., on the 4th of March next, be postponed until to-morrow.

SATURDAY, JANUARY 16, 1847.

A communication was received from the senate by their clerk, which was read as follows:

The senate have passed the bill, entitled

IN SENATE, JANUARY 13, 1847.

“An act to facilitate the transfer of stock in joint stock companies of this state," (No. 35,) with amendments, in which they request the concurrence of the house of delegates.

And they have agreed to the resolutions relative to the death of the honourable Isaac S. Pennybacker. The said amendments being twice read were severally agreed to, and it was ordered that the clerk inform the senate thereof.

The resolution submitted by Mr. BENNETT on yesterday was taken up, and having been modified by him with the leave of the house, was adopted as follows:

Resolved, That the committee of schools and colleges be instructed to enquire into the expediency of reporting to this house bill No. 223 of the session of 1843-4, granting to the Weston academy the surplus sales of forfeited lands in Lewis county.

On motion of Mr. Cook, Resolved, That the committee on the militia laws be instructed to enquire into the expediency of amending the second section of the act passed 13th March 1840, entitled "an act to amend an act, entitled an act for the better organization of the militia,'" so as to provide a stand of colours for such regiments as never have had the same.

On motion of Mr. Scorт, Resolved, That the committee for courts of justice enquire into the expediency of so amending the present laws as to provide that writs of capias ad respondendum and scire facias, summons to answer any action, and subpoenas in chancery, may be made returnable to the first day of the next regular term of the court out of which the same shall issue, or to any rule day before or after such term; and also that cases in chancery may be set for hearing after two months from the time of filing a replication to an answer.

On motion of Mr. MAYO, Resolved, That the committee for courts of justice enquire into the expediency of so amending the charter of the City of Richmond as to confer upon the day and night police of the said city the powers of constables in the arrest of persons charged with felony and other breaches of the penal laws; and so as to impose a tax for the improvement of the side walks of the public streets, lanes and alleys of the said city. On motion of Mr. SLAUGHTER, Resolved, That the committee of privileges and elections enquire into the expediency of amending the act, entitled "an act changing the place of holding a separate election in the county of Mason, and for other purposes," passed February 17th, 1845, so as to require the commissioners of the revenue, instead of the clerks of the several counties of the state, to make out annual lists of tithables and property for the use of commissioners at election precincts.

On motion of Mr. COCKE, Resolved, That the committee of finance enquire into the propriety of allowing a claim to the estate of the late captain Blair Bolling for additional pay under the law of congress approved on the 2d day of March 1827, amounting to fourteen hundred and ninety dollars.

On motion of Mr. STOVALL, Resolved, That the committee of finance enquire into the expediency of amending the laws in relation to collecting the revenue of this commonwealth.

On motion of Mr. MAJOR, Resolved, That the committee of finance enquire into the expediency of requiring the sheriffs of this commonwealth to take in payment of taxes, county claims within their respective counties.

On motion of Mr. STEPHENSON, Resolved, That the printer of this house print the judgment and opinions of the judges of the general court in the case of the commonwealth against Peter Garner and others, adjourned from the superior court of Wood county, heretofore ordered to be printed, in octavo form instead of the form now prescribed by law for printing of documents for the use of this house.

On motion of Mr. TUNSTALL, Resolved, That so much of the governor's message as relates to the report of the superintendent of public buildings be referred to a select committee, with instructions to enquire into the propriety of the suggestions therein contained, with leave to report by bill.

No. 119. A bill to suspend on certain conditions the payment of interest on the loan to Emory and Henry college; and

No. 120. A bill to increase the annuity to the Virginia institution for the education of the deaf and dumb and of the blind, and for other purposes.

No. 121. A bill concerning Franklin Tavenner.

Mr. HOLLADAY, from the committee of claims, presented the following bill:

Mr. WATTS, from the committee on the militia laws, presented reports upon the petitions of John George Heist and of Robert S. Ashley.

A motion was made by Mr. M'PHERSON that the house adopt the following resolution:

Resolved, That the governor be requested to furnish this house with a copy of the proceedings of the board authorized to appoint the field officers of the Virginia regiment raised for the Mexican war; and also to furnish a list of all the applicants for field officers who tendered their services for such appointments in the war against Mexico.

And the question being put thereupon, was determined in the negative.

On motion of Mr. M'PHERSON, Resolved, That the committee of finance enquire into the expediency of bringing in a bill providing for letting the public printing to the lowest bidder.

On motion of Mr. HARVIE, Ordered, That Mr. Stovall be added to the committee of finance.

On motion of Mr. LACY, he was excused from serving on the joint committee appointed on the resolution for examining into the arrangements made by sundry railroad companies.

No. 27. The order of the day on the bill to increase the capital stock of the Staunton and James river turnpike company for the purpose of M'Adamizing their road, being read, on motion of Mr. PERROW, the same was postponed and made the order of the day for the 1st of February next.

On motion of Mr. WATTS, Ordered, That the committee on the inilitia laws be discharged from the consideration of the petition of the officers of the 166th regiment, and the same was ordered to be laid upon the table.

Mr. PATRICK presented a petition of Peter L. Forqueran, jailor of the county of Kanawha, for an increase of the allowance for attendance on the circuit superior court for said county; which was ordered to be referred to the committee of claims.

Mr. DORMAN presented a petition of citizens of the county of Rockbridge, asking that additional penalties may be imposed for selling ardent spirits to slaves, free negroes and mulattoes.

Mr. SHEFFEY a petition of James L. Campbell and Robert Campbell, free persons of colour, praying that said James L. Campbell may be permitted to remain in the commonwealth.

Mr. CoсKE a petition of the Baptist state societies, praying the passage of an act authorizing them to receive and apply bequests.

Mr. GOODSON a petition of John Preston, praying that the title to certain lands patented to Robert Preston by the state and embraced within the limits of a tract of ten thousand acres mortgaged to the commonwealth by Francis Pierre de Tubeuf, may be guaranteed to the said John Preston.

Ordered, That said petitions be referred to the committee for courts of justice.

On motion of Mr. MAYO leave was granted to withdraw the petition of the Protestant Episcopal church of Virginia for the passage of an act authorizing religious congregations of this state to hold a limited amount of property; thereupon, he again presented the same, and it was ordered to be referred to the committee for courts of justice.

Mr. EDGINGTON presented two memorials of citizens of the county of Harrison, remonstrating against any change in the terminus of the Baltimore aud Ohio railroad, and against chartering any company to construct a railroad from the Potomac to any point south of the City of Wheeling.

Mr. OLDHAM Several similar memorials of citizens of the county of Marshall.

Mr. BENNETT a petition of citizens of the county of Lewis, for the incorporation of a company to construct the said railroad from the Potomac to some point south of the City of Wheeling.

Mr. BROWN of Albemarle presented a memorial of citizens of the county of Albemarle, remonstrating against amending the charter of the Rivanna navigation company so as to absolve them from its requirements.

Also a similar memorial of citizens of the town of Charlottesville.

Mr. BROWN of Monongalia a petition of citizens of the county of Monongalia, for the passage of an act authorizing the adjustment of the claims of certain labourers on the Maryland and Ohio road.

Mr. HAYMOND a similar petition of George P. Martin of the county of Marion.

Mr. PERROW a memorial of citizens of the counties of Albemarle and Nelson, remonstrating against making an appropriation for M'Adamizing the road from Scottsville to Staunton, until time has been allowed to survey a route for a road from Howardsville to Staunton.

Mr. STURM a petition of citizens of the county of Randolph, and another of citizens of the county of Barbour, for the incorporation of a company to construct a turnpike road from the town of Beverley to Clarksburg. Ordered, That the said petitions be referred to the committee of roads and internal navigation.

On motion of Mr. BROWN of Albemarle leave was given to withdraw the petition of the Rivanna navigation company, praying exemption from certain provisions of their charter; and also to withdraw the memorial of the stockholders of the said company, remonstrating against the same, presented at the session of the legislature in 1844-5; thereupon he again presented the said petition and memorial, and they were ordered to be referred to the committee of roads and internal navigation.

Mr. SHEFFEY presented the response of the court of directors of the Western lunatic asylum to the petition of A. Waddell and others, which was ordered to be referred to the committee on lunatic asylums.
