Ordered, That the Clerk return said bill to the Assembly, with a message that the Senate has concurred in the passage of the

same.

The Senate bill (No. 1290, Int. No. 1183) entitled "An act to incorporate Sprague Chapel,'" was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present as follows:

The Assembly bill (No. 1410, Rec. No. 420) entitled "An act to amend the Insurance Law, in relation to group life insurance, was read the third time.

Ordered, That the Clerk return said bill to the Assembly, with a message that the Senate has concurred in the passage of the same. Pursuant to notice heretofore given, Mr. Love moved that the committee on codes, be discharged from the consideration of Senate bill (No. 16, Int. No. 16) entitled "An act to amend the Penal Law, in relations to prosecutions for the sale and circulation of obscene or disgusting literature."

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

The Senate bill (No. 1673, Int. No. 1327) entitled "An act to amend the Insanity Law, relative to the commitment of the insane, and of inebriates," having been announced for third reading.

Mr. Fearon moved that said bill be recommitted to the committee on general laws, with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Fearon, from the committee on general laws, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

The Senate resolved itself into a committee of the whole and proceeded to the consideration of general orders, being the bills entitled as follows:

(1) Senate (No. 1608, Int. No. 209) entitled "An act to amend the Domestic Relations Law, in relation to the domicile of a married woman.

(2) Senate (No. 1601, Int. No. 822) entitled "Concurrent resolution of the Senate and Assembly proposing an amendment to section ten of article eight of the Constitution, in relation to the limitation of indebtedness of cities."

(3) Senate (No. 1592, Int. No. 1229) entitled "An act to amend the Insanity Law, in relation to the duties of local officers of the city of New York."

(4) Assembly (No. 1487, Senate reprint No. 1719, Rec. No. 187) entitled "An act to amend the Judiciary Law, in relation to the appointment of official referees."

(5) Senate (No. 1436, Int. No. 1289) entitled "An act to authorize the water power commission of the State to negotiate with other states, the District of Columbia and Canadian provinces, compacts under the Constitution of the United States for action by the Legislature for the regulation of interstate and foreign transmission and delivery of electric current."

(6) Senate (No. 1536, Int. No. 1366) entitled "An act to amend the Education Law, in relation to requiring instruction in fire prevention to be given in the schools of the State."

(7) Senate (No. 1602, Int. No. 965), entitled "An act, to amend the Civil Practice Act, in relation to summary proceedings to recover possession of real property.'

(8) Senate (No. 1641, Int. No. 974), entitled "An act to amend the New York City Municipal Court Code, generally."

(9) Senate (No. 1640, Int. No. 1107), entitled "An act to amend the Civil Practice Act, in relation to pleading items of work, labor or services, and of materials furnished.

After some time spent therein, the Presiden, resumed the chair, and Mr. Nicoll, from said committee reported in favor of the passage of the above named bills, which report was agreed to and said bills ordered to a third reading.

Mr. Knight moved that the Senate do now adjourn.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. Whereupon, the Senate adjourned.

The Senate met pursuant to adjournment. Prayer by Rev. W. H. Edwards.

The journal of Tuesday, March 24th, was read and approved. Mr. Hastings introduced a bill (Int. No. 1468) entitled "An act creating a commission to erect a monument in Prospect park, in the borough of Brooklyn, city of New York, to commemorate the memory of Thomas Jefferson, and making an appropriation therefor, which was read the first time and by unanimous consent was also read the second time and referred to the committee on finance.

Also, a bill (Int. No. 1469) entitled "An act to amend the Public Service Commission Law, in relation to charges by common carriers for the transportation of dairy, farm and orchard products," which was read the first time and by unanimous consent was also read the second time and referred to the committee on public service.

The Assembly sent for concurrence the bill (No. 1579, Rec. No. 426) entitled "An act to repeal section fourteen of chapter three hundred and sixty-five of the laws of eighteen hundred and ninety-four, entitled 'An act to provide for the indexing and reindexing of conveyances, mortgages and other instruments relating to lands and liens thereon in the county of Kings,' relating to certain indexes," which was read the first time and by unanimous consent was also read the second time and referred to the committee on internal affairs of towns, counties and public highways.

Also, a bill (No. 1840, Rec. No. 427) entitled "An act to amend the Farms and Markets Law, in relation to the capacity of a cord of fuel wood," which was read the first time and by unanimous consent was also read the second time and referred to the committee on agriculture.

Also, a bill (No. 1899, Rec. No. 428) entitled "An act to amend the Civil Practice Act and the Surrogate's Court Act, in relation [SENATE JOURNAL]

to commissions of executors, administrators, guardians or testamentary or other trustees,' which was read the first time and by unanimous consent was also read the second time and referred to the committee on codes.

Also, a bill (No. 1897, Rec. No. 429) entitled "An act to amend the Decedent Estate Law, in relation to suit by foreign executors and administrators and continuing actions and proceedings against such executors and administrators," which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Nicoll, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on general laws, retaining place on order of third reading.

Also, a bill (No. 1788, Rec. No. 430) entitled "An act to amend the Election Law, in relation to custodians of voting machines,' which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Gibbs, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Also, a bill (No. 1808, Rec. No. 431) entitled "An act to amend the Civil Service Law, in relation to retirement of officers and employees in the State civil service," which was read the first time and by unanimous consent was also read the second time. On motion of Mr. Nicoll, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Also, a bill (No. 1176, Rec. No. 432) entitled "An act to amend the Labor Law, in relation to the hours of labor of women,' which was read the first time and by unanimous consent was also read the second time and referred to the committee on labor and industry.

Also, a bill (No. 1230, Rec. No. 433) entitled "An act making an appropriation to enable the New York Monuments Commission to investigate as to the feasibility of constructing a monument in the Federal cemetery at Key West, Florida, to the memory of Civil War veterans there buried," which was read the first time and by unanimous consent was also read the second time and referred to the committee on finance.

Also, a bill (No. 1976, Rec. No. 434) entitled "An act to amend the Penal Law, in relation to taking, injuring and destroying trees, wild flowers and other vegetation growing on public and private lands," which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Westall, and by unanimous consent, the rules were suspended and said bill ordered to a third reading."

Also, a bill (No. 1748, Rec. No. 435) entitled "An act to amend the Surrogate's Court Act, in relation to contents of petition for appointment of guardian," which was read the first time and by unanimous consent was also read the second time and referred to the committee on codes.

Also, a bill (No. 1719, Rec. No. 436) entitled "An act to amend the county law, in relation to the creation of county purchasing departments," which was read the first time and by unanimous consent was also read the second time and referred to the committee on internal affairs of towns, counties and public highways. Also, a bill (No. 1759, Rec. No. 437) entitled "An act to amend the Highway Law, in relation to the transfer of registration of motor vehicles," which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Truman, and by unanimous consent, said bill was substituted for Senate bill No. 1390, Int. No. 1260, now on the order of third reading.

Also, a bill (No. 1846, Rec. No. 438) entitled "An act to amend the Highway Law, in relation to the payment by counties of expenses incident to the issuance of motor vehicle registrations and licenses, making transfers and filing notices by the county clerk," which was read the first time and by unanimous consent was, also read the second time.

On motion of Mr. Ferris, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Also, a bill (No. 1856, Rec. No. 439) entitled "An act to amend the Education Law, in relation to certain quotas for central high school districts," which was read the first time and by unanimous consent was also read the second time and referred to the committee on public education.

Also, a bill (No. 1685, Rec. No. 440) entitled "An act to amend the Highway Law, generally," which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Ferris, and by unanimous consent, said bill was substituted for Senate bill No. 1671, Int. No. 1224, now on the order of third reading.

Also, a bill (No. 1767, Rec. No. 441) entitled "An act to amend the New York City Municipal Court Code, in relation to change of boundaries of the Seventh district in the borough of Manhattan, and providing for an additional justice in said borough, and for additional justices in said districts," which was read the first time and by unanimous consent was also read the second time and referred to the committee on codes.

Also, a bill (No. 1725, Rec. No. 442) entitled "An act to amend the Civil Service Law, in relation to eligibility of a former veteran to resume employment in the city service," which was read the first time and by unanimous consent was also read the second time and referred to the committee on civil service.

Also, a bill (No. 1735, Rec. No. 443) entitled "An act to amend chapter five hundred and sixty-four of the Laws of nineteen hundred and two, entitled 'An act in relation to jurors, and to the appointment and duties of a commissioner of jurors in the county of Kings,' in relation to salaries of commissioner and deputy commissioner," which was read the first time and by unanimous consent was also read the second time.
