The said Assembly bill was again read the third time. The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message that the Senate has concurred in the passage of the same. Mr. Higgins moved to take from the table the motion to reconsider the vote by which Senate bill (No. 265, Int. No. 262) entitled "An act to amend the Code of Criminal Procedure, in relation to proceedings to determine the question of sanity," was lost. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Thompson offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor requesting the return to the Senate of the Senate bill (No. 1258, Int. No. 1160) entitled "An act to amend the Conservation Law, in relation to the unlawful taking of lobsters," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution and it was decided in the affirmative. Ordered, That the Clerk deliver said resolution to the Assembly and request its concurrence therein.

The Assembly returned the above resolution with a message that it has concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Westall offered a resolution, in the words following:

Resolved. That there be printed for the use of the Senate one thousand (1000) additional copies of Senate bill (Int. No. 1142, Print No. 1639) entitled "An act in relation to the government of Westchester county in conformity with section twenty-six of article three of the Constitution.

The Clerk furnished a list of the absentees to the Sergeant-atArms, who appeared in due time before the bar of the Senate, with Messrs. Whitley, Westall, Downing, Karle, Twomey, Walker, Wales, Schackno, Love, each of whom was excused.

Mr. Knight moved that further proceedings be continued under the call of the Senate.

The Senate bill (No. 1648, Int. No. 1270) entitled "An act to amend chapter six of the Laws of nineteen hundred and twentyfour, entitled 'An act extending the application and the time of application of certain acts of the years nineteen hundred and twenty and nineteen hundred and twenty-one, nineteen hundred and twenty-two and nineteen hundred and twenty-three, relating to defenses in actions based upon unjust, unreasonable and oppressive agreements for rent of premises occupied for dwelling purposes in certain cities, and to summary proceedings to recover the possession of real property in certain cities,' in relation to further extending its provisions to February fifteenth, nineteen hundred and twenty-seven," having been announced for third reading,

Mr. Nicoll moved that said bill be recommitted to the committee on affairs of cities with instructions to said committee to strike the enacting clause therefrom.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Senate bill (No. 1331, Int. No. 1219) entitled "An act to amend the Civil Practice Act, in relation to notice of personal injury before commencing action," having been announced for third reading,

Mr. Baumes moved that said bill be recommitted to the committee on codes with instructions to said committee to strike the enacting clause therefrom.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Assembly bill (No. 1857, Rec. No. 377) entitled "An act to amend chapter four hundred and fifteen of the Laws of nineteen hundred and thirteen. entitled 'An act to establish a State commission for improving the condition of the blind in the State

of New York, and making an appropriation therefor,' in relation to investigation by the commission of the immediate needs of blind people," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present as follows:

No. 1461) entitled "An act making an appropriation for the Department of Farms and Markets to defray the expenses of such department, heretofore or hereafter incurred, for printing, advertising and supplies," was read the third time.

No. 1296) entitled "An act making an appropriation for the payment of bonuses and the expenses of the New York State Bonus Commission, as provided by chapter nineteen of the Laws of nineteen hundred and twentyfour, entitled 'An act authorizing the creation of a debt of the State and the issuance and sale of bonds to provide for the pay

ment of bonuses to honorably discharged soldiers, sailors and marines of the World War who were actual residents of the State at the time of their enlistment or induction into the military or naval service of the United Service,' as amended," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill. the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, two-thirds of all the Senators elected voting in favor thereof, as follows:
