Mr. BREATHED presented two petitions of citizens of the county of Morgan for the passage of an act guaranteeing the bonds of the Chesapeake and Ohio canal company to enable them to complete their said canal, which were ordered to be referred to the committee of roads and internal navigation.

On motion of Mr. STEPHENSON the following report of the committee for courts of justice was taken up and read:

The committee for courts of justice have, according to order, had under consideration the petition of James R. Jones for a divorce from his wife Elizabeth, to them referred, and have come to the following resolution thereupon:

Resolved as the opinion of this committee, That the prayer of the petition be rejected.

On motion of Mr. STEPHENSON the said resolution was amended by striking out the words "be rejected" and inserting in lieu thereof the words "is reasonable," and as amended was agreed to.

Ordered, That said committee prepare and bring in a bill conformably with said petition.

On motion of Mr. CALWELL the following report of the committee for courts of justice was taken up and read:

The committee for courts of justice have, according to order, had under consideration the petition of Amanda Gosling "praying for a divorce from her husband Palma Gosling," to them referred, and have come to the following resolution thereupon:

Resolved as the opinion of this committee, That the prayer of the petition be rejected.

On motion of Mr. CALWELL the said resolution was amended by striking out the words "be rejected" and inserting in lieu thereof the words "is reasonable," and as amended was agreed to.

Ordered, That the said committee prepare and bring in a bill conformably with said petition.

On motion of Mr. THOMPSON of Dinwiddie the rule of the house was suspended, and the vote by which an engrossed bill prescribing the place of holding separate elections in Newtown Stephensburg, Frederick county, was rejected, was reconsidered; thereupon a motion was made by Mr. WALL to reconsider the vote ordering said bill to be engrossed, and it was determined in the negative; the question then recurred upon the passage of said bill and was determined in the negative. Ayes 58, noes 59.

Mr. COCKE, from the committee of finance, presented the following bill:

No. 319. A bill to authorize the payment of two hundred and sixty-nine dollars and sixty cents to Joseph R. Bentley.

On motion of Mr. Cook, Resolved, That the committee on the militia laws be instructed to enquire into the expediency of bringing in a bill authorizing the distribution of so many of the condemned arms as may be necessary amongst the commandants of regiments for drill purposes.

No. 313. An engrossed bill authorizing the issuing of certain licenses was read a third time; thereupon a clause by way of ryder thereto was submitted by Mr. GRESHAM, which was twice read and forthwith engrossed and read a third time, and the bill with the ryder was passed; and the title having been amended on motion of Mr. STOVALL, was, as amended, agreed to as follows: "An act authorizing the issuing of certain licenses, and for other purposes."

No. 10. The bill, entitled "an act concerning emancipated slaves," with the amendments thereto proposed by the senate, was taken up on motion of Mr. STOVALL, and the said amendments being read, were severally agreed to. Ordered, That the clerk inform the senate thereof.

No. 12. An engrossed bill to incorporate the directors of the Scientific and Eclectic medical institute, was taken up on motion of Mr. STOVALL and read a third time; thereupon a clause by way of ryder thereto was submitted by Mr. MAYO, which was twice read and forthwith engrossed and read a third time, and the bill and ryder were passed.

Ordered, That the clerk communicate the same to the senate and request their concurrence.

No. 65. A bill to amend the act passed 5th March 1846, incorporating the Hardy and Winchester turnpike company, was on motion of Mr. HIETT, ordered to be laid upon the table.

No. 30. A bill to provide for cases in which the courts have failed to comply with the act of the 5th March 1846, amending the present primary school system, and for other purposes, with the substitute thereto proposed by the committee of schools and colleges, was on motion of Mr. BURWELL, ordered to be laid upon the table, and the said substitute was ordered to be printed.

A message was received from the senate by Mr. ROGERS, who informed the house that the senate had passed the bill, entitled "an act to authorize the Board of public works to purchase two fifths of the stock of the Alexandria canal company."

A message was received from the senate by Mr. STANARD, who informed the house that the senate had passed the bills, entitled "an act to provide for the completion of the James river and Kanawha canal from tidewater at Richmond to the town of Buchanan, and for other purposes," (No. 28;) and "an act to authorize the Farmers Bank of Virginia and the Exchange Bank of Virginia to establish offices of discount and deposit in the town of Alexandria, and for other purposes." (No. 127:)

A message was received from the senate by Mr. M'MULLEN, who informed the house that the senate had passed the bill, entitled "an act to increase the capital stock of the Staunton and James river turnpike company, for the purpose of M'Adamizing their road." (No. 27.)

No. 82. A bill to amend, for the county of Loudoun, the act for the establishment of district free schools, passed February 25th, 1846, was read a second time, amended on motions severally made, and as amended ordered to be engrossed and read a third time.

The following bills were read a second time and ordered to be engrossed and read a third time, viz:

No. 80. A bill authorizing the county court of Amelia to reassess the lands of Francis A. Wilson; and No. 81. A bill granting aid to the Northwestern Virginia academy.

On motion of Mr. Bocock, Ordered, That the committee for courts of justice be discharged from the consideration of the petitions of citizens of the county of Augusta, asking for a change in the jury system; of John M. Preston; of certain notaries public of the City of Norfolk and town of Portsmouth; and of notaries public of the town of Lynchburg, each asking for an increase of their fees; and that the said petitions be laid upon the table.

Mr. BANKS, from the committee of propositions and grievances, presented reports upon the petitions of citizens of the counties of Tazewell, Wythe and Smyth, for a new county; of the trustees of the town of Lewis

burg in the county of Greenbrier; of the division No. 31 of the Sons of Temperance, for an act of incorporation; and the following bill:

No. 322. A bill prescribing regulations to be observed in making applications for the formation of new counties.

Mr. BANKS announced that the said committee having finished the business before it had no further occasion for a clerk, and that officer was ordered to be discharged accordingly.

No. 323. A bill appropriating a sum of money for the benefit of Samuel Freeman of the City of Richmond. Mr. DAVIS, from the committee on agriculture and manufactures, presented a report upon the petition of Abram M'Collock and other citizens of the county of Ohio; and the following bill:

No. 324. A bill to incorporate the Farmville manufacturing company.

Mr. HUNTER, according to order, presented the following bill:

No. 325. A bill amending the act passed the 25th February 1846, establishing district free schools in the counties of Frederick and Jefferson.

On motion of Mr. HARRISON of Loudoun, Resolved, That leave be given to bring in a bill incorporating a company to construct a bridge from the Point of Rocks in the county of Frederick, state of Maryland, across the Potomac to some point on the Virginia shore opposite the Potomac furnace property.

The SPEAKER deferred announcing the committee to bring in said bill until to-morrow.

On motion of Mr. WILLIAMS, leave was granted to withdraw the petition of the heirs of John Nelson, presented at the present session of the general assembly.

On motion of Mr. STOVALL, leave was granted to withdraw the petition of Stephen Kent, presented in like

manner.

On motion of Mr. TUNSTALL, the report of the joint committee on the public library was taken up and read. [Doc. No. 50.]

The resolution contained in said report is the following:

Resolved, That the accounts of the librarian ending the 31st December 1846, be received and allowed. And the question being put thereupon was agreed to by the house.

No. 42. A bill providing for the extension of the Louisa railroad to the eastern base of the Blue Ridge, was taken up on motion of Mr. DARRACOTT, read a second time, and amended on motions severally made, and as amended ordered to be engrossed and read a third time.

No. 222. A bill authorizing the state's guarantee to certain bonds of the Chesapeake and Ohio canal company, was taken up on motion of Mr. HUNTER, read a second time and ordered to be engrossed and read a third time.

No. 65. A bill to amend the act passed 5th March 1846, incorporating the Hardy and Winchester turnpike company, with the amendments thereto proposed by the committee of roads and internal navigation, was taken up on motion of Mr. LEE, and the said amendments being read were agreed to.

The said bill contained the following as its third section:

"Be it further enacted, That the Board of public works be and they are hereby authorized to subscribe on behalf of the commonwealth for eight hundred shares, being two fifths of the capital stock of said company, upon the terms and conditions prescribed by the act, entitled 'an act prescribing certain general conditions on which future subscriptions to the capital of joint stock companies shall be made on behalf of the commonwealth,' passed February 11th, 1832."

A motion was made by Mr. STOVALL to strike from the bill the said section, and it was determined in the negative. Ayes 49, noes 56.

No. 107. A bill to amend an act, entitled "an act to reduce into one the several acts now in force concerning the inspection of tobacco," passed March 6th, 1819, was read a second time, amended on motion of Mr. Fox, and as amended ordered to be engrossed and read a third time.

No. 169. A bill to incorporate commissioners of the public schools in Portsmouth, was on motion of Mr. WATTS, ordered to be laid upon the table.

On motion of Mr. HUNTER, the rule of the house was suspended, and the vote rejecting a bill to provide for the construction of a road from Bath in Morgan county, to the mouth of St. John's run on the Potomac, was reconsidered, and the said bill was ordered to be engrossed and read a third time.

Mr. NEWTON Submitted a substitute intended to be offered by him for the bill providing for the connection of the canal or basin at Richmond with the tidewater of James river through the Richmond dock, and for other purposes, which on his motion was ordered to be printed.

On motion of Mr. YERBY the house adjourned until to-morrow morning 10 o'clock.

WEDNESDAY, MARCH 3, 1847.

A communication was received from the senate by their clerk, which was read as follows:

The senate have passed the bill, entitled

IN SENATE, MARCH 2, 1847.

"An act to authorize the Lynchburg and Salem turnpike company to M'Adamize their road, and for other purposes." (No. 44.)

They have also passed the bill, entitled

"An act changing the times of holding the circuit superior courts of Cumberland and Appomattox and the town of Lynchburg," (No. 47,) with amendments, in which they request the concurrence of the house of delegates.

And they have rejected the bill, entitled

"An act concerning free negroes and mulattoes." (No. 68.)

The said amendments being twice read, on motion of Mr. TUNSTALL the said bill was ordered to be laid upon the table.

The SPEAKER announced the following as the committee to bring in the bill under the resolution submitted on yesterday by Mr. HARRISON of Loudoun, viz: Messrs. Harrison of Loudoun, Hunter, Carson, Stephenson, Maclin, Edmondson of Lunenburg, and Brown of Monongalia.

On motion of Mr. LEAKE, Resolved, That a select committee be appointed to enquire into the expediency of bringing in a bill to incorporate a company for the purpose of manufacturing iron, cotton, wool and other articles in the county of Goochland, to be called "The Tuckahoe aqueduct factory."

Ordered, That the said committee be composed of Messrs. Leake, Lancaster, Thompson of Dinwiddie, Cocke, Castleman, Brown of Albemarle, and Cardwell.

Mr. DANIEL, from the committee of privileges and elections, presented a report upon the sheriffs' returns of elections and the qualifications of members.

Mr. LEE, from the committee of roads and internal navigation, presented the following bill:

No. 326. A bill to incorporate the Mattaponi navigation company.

Mr. BENNETT presented a petition of citizens of the county of Lewis, asking for an appropriation to build bridges on the Staunton and Parkersburg road, which was ordered to be referred to the committee of roads and internal navigation.

The following report of the committee for courts of justice was taken up on motion of Mr. PERROW: The committee for courts of justice have, according to order, had under consideration the petition of Paulina P. Wright to them referred, praying for a divorce from her husband Shelton Wright, and have come to the following resolution thereupon:

Resolved as the opinion of this committee, That the prayer of the petition be rejected.

On motion of Mr. PERROW, the said resolution was amended by striking therefrom the words "be rejected," and inserting in lieu thereof the words "is reasonable," and as amended was agreed to by the house.

Ordered, That the said committee prepare and bring in a bill conformably therewith.

On motion of Mr. M'PHERSON, Resolved, That the committee on agriculture and manufactures enquire into the expediency of reviving the acts, entitled "an act incorporating the Virginia Fortsmouth iron company," and "an act incorporating the Virginia chlorine company," passed February 19th, 1845; also into the expediency of reviving the act, entitled "an act incorporating the South Shenandoah copper company," passed February 21st, 1845.

On motion of Mr. JONES of Gloucester, Resolved, That the committee of schools and colleges be instructed to enquire into the expediency of bringing in a bill authorizing an allowance of forty-two dollars and thirty-two cents to Lewis C. Booker of Gloucester county, being the amount of his account for the tuition of poor children in said county for the year 1845.

Mr. HILL of Fayette and Nicholas submitted the following resolution, which on motion of Mr. Watts, was ordered to be laid upon the table, viz:

Resolved, That no member of this house shall have leave to speak on any one subject for a longer period than ten minutes during this session.
