Lawson 141; as register of the land office, for Stafford H. Parker 141; as secretary of the commonwealth and librarian, for William H. Spotts 140, scattering 1; thereupon the several gentlemen having a majority of the whole vote, were declared severally elected for the various offices to which they were nominated, each for one year from the expiration of the term for which the present incumbents of those offices were elected.

No. 47. A bill changing the time of holding the circuit superior courts of Cumberland and Appomattox counties and the town of Lynchburg, was taken up, and ordered to be engrossed and read a third time.

No. 73. A bill to authorize the auditor to issue a warrant upon the treasury in favour of Peter Moore's administrator, with the substitute thereto reported by the committee of finance, was taken up, and the said substitute being read, was agreed to, and the said bill as amended was ordered to be engrossed and read a third time.

A message was received from the senate by Mr. WALLACE, who informed the house that the senate agreed to the resolution authorizing the payment to the captains of the second battalion of the Virginia regiment of volunteers, and others, for expenses incurred in the organization of their respective companies, with amendments, in which they request the concurrence of the house of delegates.

No. 28. A bill to provide for the completion of the James river and Kanawha canal from tidewater at Richmond to the town of Buchanan, and for other purposes, with the amendments thereto proposed by the committee of roads and internal navigation, was taken up, and the said amendments being agreed to, Mr. DORMAN submitted a substitute for the said bill as amended, and the question being put upon adopting said substitute it was determined in the affirmative. Ayes 71, noes 50.

SATURDAY, FEBRUARY 27, 1847.

A communication was received from the senate by their clerk, which was read as follows:

IN SENATE, FEBRUARY 24, 1847.

The senate have agreed to the resolution providing for the distribution of the printed copies of the report of the revisors of the Civil Code.

The resolution authorizing the payment to the captains of the second battalion of the Virginia regiment of volunteers, and others, for expenses incurred in the organization of their respective companies, with the amendments thereto proposed by the senate, was on motion of Mr. WATTS, ordered to be laid upon the table.

Mr. Bocock, from the committee for courts of justice, presented the following bill:

No. 311. A bill ceding to the United States jurisdiction over St. Helena.

Mr. BURWELL, from the committee of schools and colleges, presented the following bill:

No. 312. A bill incorporating the trustees of the Columbia academy in the county of Fluvanna.

Mr. BANKS, from the committee of propositions and grievances, presented reports upon the petitions of citizens of the county of Middlesex for an act for taking the sense of the people upon the removal of the seat of justice; of citizens of the county of Shenandoah for a separate election in said county; of citizens of the county of Fluvanna for a separate election in that county; of citizens of the county of Rockbridge for a separate election in that county; of citizens of the town of Beverley for an act of incorporation; and upon the resolution for incorporating the town of Moundsville.

Mr. WATTS, from the committee on the militia laws, presented reports upon the petitions of the officers of the 168th regiment of militia asking to be furnished with certain equipments; and of the officers of the 113th regiment of militia for the formation of a new regiment in the county of Wood.

On motion of Mr. SYME, the following resolution submitted by Mr. WATTS on yesterday, was taken up. Resolved, That the committee charged with the investigation of the charges against judge Gholson, have power to cause so much of the testimony in said investigation to be printed for the use of the committee as they may deem relevant and proper.

And the question being put thereupon, was determined in the negative.

On motion of Mr. WATTS, Resolved, That the governor be requested to furnish this house with a statement exhibiting the amount allowed and paid to the officers of the volunteer companies of the first regiment for expenses incurred in raising, organizing and transporting said companies, together with such claims as have been rejected by him, and the grounds of their rejection.

On motion of Mr. STOVALL, Resolved by the general assembly of Virginia, That the resolution of the assembly adopted the 12th of January 1846, entitled "a resolution to rescind the resolution requiring notice to be given to persons having claims on Virginia for revolutionary land bounty to present the same by a given day for adjustment, or that the same shall thereafter be void, and extending the time for prosecuting their claims," be rescinded, and that claimants of revolutionary land bounty be allowed till the 1st of March 1850 to prosecute their claims.

2. Resolved, That the register of the land office be, and he is hereby instructed to publish the foregoing resolution in such newspapers as may be most likely to give notice of the same.

Ordered, That the clerk communicate the same to the senate and request their concurrence.

Mr. SYME presented certain documents to be used as evidence to support the claim of Capt. William M. Robinson; which was ordered to be referred to the committee of claims.

On motion of Mr. HARGRAVE leave was given to withdraw the petition of Nancy Lane, presented at the last session of the general assembly, praying to be divorced from her husband.

Mr. HARGRAVE then presented again the said petition, and it was ordered to be referred to the committee for courts of justice.

Mr. HARGRAVE presented a petition of the school commissioners and other citizens of the county of Surry asking to be exempted from the operation of a law passed the 5th March 1846, amending the primary school system, which was ordered to be referred to the committee of schools and colleges.

Mr. SHEFFEY presented a petition of members of the Rechabite division No. 31 of the Sons of Temperance, praying for an act of incorporation for said division, which was ordered to be referred to the committee of propositions and grievances.

No. 47. An engrossed bill changing the times of holding the circuit superior courts of Cumberland and Appomattox and the town of Lynchburg, was read a third time and passed.

Ordered, That the clerk communicate the same to the senate and request their concurrence.

The question was then reconsidered, and recurring again upon the passage of the bill and ryder, a motion was made by Mr. SHEFFEY that the rule of the house be suspended for the purpose of reconsidering the vote by which the ryder was ordered to be engrossed, and it was determined in the affirmative; and the question being again put upon engrossing the ryder, it was ordered to be engrossed, and was forthwith engrossed and read a third time; and the question being again put upon the passage of the bill and ryder, was determined in the affirmative. On motion of Mr. SHEFFEY the rule of the house was suspended, and the vote adopting the title to the bill, entitled "an act to incorporate the Bank of Potomac in Alexandria," was reconsidered; thereupon the title was amended, and as amended agreed to as follows: "An act to authorize the Farmers Bank of Virginia and the Exchange Bank of Virginia to establish offices of discount and deposit in the town of Alexandria, and for other purposes."

A communication was received from the senate by their clerk, which was read as follows:

The senate have passed the bill, entitled

IN SENATE, FEBRUARY 27, 1847.

"An act changing the dividing lines between the counties of Lewis and Gilmer," with amendments, in which they request the concurrence of the house of delegates.

And they have agreed to the preamble and resolutions relative to the prohibition by the congress of the United States of slavery in any territory to be acquired by conquest or treaty, with amendments, in which they request the concurrence of the house of delegates.

The said amendments to the said bill being read, were severally agreed to, and it was ordered that the clerk inform the senate thereof.

The said amendments to the said resolution being read, on motion of Mr. DORMAN the same were laid upon the table.

Mr. BANKS, from the committee of propositions and grievances, presented reports upon the petitions of citizens of Fayette county for a new county; of citizens of the counties of Preston, Taylor and Barbour, also for a new county; and upon a resolution for causing the public lot attached to the scale house for weighing live stock to be paved.

Mr. HOLLADAY, from the committee of claims, presented reports upon the petition of the president and directors of the Lynchburg and Buffaloe springs turnpike company; and upon the resolution for refunding certain damages and costs to Thomas Towson late sheriff of Stafford county.

On motion of Mr. HOLLADAY the committee of claims were discharged from the consideration of the petitions of James Wells of the county of Lee; of the heirs of John Nelson; of William Sheppard late sheriff of Jackson county; of David S. Jones of Rockingham county; of Capt. William M. Robinson; of Alex. M'Dougald; and of John Hannon; and from the resolutions for refunding to William T. Joynes, certain money; for paying the expenses incurred by Lewis M'Kenzie in transporting the Alexandria volunteers to Richmond; for refunding to Benjamin Riddell a sum of money; and for paying the expenses incurred by Capt. John W. Rowan in the enlistment and organization of his company of volunteers; and the said petitions and resolutions were ordered to be laid upon the table.

Mr. WATTS, from the committee on the militia laws, presented a report on the petition of the officers of the 47th and 88th regiments of militia for the restoration of the office and pay of brigade inspectors.

Mr. DORMAN, from the committee of roads and internal navigation, presented the following bills:

No. 314. A bill to provide for the construction of a dam and lock by the James river and Kanawha company at the town of Jefferson.

No. 315. A bill to revive the Goose creek navigation company.

No. 316. A bill providing for the connection of the James river and Kanawha canal with the tidewater of James river at Richmond and for other purposes.

No. 317. A bill incorporating the Moorfield and North branch turnpike company; and

No. 318. A bill to amend the act passed the 27th February 1829, prescribing a tariff of tolls on the Kanawha river.

On motion of Mr. DORMAN the committee of roads and internal navigation was discharged from the consideration of the petition of the president and directors of the Louisa railroad company, complaining of the violation by the Richmond, Fredericksburg and Potomac railroad company of a contract with said Louisa company, and the memorials and remonstrances relative to the same subject; and of citizens of the counties of Cabell and Wayne for a subscription by the state to the stock of the railroad from Richmond to the Ohio river, and that the said petitions be laid upon the table.

On motion of Mr. STEPHENSON, Resolved, That the first auditor be instructed to prepare and cause to be printed by the public printer, in convenient form and submitted to the house of delegates at its next session, tabular statement embracing the following information, to wit: the white and black population of the state, the latter embracing free negroes according to the census of 1830 and 1840, arranged in counties and towns and in the four great divisions of the state; also the federal population, the land and property tax and free white titheables in each of the said years, arranged in the same manner; also the free white and black titheables and land and property tax for the year 1846, arranged in the four great divisions as aforesaid.

On motion of Mr. DORMAN, Ordered, That 1000 copies of the said tabular statement, when made, be printed for the use of the next general assembly.

Mr. GRESHAM presented a petition of citizens of the counties of Richmond, Westmoreland and Essex for the passage of an act more effectually to prevent the destruction of fish in the Rappahannock river, which was ordered to be referred to the committee of propositions and grievances.
