The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

On motion of Mr. Hewitt, and by unanimous consent, said bill was substituted for Senate bill No. 1084, Int. No. 1022, now on the order of third reading.

Mr. Knight moved a closed call of the Senate.

The President put the question whether the Senate would agree to said motion and it was determined in the affirmative.

By direction of the President, the Clerk called the roll, when the following Senators responded:

The Clerk furnished a list of the absentees to the Sergeant-atArms, who appeared in due time before the bar of the Senate, with Messrs. Kennedy, Keck, Thompson, Walker, Wendell, J. F. Williams, Webb, Downing, Dunnigan, Antin, each of whom was excused.

Mr. Knight moved that the Senate proceed to business with the call pending.

The Senate bill (No. 1474, Int. No. 717) entitled An act to amend the State Boards and Commissions Law and the Farms and Markets Law, in relation to the State Fair, the abolition of the State Fair Commission and the transfer of its powers and duties to the Department of Farms and Markets," having been announced for third reading,

Mr. Fearon moved that said bill be recommitted to the committee on finance, with instructions to said committee to report the same forthwith, amended as follows:

Page 2, strike out lines 17 to 19 both inclusive.

Page 2, line 20, strike out "chairman of the commission."

Page 3, line 20, after "statute" strike out the remainder of the line and insert a period.

Page 3, strike out lines 21 to 25, both inclusive and insert in place thereof the following: "The commissioner of farms and markets shall establish a bureau in the department of farms and markets to be known as the bureau of the state fair. He shall appoint a director of such bureau who shall receive an annual salary of not to exceed ten thousand dollars and who shall serve during the pleasure of the commissioner."

Page 3, line 27, after "mean" strike out the remainder of the line and insert "the department of farms and markets." Page 4, strike out lines 1 and 2.

No. 316) entitled "An act to confer jurisdiction on the Court of Claims to hear, audit and determine the claim of Francesco Valerio against the State for the unpaid amount and value of certain work performed and materials furnished in connection with a certain highway construction contract, and to render judgment therefor,' was read the third time.

Allen, as administrators of the estate of Lawrence Allen, deceased, against the State for personal injuries resulting in decedent's death on the thirteenth day of April, nineteen hundred and twenty-four, in the town of West Sparta, Livingston county, and to render judgment therefor," was read the third time.
