Mr. HUNTER presented a petition of citizens of the county of Jefferson, asking a change in the school law as it applies to that county, together with certain resolutions of the school commissioners on the same subject, which was ordered to be referred to the committee of schools and colleges.

Mr. DAVIS presented a petition of Lucy M. Montague, asking to be divorced from her husband William W. Montague, which on his motion was ordered to be laid upon the table.

Mr. HAPPER presented a memorial of citizens of the county of Norfolk, remonstrating against the petition of citizens of the town of Portsmouth, asking for an act incorporating said town.

Mr. M'PHERSON a petition of citizens of the county of Shenandoah, for the establishment of a separate election at Forrestville in said county.

Ordered, That the said petitions be referred to the committee of propositions and grievances.

Mr. MAYO presented a document to support the petition of Samuel Freeman, which was ordered to be referred to the committee of claims.

No. 233. A bill to authorize the Baltimore and Ohio railroad company to construct the extension of their railroad through the territory of Virginia, with the substitute thereto proposed by Mr. HUNTER, and the amendment thereto submitted by Mr. EDGINGTON, was taken up.

The first section of the substitute is the following:

"Be it enacted by the general assembly, That the Baltimore and Ohio railroad company be and they are hereby authorized to complete their road through the territory of this commonwealth, so as to terminate the same on the northern side of Wheeling creek in the City of Wheeling in the county of Ohio: Provided however, That they shall not be permitted to strike the Ohio river at a point lower down than at or near the mouth of Fishing creek in the county of Wetzel: And provided further, That the said road shall be constructed to and by way of a point on the Tygart's Valley river at or not further than three miles from the mouth of Three Fork creek in the county of Taylor."

The said amendment proposed to strike out the words in italics and insert in lieu thereof the following: "To pass from a point in the ravine of Buffaloe creek at or near the mouth of Pile's fork to a depot to be established by said company on the northern side of Wheeling creek in the City of Wheeling in Ohio county, by such route, as upon minute estimates to be made after full examinations and instrumental surveys of the feasible or practicable routes shall appear to be the cheapest upon which to construct, maintain and work said railroad: which estimates shall be made on like principles and plans, in like manner, and upon as great respective amounts of trade and travel as were adopted and employed in the comparative estimates of the company's chief engineer laid before the meeting of the stockholders of the said company held in Baltimore on the twelfth day of July eighteen hundred and forty-five: Provided, That said railroad shall not be made to enter the ravine of the Ohio river at any point further south than the mouth of Fish creek in Marshall county: And provided, That if the said railroad by the cheapest route to the City of Wheeling which shall not enter the ravine of the Ohio river at any point south of Grave creek in Marshall county, shall appear from the estimates to be made as aforesaid, to be more costly to construct, maintain and work than it would be by the route passing into the ravine of the Ohio river at or near the mouth of Fish creek, and thence to the City of Wheeling; and if when the difference of probable cost between said two routes shall be ascertained as aforesaid, the City of Wheeling shall agree to pay to said railroad company such difference of cost by the time said railroad shall be completed and opened for transportation to said depot in Wheeling, (which payment it shall be lawful for the said City of Wheeling to provide for and make,) then the said railroad company are hereby required to locate and construct their said railroad so that in passing to said depot in Wheeling it shall not enter the ravine of the Ohio river at any point south of Grave creek. "Be it further enacted, That to secure to the said City of Wheeling the benefits of the western terminus, all parts of the said railroad between the Monongahela river and said terminus shall be opened for the transportation of freight and passengers simultaneously; and the aggregate charge for toll and transportation, upon freight and passengers respectively, shall be the same between Baltimore and any point on said road within a direct distance of five miles from the Ohio river, as between Baltimore and Wheeling."

The amendment being under discussion, Mr. Cook demanded the previous question, and it was sustained by the house, and the question being put upon adopting said amendment, was determined in the affirmative. Ayes 66, noes 57.

On motion of Mr. ROBINSON, Resolved, That the committee on agriculture and manufactures enquire into the expediency of establishing an inspection of flour at the King William mills on Pamunkey river in King William county.

On motion of Mr. NEWTON, Resolved, That the committee of roads and internal navigation be directed to enquire into the expediency of reporting a bill authorizing the James river and Kanawha company to apply the surplus revenue of the Richmond dock after payment of its debt to the borrowing of a sum necessary to the completion of the dock and its connection with the basin.

On motion of Mr. FITZHUGH, Resolved, That the committee of claims be instructed to enquire into the expediency of refunding to Thomas Towson, late sheriff of Stafford county, the amount of damages and costs paid by him by virtue of a judgment obtained by the auditor against him at the June term of the general court in 1846.

Mr. MAYO presented a petition of Frederick Anderson asking for the remission of certain taxes, which was ordered to be referred to the committee of finance.

On motion of Mr. WATTS, Ordered, That leave be given to withdraw the petition of the citizens of the town of Portsmouth for the incorporation of said town, and the memorial of citizens of the county of Norfolk remonstrating against said petition.

An engrossed bill to transfer the commonwealth's right in a tract of forfeited land in the county of Lewis to the Buchanan academy in that county, was read a third time; thereupon a ryder thereto was submitted by Mr. STEPHENSON, which being twice read, an amendment was offered by Mr. HAYMOND, and then on motion of Mr. STEPHENSON the bill and ryder were laid upon the table.

Mr. TUNSTALL presented a petition of the officers and privates of the 168th regiment asking that said regiment may be furnished with a stand of colours and a drum and fife; which was ordered to be referred to the committee on the militia laws.

A message was received from the senate by Mr. BAPTIST, who informed the house that the senate had passed the bills, entitled "an act amending the act, entitled 'an act regulating the tolls of the Manchester turnpike company,'" passed March 12th, 1834, (No. 135;) and "an act divorcing Helen A. W. Hamilton from her husband Robert S. Hamilton," (No. 20.)

A motion was made by Mr. HUNTER that the rule of the house be suspended for the purpose of reconsidering the vote rejecting an engrossed bill to increase the capital stock of the Staunton and James river turnpike company, for the purpose of M'Adamizing their road; thereupon a motion was made by Mr. HART that the said motion be laid upon the table.

Mr. LEAKE, from the committee on banks, presented the following bill:

No. 303. A bill to incorporate the Holcombe savings bank at Lynchburg.

Mr. LAYNE, from the joint committee appointed to examine the penitentiary institution, presented a report, which on his motion was laid upon the table and ordered to be printed. [Doc. No. 50.]

Mr. CASTLEMAN presented sundry affidavits to be used as evidence to support the petitions relating to the Little's falls railroad; which were ordered to be laid upon the table.

On motion of Mr. BALLARD, Resolved, That when this house adjourns on Saturday next, it will adjourn to meet on Monday next at 10 o'clock A. M.

A communication was received from the senate by their clerk, which was read as follows:

"An act concerning emancipated slaves," (No. 10,) with amendments, in which they request the concurrence of the house of delegates.

The said amendments being read, on motion of Mr. Bocock the said bill was laid upon the table.

On motion of Mr. WATTS, Resolved, That the committee of roads and internal navigation enquire into the expediency of re-enacting the act passed 14th January 1845, incorporating the Bower's Hill turnpike company.

Mr. SCOTT, from the committee for courts of justice, presented as a part of the Criminal Code, the following bills:

No. 304. A bill concerning the arrest and examination of offenders, commitment for trial and taking bail. No. 305. A bill concerning indictments, presentments and informations.

Mr. BANKS, from the committee of propositions and grievances, presented reports upon the petitions of citizens of the town of Portsmouth for an act of incorporation; and of citizens of the county of Frederick, asking a change in the place of holding a separate election in said county.

On motion of Mr. BANKS, Ordered, That the committee of propositions and grievances be discharged from the consideration of the petitions of William S. M'Cabe and others of Bedford county; of S. O. Anderson and others; of J. D. Alexander and others; of citizens of the county of Roanoke; of David Graham and others, citizens of Wythe county; of citizens of the James river valley; of William A. On motion of Mr. HILL of Fayette and Nicholas, Resolved, That the committee of finance enquire into the expediency of refunding to William Myles the taxes on $2000 paid by him in the year 1843, and ou $1000 paid in the year 1844, the taxes on the same being illegally charged to him and paid.

Mr. LEE presented a petition of citizens of the county of Hardy, for the passage of an act to incorporate a company to construct a turnpike road from Patterson's creek depot to Moorfield.

Mr. MAYO presented a petition of the James river and Kanawha company, asking for pecuniary aid from the state to complete their works, and for an extension of their charter.

Ordered, That the said petitions be referred to the committee of roads and internal navigation.

A bill to incorporate the Bank of Potomac in Alexandria, with the amendment thereto proposed by the committee to which the same had been committed, was taken up on motion of Mr. TYLER, and the said amendment being agreed to, the said bill as amended was ordered to be engrossed and read a third time.

A motion was made by Mr. WATTS that the house adopt the following resolution, viz:

Resolved, That the committee charged with the investigation of the charges against judge Gholson, have power to cause so much of the testimony in said investigation to be printed for the use of the committee as they may deem relevant and proper.

On motion of Mr. HAYMOND the said resolution was ordered to be laid upon the table.
