On motion of Mr. BANKS, Resolved, That the committee of schools and colleges enquire into the propriety of authorizing the school commissioners of Madison county to pay out of the quota of said county for the year 1847, or any other funds in the hands of their treasurer, the sum of thirty-one dollars and fifteen cents due to Joseph B. Webb, for the tuition of poor children in said county in the year 1845.

Mr. BROWN of Albemarle presented three petitions of citizens of the county of Albemarle, asking for certain changes in the charter of the Rivanna navigation company.

Also a petition of the stockholders of said company, of the like import.

Mr. DARRACOTT a memorial of citizens of the county of Hanover, remonstrating against the construction of a railroad from the City of Richmond to York river.

Mr. CASTLEMAN presented three petitions of citizens of Jefferson and Clarke counties, and of citizens of Jef ferson and Loudoun counties, asking for a charter to construct a railroad from Little's falls on the Shenandoah river in the county of Jefferson, to intersect the Baltimore and Ohio railroad at the Old Furnace in said county, and the Winchester and Potomac railroad at or near Keye's Switch.

Ordered, That said petitions be referred to the committee of roads and internal navigation.

Mr. LACY presented a petition of citizens of the county of Charles City, for the formation of an additional troop of cavalry in the 52d regiment, which was ordered to be referred to the committee on the militia laws.

Mr. ANDERSON presented a petition of the trustees of the town of Farmville, asking for an enlargement of their powers, which was ordered to be referred to the committee of propositions and grievances.

Mr. CASTLEMAN presented a petition of John B. White and others, officers of the court of Hampshire, in favour of a change of the time of holding the circuit superior court of said county, which was ordered to be referred to the committee for courts of justice.

On motion of Mr. BROWN of Albemarle, the house adjourned until to-morrow 12 o'clock.

SATURDAY, JANUARY 9, 1847.

Mr. BURWELL, from the committee of schools and colleges, presented the following bills:
No. 91. A bill to establish the Virginia armory school.

No. 92. A bill to amend the act of 25th February 1846, entitled "an act to establish district free schools in the counties of Lancaster, Westmoreland, Richmond, Prince William, Loudoun, Fairfax and certain other counties therein mentioned;" and

No. 93. A bill to authorize a payment to be made by the school commissioners of Madison county to Joseph B. Webb, a teacher in said county.

Mr. LEE presented a petition of Alexander Hamilton and others, for the passage of an act to incorporate a company to improve the navigation of the Potomac river by slackwater navigation.

Mr. EDGINGTON presented a memorial of citizens of the county of Ohio, remonstrating against any alteration of the terminus of the Baltimore and Ohio railroad, and against the charter of any company to construct a railroad with its terminus at any point south of the City of Wheeling.

Mr. OLDHAM a similar remonstrance of citizens of the county of Marshall.

Ordered, That the said petitions be referred to the committee of roads and internal navigation.

Mr. GOODSON presented a petition of the trustees of Emory & Henry college, praying to be released from the debt due from said college to the state, which was ordered to be referred to the committee of schools and colleges.

Mr. HART presented a petition of John Timberlake and other citizens of the county of Albemarle, asking the repeal of the act of 1845-6, constituting a portion of the Rivanna river a lawful fence, which was ordered to be referred to the committee on agriculture and manufactures.

On motion of Mr. HOWARD, leave was granted to withdraw the petition of John Coke, presented at the last session of the general assembly.

On motion of Mr. BROWNE of Mathews and Middlesex, leave was granted to withdraw the petition of Robert M. Trice, praying to be relieved from the payment of money improperly claimed from him by the auditor, as deputy sheriff of Middlesex county; thereupon, Mr. BROWNE again presented the same, and it was ordered to be referred to the committee of claims.

On motion of Mr. NEWTON, leave was granted to withdraw the petition of William M. Atkinson, asking certain amendments to the act authorizing him to lease a lot in Norfolk City; thereupon Mr. NEWTON again presented the same, and it was ordered to be referred to the committee for courts of justice.

On motion of Mr. WALLACE, Ordered, That 1000 extra copies of the petition of citizens of the county of Henry, ordered to be printed on yesterday, be printed for the use of the general assembly. [Doc. No. 23.] Mr. MAYO, from the select committee, presented the following bill:

No. 94. A bill to incorporate the Virginia and New York steam packet company.

On motion of Mr. MAYO, Ordered, That the petition of Henry Ludlam and others, and the remonstrance against the same of certain citizens of Richmond, be printed for the use of the general assembly. [Doc. No. 24.] On motion of Mr. CocкE, Resolved, That the committee of claims be instructed to enquire into the propriety of allowing a claim to Robert K. Dabney of seventy-four dollars and sixty-eight cents, advanced by him for the education of the poor children of Powhatan, beyond the amount received by him as treasurer of the school fund for the year 1846.

Mr. Bocock, from the committee for courts of justice, presented a report upon the expediency of reducing the number of the monthly and quarterly sessions of the county courts; and the following bill:

No. 95. A bill changing the time of holding the May quarterly term of the county of Jefferson.

Also a report on the revision and digest of the criminal code; and the following bills:

No. 96. A bill concerning offences against the sovereignty of the state.

No. 97. A bill concerning offences against the lives and persons of individuals; and

No. 98. A bill concerning offences against private property.

No. 28. A bill to provide for the completion of the James river and Kanawha canal from tidewater at Richmond, to the town of Buchanan, and for other purposes, was taken up on motion of Mr. DORMAN, and the amendment which was pending when the said bill was under consideration on the sixth instant, which was submitted by Mr. DORMAN, and which proposed to strike out the second section and insert in lieu thereof another section, being agreed to, a motion was made by Mr. STROTHER to amend the bill as amended, by striking out the whole thereof, and inserting a substitute therefor.

The said substitute contained the following as its sixth section: "Be it further enacted, That the president and directors of the James river and Kanawha company shall expend, if so much be required, dollars of the stock loaned under this act, in the completion of the works of the said company from Lynchburg

to

"' &c.

A motion was made by Mr. STROTHER to fill the first blank with the sum of six hundred and forty-two thousand dollars; and a motion was made by Mr. PERROW to fill the same with the sum of twelve hundred thousand dollars, and Mr. STOVALL demanded that the vote thereon be recorded, and the question on filling said blank being under discussion, on motion of Mr. DORMAN the bill, with the proposed amendments, was passed by for the present.

A message was received from the senate by Mr. M'MULLEN, who informed the house that the senate had adopted a resolution for enquiry into arrangements made by the Richmond, Fredericksburg and Potomac railroad, the Petersburg and Richmond railroad, the Petersburg railroad and the Portsmouth and Roanoke railroad companies with any other company, in relation to the use and employment of the funds of said companies, in which they request the concurrence of the house of delegates.

On motion of Mr. Boсock, the report of the committee for courts of justice, on the revision and digest of the criminal code, and the bills this morning reported, as part of said revision, were ordered to be printed. [Doc. No. 25.]

On motion of Mr. DORMAN, the house adjourned until Monday 12 o'clock.

MONDAY, JANUARY 11, 1847.

A communication was received from the senate by their clerk, which was read as follows:

The senate have passed the bills, entitled

IN. SENATE, JANUARY 9, 1847.

"An act authorizing two separate elections in the county of Wetzel." (No. 13.)

"An act to authorize the appointment of an additional commissioner of the revenue for the county of Marion." (No. 32.)

"An act authorizing a separate election at Scottsville in the county of Albemarle." (No. 36.)

"An act authorizing the refunding of a sum of money to Wylie P. Woods, deputy of Jesse Hudson, sheriff of Kanawha county." (No. 25.)

"An act concerning Daniel C. Burns, sheriff of Berkeley county." (No. 33.)

"An act refunding to James Cook, deputy for Charles Rector, sheriff of Wood county, a sum of money," (No. 34;) and

"An act concerning Stephen Coleman, sheriff of Pittsylvania county." (No. 40.)

They have also passed the bills, entitled

"An act authorizing the Hamilton lodge No. 30 of the Independent order of Odd Fellows in the City of Williamsburg to hold a limited amount of property, and regulating their tenure," (No. 43;) and

"An act to incorporate the Clarksburg savings bank," (No. 4,) with amendments, in which they request the concurrence of the house of delegates.

And they have rejected the bill, entitled

"An act directing a survey of a M'Adamized road from Howardsville in the county of Albemarle, to Staunton in the county of Augusta." (No. 38.)

The said amendments were severally agreed to, and it was ordered that the clerk inform the senate thereof. The resolution of the senate, submitted on Saturday, was taken up and read as follows:

Resolved, That a joint committee of the two house of the legislature be raised charged to enquire into the arrangement between the Richmond, Fredericksburg and Potomac railroad company and the Port Walthall steamboat association, and to report whether the said arrangement was authorized either by the action of the stockholders or by the charter of the said company; and also to enquire into any other arrangements made by the said Richmond, Fredericksburg and Potomac railroad company with any other company or individuals in relation to the use and employment of the funds of said company, and whether the same were authorized by the charter of said company, and to make the same enquiries in relation to the Petersburg and Richmond railroad company, the Petersburg railroad company and the Portsmouth and Roanoke railroad company, and that the said committee have leave to send for persons and papers.

And the question being put thereupon the same was agreed to.

On motion of Mr. SYME, the rule of the house was suspended, and the vote agreeing to said resolution was reconsidered; thereupon the said resolution was amended by the house, on his motion, by inserting after the words "the Portsmouth and Roanoke railroad company," the following: "and that said committee enquire into the circumstances attending the late change in the presidency of the Richmond, Fredericksburg and Potomac railroad company."

And the said resolution as amended was then agreed to by the house.

Ordered, That the clerk inform the senate thereof and request their concurrence in said amendment.

On motion of Mr. CARSON, Resolved, That the committee on banks be instructed to enquire into the expediency of repealing or amending so much of the 12th section of the act passed April 4th, 1839, relating to banks, as requires a classification of discounts and lists of applicants, in addition to the ordinary discount books. Mr. BANKS, from the committee of propositions and grievances, presented the following bills:

No. 99. A bill authorizing the Masonic society of lodge number one in the City of Norfolk to sell and convey a certain lot owned by them in said city, and for other purposes; and

No. 100. A bill incorporating the Franklin lodge number thirteen of the Independent order of Odd Fellows of the City of Wheeling.

Mr. Bocock, from the committee for courts of justice, presented the following bill:

No. 101. A bill changing the time of holding the circuit superior courts of the counties of Clarke and Hampshire.

On motion of Mr. Cook, the committee on the militia laws were discharged from the consideration of the petition of the officers of the 157th regiment, and the petitioners were allowed to withdraw the same.

Mr. STURM presented a petition of citizens of the town of Beverley in the county of Randolph, asking for an act incorporating said town.

Mr. BREATHED a petition of the president and trustees of the town of Bath in the county of Morgan, for the passage of an act authorizing them to permit a billiard table to be kept in said town during the bathing season.

Mr. HARRISON of Loudoun a petition of citizens of the counties of Loudoun, Fauquier and Prince William for the formation of a new county out of parts of said counties with the town of Middleburg for its seat of justice, and protesting against the formation of a new county with the town of Upperville as the seat of justice. Mr. Love a memorial of citizens of the county of Fairfax, remonstrating against a division of said county, and against annexing the same to the county of Alexandria.

Ordered, That said petitions be referred to the committee of propositions and grievances.

Mr. STURM presented a petition of citizens of the county of Barbour, for the incorporation of a company to construct a turnpike road from Beverley to Clarksburg, which was ordered to be referred to the committee of roads and internal navigation.

Mr. HART presented a memorial of citizens of the county of Albemarle, remonstrating against the petition of John Timberlake, praying for the repeal of the act declaring the Rivanna river a lawful fence between Meriwether's bridge and Snead's dam; which was ordered to be referred to the committee on agriculture and manufactures.

Mr. HOWARD presented a petition of Frances C. Coleman, asking for the passage of an act authorizing her as the legal guardian of her infant children and the guardian of other infants interested, to compromise certain suits in which they are parties, as the petitioner may think best for the interests of said infants, which was ordered to be referred to the committee for courts of justice.

Also a petition of John Coke, sergeant of the City of Williamsburg, asking that a fine and costs imposed upon him may be refunded.

And a petition of Robert Anderson, one of the heirs, and also administrator de bonis non of James Anderson deceased, praying on behalf of himself and the other heirs of said James Anderson, compensation for their ancestor's services in the revolutionary war.

Ordered, That the said petitions be referred to the committee of claims.

Mr. HOLLADAY presented certain testimony in relation to the petition of Samuel Philips, which was also ordered to be referred to the same committee.

No. 28. A bill to provide for the completion of the James river and Kanawha canal from tidewater at Richmond to the town of Buchanan and for other purposes, with the amendments under consideration on Saturday, was taken up.

The sixth section of the substitute submitted by Mr. STROTHER, provides "that the president and directors of the James river and Kanawha company shall expend, if so much be required, dollars of the stock

loaned under this act," &c.

On Saturday a motion was made by Mr. STROTHER to fill said blank with the words "six hundred and fortytwo thousand," and by Mr. PERROW to fill the same with the words "twelve hundred thousand ;" and the question being on the largest sum, was determined in the negative. Ayes 45, noes 76.

On motion of Mr. STOVALL, the vote was recorded as follows:

A communication was received from the senate by their clerk, which was read as follows:

The senate have passed the bills, entitled

"An act changing the place of holding a separate election in each of the counties of Botetourt and Southampton." (No. 14.)

"An act authorizing a separate election at Knottsville, in the county of Taylor." (No. 22.)

"An act changing the company of Rifle Greys, in the county of King William, to a company of light infantry, and authorizing an exchange of arms." (No. 29.)

"An act to change the place of holding a separate election in the county of New Kent." (No. 41.) "An act releasing to Elizabeth Ericson the commonwealth's right to a tract of land formerly owned by Mathew Ericson of the county of Mercer," (No. 50,) and

"An act concerning Daniel G. Henkle, deputy for David Sniveley, sheriff of Jefferson county." (No. 62.) They have also passed the bills, entitled

"An act to incorporate the Manakin iron manufacturing company, in the county of Goochland." (No. 15.) The said amendments were severally agreed to, and it was ordered that the clerk inform the senate thereof. On motion of Mr. HAYMOND, Resolved, That the committee for courts of justice enquire into the propriety of extending the provisions of the seventeenth section of the act concerning lands returned delinquent for nonpay

ment of taxes, and making disposition of certain lands so delinquent, and of certain escheated lands, for the benefit of actual and bona fide holders thereof under grants from the commonwealth, passed in 1831.

Mr. Bocock, from the committee for courts of justice, presented the following bills:

No. 102. A bill changing the time of holding the circuit superior courts of the counties of Randolph, Barbour, Taylor and Harrison; and

No. 103. A bill divorcing Stephen Odell from his wife Eleanor.

And as a part of the Criminal Code the following bills:

No. 104. A bill concerning offences against public justice; and

No. 105. A bill concerning forgery.

On motion of Mr. Bocock the two last bills were ordered to be printed.

Mr. BURWELL, from the committee of schools and colleges, presented the following bill:

No. 106. A bill to incorporate the Richmond male orphan society.

Mr. HARVIE, from the committee of finance, presented reports upon resolutions for authorizing clock pedlars and others to transfer their licenses; for authorizing sheriffs to retain in their hands claims against the commonwealth till the taxes are paid; and for directing the sheriffs to specify each subject of taxation in their tax bills. Mr. DAVIS, from the committee on agriculture and manufactures, presented the following bill:

No. 107. A bill to amend an act, entitled "an act to reduce into one the several acts now in force concerning the inspection of tobacco," passed March 6th, 1819.

On motion of Mr. STEPHENSON the special order of the day on the bill No. 63, entitled a bill to incorporate the Potomac and Ohio railroad company, was postponed until to-morrow.

Mr. WALL presented a petition of the stockholders of the Valley turnpike company, praying that three proxies to represent the state in said company may be appointed instead of one.

Mr. BURDETT a petition of citizens of the county of Taylor, asking that some modification may be made in the tolls receivable at the gate and bridge in said county, on the Northwestern road.

Also a memorial of citizens of the county of Taylor, remonstrating against changing the terminus of the Baltimore and Ohio railroad company as heretofore fixed, and praying that no other company may be incorporated to construct a railroad from the Potomac to any point on the Ohio river south of Wheeling.

Mr. DUNCAN a petition of citizens of the county of Harrison, for the incorporation of a company to make said railroad from the Potomac to some point on the Ohio river, not further south than the mouth of the Little Kanawha.

Mr. Love a petition of citizens of the town and county of Alexandria, for a subscription by the state to a part of the capital stock of the Alexandria canal.

Ordered, That the said petitions be referred to the committee of roads and internal navigation.

On motion of Mr. Love, Ordered, That the said last petition be printed for the use of the general assembly. [Doc. No. 26.]

Mr. WAGGONER presented a memorial of citizens of the county of Mason, remonstrating against the formation of a new county out of parts of the counties of Mason, Cabell and Kanawha, which was ordered to be referred to the committee of propositions and grievances.

A message was received from the senate by Mr. M'MULLEN, who informed the house that the senate agreed to the amendment proposed by the house to the resolution of the senate for enquiring into arrangements made by the Richmond, Fredericksburg and Potomac railroad company and other railroad companies with individuals or others in relation to the use of the funds of said companies.

No. 28. A bill to provide for the completion of the James river and Kanawha canal from tidewater at Richmond to the town of Buchanan and for other purposes, with the substitute thereto proposed by Mr. STROTHER, and the amendment proposed to said substitute by Mr. PATRICK, was taken up; thereupon Mr. PATRICK, with the consent of the house withdrew his said amendment.

The said substitute was then further amended on motion of Mr. PATRICK.

The sixth section of the said substitute contained the following clause: "And that the said president and directors shall expend, if so much be required, sixty thousand dollars of the said stock in the construction of a dam and lock across the Kanawha river at Tyler's shoals, or as near thereto as a suitable foundation for the same can be obtained, and in the completion of the connections."

A motion was made by Mr. NEWTON, that the blank in said clause be filled with the following words: "Tidewater connection, three hundred and fifty thousand dollars: Provided however, That of the said sum of three hundred and fifty thousand dollars the stock for one hundred and fifty thousand dollars shall be issued in the year 1847, and the stock for two hundred thousand dollars shall be issued in the year 1848 or 1849, as may be required."

And the question being put upon inserting the same, was determined in the negative. Ayes 47, noes 66. On motion of Mr. SMITH the vote was recorded as follows:
