After some time spent therein, the President resumed the chair, and Mr. Cole from said committee reported in favor of the passage of the above named bills, the 22nd with amendments, which report was agreed to and said bills ordered to a third reading.

Mr. Knight moved that the committee on codes be discharged from the consideration of Assembly bill (No. 1277, Senate reprint No. 1475, Rec. No. 207) entitled "An act to amend the Penal Law, in relation to intoxicating liquor."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

On motion of Mr. Knight, and by unanimous consent, said bill was substituted for Senate bill No. 1605, Int. No. 29, now on the order of third reading.

Mr. Knight moved that the committee on codes be discharged. from the consideration of Assembly bill (No. 958, Rec. No. 206)

entitled "An act to amend the Code of Criminal Procedure, in relation to the enforcement of laws relating to intoxicating liquor."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

On motion of Mr. Knight, and by unanimous consent, said bill was substituted for Senate bill No. 1604, Int. No. 30, now on the order of third reading.

At 11 o'clock and fifty minutes Mr. Knight moved that the Senate stand in recess until one-thirty.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Senate again met.

Mr. Byrne introduced a bill (Int. No. 1438) entitled "An act to amend the Tax Law, in relation to the definition of ground floor in relation to buildings for dwelling purposes which are exempt from taxation, " which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Byrne, and by unanimous consent the rules were suspended and said bill ordered to a third reading and referred to the committee on taxation and retrenchment, retaining place on order of third reading.

Mr. J. F. Williams moved that the committee on finance be discharged from the consideration of Senate bill (No. 1157, Int. No. 1080) entitled "An act to amend section eight of chapter nine hundred and seven of the Laws of nineteen hundred and twenty, entitled 'An act providing for the reconstruction and rebuilding of the bridge crossing the Hudson river and Barge canal and connecting the cities of Troy and Cohoes between the counties of Albany and Rensselaer; apportioning the expense thereof to the State of New York, the counties of Albany and Rensselaer and the cities of Troy and Cohoes; making an appropriation for the share of such expense to be paid by the State and otherwise providing for the payment of such expense,' in relation to the apportionment of the expense of operation of such bridge, and making an appropriation for the State's share thereof," and that said bill be amended, reprinted and recommitted to the committee on finance. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Senate bill (No. 1294, Int. No. 1187) entitled "An act to authorize the Attorney-General to employ counsel to recover from the United States the cost of maintenance and care of alien immigrants," was read the third time.

Jackson against the State for legal services performed during the years nineteen hundred and twenty and nineteen hundred and twenty-one, as special counsel to the Public Service Commission, first district, and to make an award therefor," was read the third time.
